VIII. We will alfo, and by thefe prefents, for us, our heirs and fucceffors, do give and grant licence by this our charter, unto the faid Edward earl of Clarendon, George duke of Albemarle, William lord Craven, John lord Berkley, Anthony lord Afhley, Sir George Carteret, Sir William Berkley, and Sir John Colleton, their heirs and affigns, and to all the inhabitants and dwellers in the province aforefaid, both present and to come, full power and abfolute authority, to import or unlade, by themfelves, or their fervants, factors or affigns, all merchandizes and goods whatsoever, that shall arife of the fruits and commodities of the faid province, either by land or by fea, into any of the ports of us, our heirs and fucceffors, in our kingdom of England, Scotland or Ireland, or otherwife to difpole of the fame goods, in the faid ports; and if need be, within one year next after the unlading, to lade the faid merchandizes and goods again into the fame, or other ships, and to export the fame into any other countries, either of our dominions or foreign, being in amity with us, our heirs and

leton, their heirs and affigns, full and free licence, liberty and authority, at any time or times, from and after the feaft of St Michael the arch-angel, which fhall be in the year of our Lord Chrift one thousand fix hundred fixty and feven, as well to import, and bring into any of our dominions, from the faid province of Carolina, or any part there. of, the feveral goods and commodities herein after mentioned, that is to fay, filks, wine, currants, raifins, capers, wax, almonds, oyl and olives, without paying or answering, unto us, our heirs or fucceffors, any cuftom, import, or other duty, for, or in respect thereof, for and during the term and space of feven years, to commence and be accompted, from and after the first importation of four tuns of any of the faid goods, in any one bottom, fhip or veffel from the faid province, into any of our dominions; as alfo to export and carry out of any of our dominions into the faid province of Carolina, cuftom free, all forts of tools, which fhall be useful or neceffary for the planters there, in the accommodation and improvement of the premises, any thing before, in these prefents contained, or any law, act, ftatute, prohibition, or other matter, or any thing heretofore had, made, enacted or provided, or hereafter to be had, made, enacted or provided to the contrary, in any wife notwithstanding.

X. And furthermore, of our more ample and especial grace, certain knowledge, and meer motion, we do, for us, our heirs and fucceffors, grant unto the faid Edward earl of Clarendon, George duke of Albemarle, William lord Craven, John lord Berkley, Anthony lord Afhley, Sir George Carteret, Sir William Berkley, and Sir John Colleton, their

heirs and affigns, full and obfolute power and authority, to make, erect and conftitute, within the faid province of Carolina, and the ifles and iflets aforefaid, fuch, and fo many fea ports, harbours, creeks and other places, for difcharge and unlading of goods and merchandizes out of fhips, boats and other veffels, and for lading of them, in fuch and fo many places, and with fuch jurifdiction, privileges and franchises, unto the faid ports belonging, as to them fhall feem molt expedient, and that all and fingular the fhips, boats and other veffels, which fhall come for merchandizes, and trade into the faid province, or fhall depart out of the fame, shall be laden and unladen at fuch ports only, as fhall be erected and conftituted by the faid Edward earl of Clarendon, George duke of Albemarle, William lord Craven, John lord Berk ley, Anthony lord Alhley, Sir George Carteret, Sir William Berkeley, and Sir John Colleton, their heirs and affigns, and not elfe where, any ufe, cuftom, or any other thing to the contrary in any wife notwithstanding.

Carteret, Sir William Berkley and Sir John Colleton, their heirs and affigns, full and abfolute licence, power and auchafe the thority, that the faid Edward earl of Clarendon, George duke of Albemarle, William Lord Craven, John lord Berkeley, Anthony lord Afhley, Sir George Carteret, Sir William Berkley, and Sir John Colleton, their heirs and affigns, from time to time hereafter for ever, at his and their will and pleáfure, may affign, alien, grant, demife or enfeof the premifes, or any parte or parcels thereof, to him or them that fhall be willing to purchase the fame, and to such person or perfons as they fhall think fit, to have and to hold, to them the faid perfon or perfons, their heirs and affigns, in fee fimple or fee tayle, or for term of life, or lives, or years, to be held of them the faid Edward earl of Clarendon, George duke of Albemarle, William lord Craven, John lord Berkley, Anthony lord Afhley, Sir George Carteret, Sir William Berkley, and Sir John Colleton, their heirs and affigns, by fuch rents, fervices and cuftoms, as fhall seem meet to the faid Edward earl of Clarendon, George duke of Albemarle, William lord Craven, John lord Berkley, Anthony lord Afhley, Sir George Carteret, Sir William Berkley, and Sir John Colleton, their heirs and affigns, and not immediately of us, our heirs and fucceffors, and to the fame person and perfons, and to all and every of them, we do give and grant by thefe, prefents, for us, our heirs and fucceffors, licence authority and power, that fuch perfon or perfons, may have or take the premises, or any parcel thereof, of the faid Edward earl of Clarendon, George duke of Albemarle, William lord Craven, John lord Berkley, Anthony lord Afhley, Sir George Carteret, Sir William Berkley, and Sir John Colleton, their heirs and affigns, and the fame to hold, to themselves, their heirs or affigns, in what eftate of inheritance whatfoever, in fee fimple or fee tayle, or otherwife, as to them and the faid Edward earl of Clarendon, George duke of Albemarle, William lord Craven, John lord Berkeley, Anthony lord Afhley, Sir George Carteret, Sir William Berkley, and Sir John Colleton, their heirs and affigns, fhall feem expedient; the ftatute made in the parliament of Edward, fon of King Henry, heretofore King of England, our predeceffor, commonly called the ftatute of Quia emptores terrarum; or any other ftatute, act, ordinance, ufe, law, cuftom or any other matter, caufe or thing heretofore publifhed or provided to the contrary, in any wife, notwithftanding.

XIV. And further alfo, we do by these prefents, for us, And to erect our heirs and fucceffors, give and grant licence to them the ties, cities, faid Edward earl of Clarendon, George duke of Albemarle, towns and William lord Craven, John lord Berkley, Anthony lord other fortis Afhley, Sir George Carteret, Sir William Berkley, and fications. Sir John Colleton, their heirs and affigns, full power, liberty and licence to erect, raise and build, within the faid province and places aforefaid, or any part or parts thereof, fuch, and fo many forts, fortreffes, caftles, cities, burroughs, towns, villages and other fortifications whatsoever, and the fame, or any of them to fortify and furnish with ordnance, powder, fhot, armory and all other weapons, ammunition, habilements of war, both offenfive and defenfive, as fhall be thought fit and convenient for the fafety and welfare of the faid province and places, or any part thereof, and the fame, or any of them, from time to time, as occafion fhall require, to dismantle, disfurnish, demolish and pull down, and also to place, conftitute and appoint, in and over all or any of the faid caftles, forts, fortifications, cities, towns and places aforefaid, governors, deputy governors, magiftrates, fheriffs and other officers, civil and military, as to them shall seem meet, and to the faid cities, burroughs, towns, villages, or any other place or places within the faid province, to grant letters or charters of incorporation, with all liberties, franchifes and privileges requifite and ufeful, or to, or within any corporations within this our kingdom of England, granted or belonging; and in the fame cities, burroughs, towns and other places, to conftitute, erect and appoint, fuch, and
