The contents of this volume consist in the main of a series of lectures delivered at the Illinois College of Law in 1910, and subsequently printed and used in the extension department of that institution. The chapters on "The Theory of Direct Legislation" and "The Theory of the Recall of Judicial Decisions" have been added to the original series especially for this volume, as these theories have developed since the original lectures were prepared. It is easy to see that by the use of copious quotations this volume could have been greatly extended, but an attempt has been made to present only the essential teachings of the authorities in order to make the trend of the argument clear. In the accomplishment of this task I fear that some important decisions have been omitted that should have been included. The writer had no idea at the time the original lectures were prepared that the courts of the country were destined to come in for such a wide share of political attention as they have in so short a time. But such a study as this must convince any one that the increased opportunity of the |
