SECT. II. And be it further enacted by the authority aforesaid, ers to make That it shall be the duty of the commissioners of the respective counties herein named, or a majority of them respectively, to make a contract or contracts with any person or persons for improving the navigation of the said creek within the limits before mentioned, or such parts thereof as they shall judge to be of the greatest public benefit: Provided always, That no contract as aforesaid shall be made directly or indirectly, with any one of the commissioners aforesaid.

SECT. IV. SECTION I. BE it

CHAPTER LXVI.

An ACT to enable Catharine Shaeffer, administratrix of John Shaeffer, late of the county of Berks, deceased, to convey a lot of ground to Philip Weaver.

WHERE

WHEREAS it appears to the legislature that John Shaeffer did in his lifetime sell, by parole, unto Philip Weaver, a lot of ground near the town of Womelsdorff, in the county of Berks, for the sum of sixty pounds; and that he did in his lifetime receive a moiety of the said purchase money from the aforesaid Philip Weaver; but that he, the said John Shaeffer, died without having made a deed to the said Philip Weaver for the lot aforesaid. And whereas it also appears that the said Philip Weaver is willing to pay the residue of the said purchase money, on receiving a deed, and that the administratrix of the said Jolan Shaeffer is also willing to complete the title for the said lot of ground to the said Philip Weaver, but cannot legally do it, inasmuch as there is no written evidence of contract: Therefore, to enable the said administratrix to make a conveyance,

CHAPTER LXVII.

An ACT dissolving the marriage of Isaac Peck, and Susannah, his

THEREAS it hath been represented by the memorial and petition of Susannah Peck, late of White Marsh township, Montgomery county, that she contracted marriage with Isaac Peck in the month of April, one thousand eight hundred and five, that shortly after their intermarriage, her said husband, regardless of his matrimonial vows, commenced a series of abusive conduct towards her, which he hath unrelentingly pursued until his abandonment of her in the month of October, one thousand eight hundred and nine, and whereas the barbarous, cruel and unjust conduct of the said Isaac Peck, to his wife Susannah, is satisfactorily proven to the legislature by sundry documents accompanying her petition, and as it satisfactorily appears that the said Susannah hath always maintained the character of an honest, inoffensive woman, and faithful wife: Therefore,

CHAPTER LXVIII.

An ACT to prevent Swine running at large within the township of
Kingston, in the county of Luzerne.

WHER

HEREAS the owners of lands in the township of Kingston, in the county of Luzerne, have heretofore sustained great damage and spoil in their meadows and cornfields, by swine running at large: And whereas the extension of the laws of this commonwealth, made to prevent the running of swine at large to the county aforesaid, has been found inadequate to a redress of the grievance by reason of the impracticability of keeping and supporting a sufficient fence or fences to prevent the trespassing of swine in that part of the aforesaid township, bounded by the west bank of the Susquehanna river, in consequence of the frequent inundations of the same: For remedy whereof, SECTION I. BE it enacted by the Senate and House of Repre sentatives of the Commonwealth of Pennsylvania in General Assembly met, and it is bereby enacted by the authority of the same, No hogs, &c. That from and after the first day of April next, it shall not be lawful for any swine, hogs, shoats or pigs, to go at large in the township of Kingston, in the county of Luzerne, whether yoked and ringed, or not; therefore, if any person shall find tresHogs tres passing on his, her or their lands, within the limits of the townpassing may ship aforesaid, any swine, hog or hogs, shoat or shoats, or pigs, it shall and may be lawful for him, her or them, all such swine, Proceeding hogs, shoats or pigs, to take, drive and carry away, or cause to thereupon: be taken, driven or carried away, and being so taken or carried away, the said takers shall forthwith acquaint the nearest justice of the peace thereof, and being by him legally attested that the said swine were taken trespassing as aforesaid, the said justice shall immediately appoint and order two disinterested persons of the neighbourhood, to make a just and reasonable appraisement of the damage done by the trespassing of the said swine, and the same being so made, to return to the said justice as soon as conveniently may be thereafter.
