IV. And be it further enacted by the authority aforesaid, that the Registers which kept to be va- shall have been so kept, and the several entries made therein according to the Laws

Public Act.

in force in this Province, as well as authentic copies of the entries therein made, shall to all intents and purposes be good and available in Law as if the said Register had been kept pursuant to the Act passed by the Legislature of this Province, in the thirty-fifth year of the Reign of His Majesty George the Third, intituled, “An "Act to establish the form of Registers of Baptisms, Marriages and Burials, to con"firm and make valid in Law the Registers of the Protestant Congregation of Christ Church, Montreal, and others which may have been informally kept, and to afford "the means of remedying omissions in former Registers." Provided always, that all and every the Regulations and requirements of the said Act with respect to the Registers therein mentioned, be also observed with respect to the Registers to be kept pursuant to this Act.

V. Provided always, and be it further enacted by the authority aforesaid, that the Ministers keeping Registers pursuant to this Act, shall in all respects comply with and be governed by the above recited Act, and shall in case of disobedience to the said Act be liable to the penalties in like cases provided by the said Act, which penalties shall also be recoverable, paid, applied and accounted for in the same manner as the penalties by the said Act imposed are thereby directed to be paid,applied and accounted for.

VI. And be it further enacted by the authority aforesaid, that this Act shall be deemed and taken to be a public Act, and as such shall be judicially taken notice of by all Judges, Justices of the Peace, and all others whom it may concern, without being specially pleaded.

V. Pourvu toujours, et qu'il soit de plus statué par l'autorité susdite, que les Ministres qui tiendront des Régîtres en conformité à cet Acte, se conformeront à tous égards et se gouverneront d'après l'Acte ci-dessus récité, et seront sujets, en cas de désobéissance envèrs le dit Acte, aux mêmes pénalités imposées par le dit Acte, et que ces pénalités seront recouvrées, payées, appliquées, et qu'il en sera rendu compte en la même manière et ainsi qu'il est ordonné de recouvrer, payer, appliquer, et rendre compte des pénalités imposées par le dit Acte.

Baptist Church lative enactment to record Births, celebrate Marriages and solemnize Funeral rights, gisters of Mar and to keep Registers authenticated in due form of Law for those purposes: and whereas it is equitable that the prayer of the said Petition should be granted :Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Lower Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act passed in the fourteenth year of His Majesty's Reign, "intituled, "An Act for making more effectual provision for the Government of the "Province of Quebec in North America," and to make further provision for the "Government of the said Province;" And it is hereby enacted by the authority of the same, that it shall be lawful for the said Reverend Abial Moulton, or any Minister for the time being of the said Church, chosen and appointed according to the rules and regulations thereof, to obtain, have and keep (subject always to the penalties by Law in this behalf provided) Registers duly authenticated according to Law, of all such Marriages, Births and Burials as shall be performed or take place under the Ministry of such Minister, and the Registers so kept (the necessary legal formalities as by Law already provided in relation to Registers of like nature being observed) shall to all intents and purposes have the same effect at Law as if the same had been kept by any Priest, or Minister of religion in this Province, any Law to the contrary notwithstanding.

II. Provided always and be it further enacted by the authority aforesaid, that no Minister of any such Congregation, shall be intitled to the benefit of this Act unless he shall have taken the oath of allegiance before a Judge of the Court of King's Bench for the district in which he shall reside, (which oath such Judge is hereby authorized and required to administer ;) and a certificate of the taking such oath shall be made by the Prothonotary of the said Court in duplicate, and signed by the Judge, and one copy of such certificate shall be filed of record in the office of such Prothonotary and the other shall be delivered to the person taking such oath; and for such certificate and the duplicate thereof, and for filing the same, the Prothonotary shall be entitled to two shillings and six pence currency, and no more; nor shall any such Minister be entitled to the benefit of this Act unless he shall, at the time of taking such oath as aforesaid, produce to the Judge who shall administer the same, the certificate of his ordination, and of the invitation or call to become their Minister by him received from his Congregation and of his installation as such Minister, or legally attested copies of such Documents respectively; and all such Documents shall be copied into each Register to be kept by such Minister under the authority of this Act, and the copies so made therein certified to be correct by the Prothonotary before such Register shall be authenticated by him or by any Judge

succéderont dans la charge Pastorale, soient autorisés par des dispositions Législatives, à enrégistrer les Naissances, à solemniser le Mariage, à Inhumer les morts, et à tenir des Régîtres authentiqués en conformité à la Loi pour ces fins; Et vû qu'il est équitable que la prière de la dite Pétition soit accordée: Qu'il soit donc statué par la Très Excellente Majesté du Roi, par et de l'avis et consentement du Conseil Législatif et de l'Assemblée de la Province du Bas-Canada, constitués et assemblés en vertu et sous l'autorité d'un Acte passé dans le Parlement de la Grande-Bretagne, intitulé, "Acte qui rappelle certaines parties d'un Acte passé dans la quatorzième Année du Règne de Sa Majesté, intitulé, "Acte qui pourvoit plus efficacement pour le Gouverne"ment de la Province de Québec dans l'Amérique Septentrionale ;" et qui pourvoit plus amplement pour le Gouvernement de la dite Province ;" Et il est par le présent statué par la dite autorité, qu'il sera loisible au dit Révérend Abial Moulton, ou à tout autre Ministre pour le tems d'alors de la dite Eglise, choisi et élu suivant les règles et règlemens d'icelle, d'obtenir, avoir et tenir (sujet toujours aux pénalités pourvues par la Loi à ce sujet) des Régîtres dûment authentiqués suivant la Loi, de tous tels Mariages, Naissances et Sépultures qui pourront être faits et avoir lieu sous le Ministère de tel Ministre ; lesquels Régîtres ainsi tenus, (les formalités nécessaires et légales déjà pourvues par la Loi, pour les Régîtres de même nature ayant été observées) auront à toutes fins et intentions les mêmes effets en Loi que s'ils eussent été tenus par aucun Prêtre ou Ministre de Religion dans cette Province, nonobstant toute Loi à ce contraire.

Pourvu toujours, et qu'il soit de plus statué par l'autorité susdite, qu'aucun Les Ministres Ministre de telle Congrégation n'aura droit au bénéfice de cet Acte, à moins qu'il préteront le n'ait pris le serment d'allégéance devant un Juge de la Cour du Banc du Roi pour légéance. le District dans lequel il fera sa résidence, (lequel serment tel Juge est par le présent autorisé d'administrer) et un certificat de la prestation de tel serment sera dressé par le Protonotaire de la dite Cour, en duplicata, et signé par le Juge, dont une copie sera déposée dans le Bureau de tel Protonotaire, et l'autre sera remise à la personne qui prêtera tel serment, et le dit Protonotaire aura droit de recevoir pour tel certificat, et le duplicata d'icelui, ainsi que pour le filer, deux chelins et six deniers courant, en tout et pas plus; et aucun tel Ministre n'aura droit au bénéfice de cet Acte à moins qu'il ne produise lors de la prestation de tel serment au Juge qui lui aura administré le dit serment un certificat de son ordination, et de l'invitation ou de la demande de devenir le Ministre de telle Congrégation, et de son installation comme Ministre susdit, ou des copies certifiées des dits documens respectivement; et tous les documens susdits seront transcrits dans chaque Régître que ' tiendra tel Ministre sous l'autorité de cet Acte, et les copies ainsi transcrites en icelui seront certifiées être correctes par le Protonotaire, avant que tel Régître ait été par lui authentiqué, ou par aucun Juge de la Cour; et nul tel Ministre n'aura de

III. And be it further enacted by the authority aforesaid, that nothing herein King's Rights, contained shall affect or be contrued to affect in any manner or way whatsoever the rights of His Majesty, his Heirs and Successors, or of any body politic or corporate, or of any person or persons, such only excepted as herein mentioned.
