CHAPTER 64.

An Act to confirm certain Borrowing by the Municipality of Cape Breton County, and to enable the said Municipality to Borrow Money to repay

2. Further borrowing powers.

WHEREAS, under a resolution of the Municipal Council of Cape Breton County, passed on the 23rd day of April, A. D. 1909, in accordance with the provisions of Chapter 71 of the Acts of 1909, the Council authorized the borrowing from the Royal Bank of Canada of the sum of $49,000;

And whereas, it became necessary to borrow further amounts from said Bank in order to meet the current legal expenditure and liabilities of the said Corporation for the year 1909, which became payable before the revenue for the said year was collected and paid;

And whereas, in consequence the sum of $31,507.48 was due to the Bank by the Municipality on the 12th day of January, A. D. 1910;

And whereas, by resolution of the Municipal Council duly passed on the 20th day of January, A. D. 1910, the said borrowing from said Bank was ratified and confirmed, and it was further resolved that legislation be obtained as in this Act hereinafter provided;

Be it therefore enacted by the Governor, Council, and Assembly, as follows:

1. The borrowing from the Royal Bank of Canada by the Warden and Treasurer of the Municipality of the County of Cape Breton on behalf of said Municipality during the year 1909, of further sums of money in addition to the amounts authorized by the resolution of the Council of said Municipality passed on the 23rd day of April, 1909, is hereby ratified and confirmed,

and it is hereby declared that the sum of $31,507.48 was thereby due and payable to the said Bank by the Municipality on the 12th day of January, 1910.

2. The Warden and Treasurer of the Municipality borrowing of Cape Breton County are hereby authorized to borrow powers. from the Royal Bank of Canada, or from any person or corporation a sum of money sufficient to pay said ndebtedness of $31,507.48 to the said Bank, with interest accruing thereon up to the time of said payment, the said money to be borrowed on a promissory note which shall be signed by the Warden or Treasurer on behalf of the Municipality, and said note to be made payable within a period of two years from the date of the said note, with interest at such rate as may be arranged by the Warden and Treasurer.

CHAPTER 65.

An Act to enable the Municipality of the County of Cumberland to provide for further assistance to the Maritime Winter Fair and to provide

4. Such sum of $280.00 as aforesaid shall be added by the Municipal Council to the amounts required by the municipality for general purposes each and every year and assessed upon the municipality and collected in like manner as such other amounts are assessed and collected.

5. The said Municipal Council of the county of Cumberland is hereby authorized and empowered to expend the sum of one hundred and fifty dollars in decorating the square and county buildings at Amherst aforesaid, for the "Old Home Week, 1910."

6. The said sum of $150 as aforesaid shall be added by the Municipal Council to the amounts required by the municipality for general purposes and assessed upon the municipality at the next ensuing general assessment thereafter and collected in like manner as such other amounts are assessed and collected.

CHAPTER 66.

An Act to amend Chapter 85 of the Acts of 1903-4,
entitled, "An Act to enable the Municipality of
Cumberland to grant aid to the Amherst
Hospital.''

SECTION 1.-Grant authorized.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 1 of said Chapter 85 of the Acts of Grant 1903-4, is hereby amended by striking out in the fifth line thereof the figures "$500.00,"' and inserting in lieu thereof the words and figures "One Thousand Dollars, ($1, 000.00).''

ments thereto, and the Mayor of said Town shall, upon resolution of the Council, issue debentures therefor under the seal of the Town, in the form A to Chapter 56 of the Acts of 1902, in such amounts and redeemable in such periods, not exceeding twenty years, and at a rate of interest not exceeding five per centum per annum, and payable at such places as the Council shall determine; and the proceeds of sale of such debentures shall be used for the purpose above mentioned and no other.

The Town shall annually assess and collect with the ordinary taxes of the Town a sum equal to one per cent. of the amount borrowed under the provisions of said Chapter 72 and amendments thereto, and of this Act, which sum, together with the sums paid by the owners of real estate fronting on said sidewalks, shall form a sinking fund for the redemption of the debentures issued under the authority of said Chapter and the amendments thereto, and of this Act.

The Town shall have a lien upon all real estate fronting on a street where permanent sidewalks have been or may be laid down under the provisions of said Act, for the several and respective amounts payable by the several and respective owners of the said real estate for such sidewalks, which lien shall without registration have priority over all other liens or encumbrances whatsoever upon such real estate.

2. The Council may include in the estimates in any one year hereafter, and assess and collect the same, a sum not to exceed fifty dollars to be paid to the directors or trustees of the fund for the erection of the proposed Memorial Tower to commemorate the establishment of Responsible Government in Nova Scotia.

3. Section 3 of Chapter 59 of the Acts of 1903-4 amount how is hereby amended by substituting for the words "thirty-first day of December" in the fourth and fifth lines thereof, the words "September thirtieth.''
