25. 26. Any person who wilfully or maliciously violates Penalty for the provisions of sections 23 and 25 of this Act shall, for such offence, on conviction thereof, be punished by fine not exceeding forty dollars or imprisonment not exceeding one month, or both, at the discretion of the justice or justices of the peace before whom the conviction is had.

27. No person shall lay or cause to be laid, any conductor which shall communicate with any conductor belonging to the Company, or in any way obtain, utilize or use the wires or electric current or service of the said Company, or attach any instrument or apparatus to any conductor or instrument of the Company, without the consent thereto of the Company.

28. 30. The Company shall paint or affix, and keep painted or affixed, their name, with the word "limited'' after it, on the outside of every office or place in which the business of the Company is carried on, in a conspicuous position, in letters easily legible, and shall have their name with said word "limited" after it, mentioned in legible characters in all notices, advertisements and other official publications of the Company, and other writings used in the transaction of the business of the Company; and for every neglect of a full compliance with the foregoing provisions of this section by any officer of the Company, such officer shall be liable to a penalty of twenty dollars.

31. The powers by this Act conferred to furnish franchises in electric current for lighting purposes shall not be exercised (excepting in connection with a current for power purposes) in any city or town in which a company or such city or town is already engaged in furnishing electric light, until an arrangement has been made with such company, city or town for the purchase of its franchises, plant and other property, by arbitration or otherwise.

32. This Act shall cease and determine if actual work is not commenced and continued within three years from the date of its passing.

Be it enacted by the Governor, Council, and Assembły, as follows:

1. The Head Office of the Company shall be at Head office. New Glasgow, in the County of Pictou, and all meetings of shareholders of the Company shall be held within the Province of Nova Scotia, at such time and place as may be fixed by the by-laws of the Company.

2. All Acts and parts of Acts inconsistent here- Repeal. with are hereby repealed.

CHAPTER 162.

An Act to Amend and Consolidate the Acts Relating to the Pacific Whaling Company, Limited.

WHEREAS, by section 1 of Chapter 191, Acts of 1903, Preamble. entitled "An Act to incorporate the South Sea Sealing Company, Limited,'' the persons hereinafter named,

and such other persons as they might in writing associate with them, their associates, successors and assigns, and such other persons as might become shareholders in the Company, were constituted and declared to be a body corporate under the name of "The South Sea Sealing Company, Limited;"'

And whereas, by section 1 of Chapter 159 of the Acts of 1905 the name of said South Sea Sealing Company, Limited, was changed to "The Pacific Whaling Company, Limited;'

And whereas, said Pacific Whaling Company, Limited, has bona fide commenced business and it has become desirable to amend and consolidate the Acts relating to such Company;

Be it enacted by the Governor, Council, and Assembly, as follows:-

Incorporation. 1. Edward Donohoe, merchant; James E. Donohoe, merchant; Richard O'N. Duggan, auctioner, and George A. Wooten, merchant, all of Halifax, Nova Scotia, and Sprott Balcom, William Grant and Reuben Balcom, of Victoria, British Columbia, master mariners, and Henry J. Balcom, of Port Dufferin, Halifax County, Nova Scotia, packer, and Joseph W. Peppett, of North Sydney, Cape Breton, master mariner, and such other persons as they have in writing associated with them, their associates, successors and assigns, and such other persons as have or may become shareholders in the Company, are declared to be and to have been a body corporate, under the name of "The Pacific Whaling Company, Limited,'' hereinafter referred to as "the Company.'

Powers.

2. The said Company shall have and be deemed to have had power and authority:

(a) To build, purchase, charter, hire, acquire and hold vessels of every kind, sort or description, propelled by steam, sail or any other motive power whatsoever, with their usual appurtenances;

(b) To sell, lease, let, charter, mortgage, assign, transfer, pledge, sail, operate and maintain vessels as aforesaid, for the purposes of the Company;

(c) To hunt, buy, kill, capture and breed whales, seals and fur-bearing animals, and to catch or cure fish and marine animals of all kinds whatsoever, and to buy and sell fish of all kinds and the products thereof;

(d) To buy and sell seal skins, furs and seal oil, and generally to carry on, manage and operate the trade or business of seal and whale hunting;

(e) To purchase, lease, acquire, let, occupy or hire lands or buildings, wharves, piers, landing places or docks, and all other structures necessary for the business of the Company;

(f) To acquire the goodwill of any business within the objects of the Company, and any vessels, gear, machinery, lands, privileges, rights and contracts appertaining thereto, and in connection with any such purchase to undertake the liabilities of the Company, association or person;

(g) To sell or otherwise dispose of the whole or any part or branch of the business or property of the Company;

(h) To carry on, manage and operate the trade or business of seal and whale hunting and fishing in such seas or places as the Company may from time to time determine;

(i) To tow and otherwise move, assist, help and aid vessels in distress or otherwise;

(j) To contract for the floating, assisting and aiding of wrecked and stranded vessels, and to purchase, buy, acquire, hire, lease, hold, transfer or dispose of wrecking or other pumps, gear or material incidental to or necessary for the floating or moving of wrecked or stranded vessels, or of vessels of any kind or in any position;
