shall be considered guilty of a misdemeanor, and on conviction thereof shall be fined in a sum not exceeding two hundred and fifty dollars, for each day such vessel or vessels shall remain within five hundred yards from the wharves, landing-places and shores of the said village, or be imprisoned for a time not exceeding six months, or both, by any court having cognizance thereof; the said fine when paid, to be applied, by the said board of health, to the purchase, hire or erection, support and maintenance of a public hospital for the said village, herein after mentioned.

28. And be it further enacted, That the said board of health Public hospi shall have power to call meetings of the freeholders and inhabitants tal. of the said village, at such time and place as they shall think proper, by giving eight days notice thereof: and it shall be lawful for the freeholders and inhabitants, at any such meeting, if they shall deem it expedient, to direct a sum of money to be raised for purchasing a lot or lots of land, either within or without the bounds of the said village; the title to the same to be taken in the name of "the president and trustees of the village of Brooklyn," (any law to the contrary notwithstanding,) and to erect thereon a building for a public hospital for the said village, or to purchase or hire a lot or lots of land, as aforesaid, with a building already erected thereon, and to appropriate the same to the purposes aforesaid; to be assessed, levied and collected in the same manner as other monies are assessed, levied and collected in the said village, and the said monies, when collected, shall be paid to the said board of health, who shall apply the same for the purposes aforesaid.

29. And be it further enacted, That every person practising Penalty for physic in the said village, who shall have a patient laboring under not reporting malignant or yellow fever, or any other pestilential or infectious disease, shall forthwith make a report in writing of the same, signed by the said physician, to some one of the said board of health; and for neglecting so to do he shall be considered guilty of a misdemeanor, and be liable to a fine of fifty dollars, which fine shall be sued for in an action of debt, in any court having cognizance of the same, in the name of the president of the said board of health; and when recovered shall be applied by the said board of health to the purchase, hire or erection, support and maintenance of a public hospital for the said village as aforesaid.

30. 31. And be it further enacted, That it shall and may be lawful tion may be for the said board of health, whenever they shall deem the same neceassary, to issue their proclamation, prohibiting or regulating the intercourse by land and ferries between the said village of Brooklyn and any other place where they shall learn that a pestilential or infectious disease doth prevail; and that all persons offending in the premises, shall be liable to punishment as for a misdemeanor, by fine and imprisonment, at the discretion of the court having cognizance thereof: and in case of the prevalence of any such pestilential or infectious disease, in a part of the said village of Brooklyn, it shall and may be lawful for the said board of health to inclose and shut up such part of the said village, and to exclude all persons therefrom, so as to prevent intercourse therewith.

32. 33. And be it further enacted, That whenever any putrid or unsound beef, pork, fish, hides or skins of any kind, or any other article endangering health, shall be found within the said village, it shall and may be lawful for the said board of health, or any person or persons acting under them, to cause the same to be destroyed, by starting it, or casting them into the stream of the east river, below low water mark, and at a suitable distance from the shore, or in such other manner as the said board of health shall or may from time to time direct.

34. And be it further enacted, That the said board of trustees shall have power to appoint, from time to time, one or more persons, as harbour master in the village of Brooklyn; and the said harbour master or masters, when so appointed, shall have power to regulate and order all ships or vessels lying at the wharves of the said village, and to remove from time to time, such ships or vessels as are not employed in receiving or discharging their cargoes, to make room for such others as require to be more immediately accommodated, for the purpose of receiving or discharging theirs; and if any master, or others having charge of such ships or vessels, shall neglect or refuse to obey the directions of such harbour master, he or they shall forfeit and pay the sum of fifty dollars, to be recovered, with costs of suit, for the use of the said village; and that such harbour master shall have the same fees for his services as are allowed to the harbor master of the city of New-York.

55. And be it further enacted, That the public fund or stock Village heretofore created in the said village, to defray the expense of building a public market, and denominated "the Brooklyn village stock," shall be and continue a public fund or stock, and that the certificates heretofore issued to the subscribers to the said fund or stock, shall be valid and effectual against "the president and trustees of the village of Brooklyn," for the several amounts therein expressed, and shall be held by the said subscribers, on the terms and conditions therein mentioned.

36. And be it further enacted, That it shall and may be lawful May be infor the board of trustees of the said village of Brooklyn, to increase the amount of the said fund or stock, for the purpose of paying the sand dollars. debts contracted in building and finishing the said market, and for the improvements around the same, to twenty thousand dollars; and for that purpose to cause books for subscription to the said stock, to be opened under the superintendence of the treasurer of the said board, or such other person or persons as they may appoint; and the said treasurer, or such other person or persons as may be therefor appointed, is hereby authorised to receive subscriptions to the said fund or stock, to the amount of five thousand dollars, in addition to the amount already subscribed; and the subscriber or subscribers to the same shall receive a certificate for the amount subscribed and paid, to be signed by the president of the said village, and the treasurer of the said board, of the like purport with those already issued, except that the said sum of five thousand dollars shall be made redeemable at the same time that the present stock is redeemable.

37. And be it further enacted, That it shall be the duty of the Treasurer's treasurer of the said board of trustees to enter in books to be by duty. him kept for that purpose, credits to the respective subscribers to the said funds, for the sums to which they shall respectively be entitled, to transfer the said credits, from time to time, as shall be requisite; to pay the interest due thereon, as the same shall become due, and generally to observe and perform such regulations concerning the same, as the said board of trustees may from time to time prescribe, and the said stock shall be transferable only, on the books of the said treasurer, by the owner or owners of the same, or his, her or their attorney for that purpose duly authorised.

38. And be it further enacted, That the certificates for the Certificates said stock, heretofore issued, and to be issued, for the same, in of stock. manner aforesaid, although not under the common seal of the said village, shall be binding and obligatory upon the said corporation, in like manner and with like force and effect, as though the same were issued under the said common seal.

serve civil or criminal process on board any or all such vessel or vessels, as shall or may at any time or times hereafter, lay attached or fastened to any of the landing places in the said village, or to any of the wharves of the same, by ropes, chains or otherwise, or attached and fastened to each other, and lying along side of any such wharves and landing places, in the said village, in the same manner to all intents and purposes, as they are now, or may hereafter be authorised to serve the same within the said village of Brooklyn, any law, usage or custom, to the contrary notwithstanding.

41. And be it further enacted, That every white male inhabitant of said village, above the age of twenty-one years, and under the age of sixty years, not exempt by any existing law from serving on juries, who shall possess in his own right a personal estate of the value of one hundred and fifty dollars, free from all reprises, debts, demands or incumbrances whatsoever, shall be liable to serve as a juror within the said village, in like manner as the freeholders thereof, any law to the contrary notwithstanding.

42. And be it further enacted, That all fines and penalties under any by-law of the said village in relation to the burning of chimnies, and for the preventing and extinguishing of fires, and also all fines and penalties either under such by-laws or any statute of this state, in relation to the manner of keeping and transporting gunpowder within the limits of the said village, shall be sued for in the name of the president and trustees of the said village, by the fire-department of the same, and when recovered shall be paid to the said fire-department for their own use.

43. And be it further enacted, That every person who now is a fireman of the village of Brooklyn, and who has served as such for the term of twelve years, and shall serve as such for four years hereafter; and every person who has served as such fireman as aforesaid for ten years, and shall serve as such for five years hereafter; and every person who has served as such fireman as aforesaid for eight years, and shall serve as such for six years hereafter; and every person who has served as such fireman as aforesaid, for six years and shall serve as such for eight years hereafter; and every person who has served as such fireman as aforesaid for four years, and shall serve as such for ten years hereafter; and every other person who at the time of the passing of this act, is, or shall hereafter become such fireman as aforesaid, and shall serve as such for twelve years thereafter, shall, for ever after such service be exempt from serving as a juror in any of the courts of this state, and from all militia duty, except in cases of actual service; and a certificate of such service, signed by the chief engineer and countersigned by the clerk of the board, shall be evidence thereof.

44. And be it further enacted, That the treasurer, collectors and marshals of the said village, shall, before they enter upon the duties of their respective offices, execute bonds to the president and trustees of the said village, in such sums, and with such securities, as the board of trustees shall direct and approve.

45. And be it further enacted, That the president and trustees of the said village of Brooklyn, shall severally be, ex-officio, conservators of the peace, in and for the said village, and shall be and they are hereby invested with like powers to quell all riots,

routs, disturbances and other breaches of the peace, and to commit the offenders therein to prison or confinement, in like manner as the justices of the peace of the county of Kings are by law authorised to do.

46. And be it further enacted, That it shall and may be law- Salaries. ful for the said board of trustees to give and grant unto the president of the said village, for the time being, such salary per annum, (including his compensation as president of the board of health,) as the said board of trustees shall direct, not exceeding five hundred dollars, to be paid out of the treasury of the said village, quarter yearly; and the treasurer, health physician, clerk, assessors and collectors of the said village; the clerk of the board of health, and the inspectors of the general and village election, shall severally receive such compensation for their services as the said board of trustees shall deem reasonable and proper; and all sums of money which shall be taken and received by the said president, or by the trustees of the said village, as fees or perquisites shall be paid over to the treasurer, for the use of the said village; any thing herein before contained to the contrary notwithstanding.

47. And be it further enacted, That there shall be, and hereby Municipal is established within and for the said village of Brooklyn, a court to be called "the municipal court;" and it shall and may be lawful for the person administering the government of this state, from time to time to nominate, and, with the consent of the senate appoint, three proper and discreet persons to be known by the name of the justices of the municipal court, who shall hold their office for the term of three years; and the said justices shall be, and they hereby are invested with all and singular the powers of justitices of the peace for the county of Kings.

48. And be it further enacted, That the said justices shall have Justices pow power and authority to hold a court at such proper and convenient place in said village, as the board of trustees of the said village shall appoint and provide; and shall have exclusive jurisdiction in the said village, to hear, try and determine all actions which are now cognizable before a single justice of the peace within the limits of the said village; and also to hear, try and determine all like actions, wherein the sum or thing demanded shall not exceed the value of one hundred dollars.

49. And be it further enacted, That it shall and may be lawful for Trustees to appoint justhe board of trustees for said village to nominate, and for the said tices and justices to appoint some suitable person to be clerk of the said court, who shall hold his office during the pleasure of the said board of trustees; and who shall, before he enters upon the duties of his office, enter into a bond with sufficient surety to the president and trustees of the village of Brooklyn for the faithful execution of his trust; and it shall be the duty of the said clerk to enter or register in proper books, to be kept for that purpose, a docket of all process which may be issued from the said court and of the returns thereof; and also proper entries of all acts, orders, decrees, judgments, adjournments and proceedings of the said court, and also the substance of the plaintiff's demand and of the defendant's plea; and that all applications for process for the recovery of any debt or demand to be sued for in said court, shall be made to the clerk of the same; which process shall be tested in the name of the said
