habitants, of the age of twenty-one years and upwards, of the town of Cayuta, in the county of Tioga, who are in possession of lands, under contract for the same, and are worth the sum of one hundred and fifty dollars in personal property, or have made improvements on such lands to that amount, shall be eligible to any town office, in said town, and shall be deemed eligible to serve on juries, in any court to be holden before any justice of the peace, for said town, although such person may not be a freeholder of said town.

CHAP. 29.

AN ACT authorising the Baptist Church and Congregation in
Scipio to alter their corporate name.

Passed January 27, 1827.

BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That from and after the passage of this act, it shall and may be lawful for the first Baptist church and congregation, in Scipio, to assume and take the corporate name of the first Baptist church and congregation of Venice and Scipio.

CHAP. 30.

AN ACT relative to Kingston Academy.

Passed January 27, 1827.

BE it enacted by the People of the State of New York, represented in Senate and Assembly, That the president of the board of trustees of Kingston academy, for the time being, or any three of the trustees thereof, are hereby authorised to call a meeting of the said board of trustees for the transaction of business; and that whenever five of the said trustees, of whom the president shall be one, shall be assembled for that purpose, pursuant to previous notice given to a majority of the said board, they shall constitute a quorum, and may proceed to transact business, in the same manner as if a majority of the said board were assembled.

CHAP. 31.

AN ACT for the relief of Richard W. Tappen.

Passed January 31, 1827.

BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That Richard W. Tappen, collector of the town of Kingston, in the county of Ulster, shall have until the first day of March next, to collect the taxes of said town of Kington, and to settle the same with the treasurer of said county, any law to the contrary notwithstanding: Provided, That the said Richard

CHAP. 32.

AN ACT to amend and continue in force the act entitled "An act to incorporate the New-Hartford manufacturing society, in the county of Oneida."

Passed January 31, 1827.

WHEREAS the legislature by an act passed the thirtieth day of March eighteen hundred and ten, did incorporate Frederick Stanley and others, by the name and style of " the New-Hartford manufacturing society, in the county of Oneida :" And whereas the said act of incorporation has expired, by a limitation contained in said act: Therefore,

1. BE it enacted by the People of the State of New-York, repre sented in Senate and Assembly, That the above entitled act be, and the same is hereby revived, continued in force and extended for the term of fifteen years from the passing of this act, in the same manner as if the said act was herein fully recited.

2. And be it further enacted, That the said society shall be liable to the payment of all debts herotofore contracted and due from them, and shall be liable to be sued and prosecuted for the same, in like manner as if the said act of incorporation had not expired before the said debts were contracted; and that the said society may sue and prosecute for all and singular the debts which may be due and owing to said society, whether such debts were contracted before or after the expiration of their act of incorporation.

3. And be it further enacted, That the stockholders of the said society shall be held responsible, jointly and severally, in their individual capacities, to the amount of the stock held by them repectively, for any debts hereafter contracted by said society: Provided, That no prosecution shall be commenced against any of the stockholders until the person or persons having such demand or demands shall have first prosecuted the directors, or such stockholders as were directors at the time such debt or demand was contracted, to judgment and execution: And provided further, 'That no such suit shall be sustained without proof that payment thereof had been demanded of the proper officer of said society and refused or not complied with. 4. And be it further enacted, That the said society shall keep a book or stock ledger, in which shall be entered the name of every stockholder, and the number of shares he, she or they may respectively hold in said society; and no transfer of stock shall be valid unless entered in said book; which said book shall at all times, during business hours, be open to the examination of the stockholders, and to every other person, the payment of whose debt or demand has been refused: and in case the examination of such book shall be refused to any such person, the society shall forfeit and pay for every such refusal the sum of two hundred dollars, to be recovered in any court having cognizance thereof, in an action of debt, the one

half to the use of the people of this state, and the other half to the use of the person who shall sue for the same.

5. And be it further enacted, That nothing contained in this act, Banking preor the act hereby amended and renewed, shall be so construed as to hibited. authorize any banking or insurance operations.

6. And be it further enacted, That the legislature may, at any Right to retime, alter, modify or repeal this act.

CHAP. 33.

AN ACT for the relief of the collectors of taxes of the towns of Bern and Bethlehem, in the county of Albany.

Passed January 31, 1827.

BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That it shall and may lawful for David Reinhart, collector of taxes in the town of Bern, and David G. Seger, collector of taxes in the town of Bethlehem, in the county of Albany, severally to complete their collection of taxes, and make returns thereof to the treasurer of the said county, at any time before the first day of March next: Provided however, 'That the said David Reinhart and David G. Seger shall severally renew their securities, as such collectors, in such manner as the supervisors of said towns shall respectively, reasonably require.

CHAP. 34.

AN ACT to extend the time for the collection of taxes in the town of Grafton, in the county of Rensselaer.

BE it enacted by the People of the State of New-York, repre- Time extendsented in Senate and Assembly, That Samuel Hewet, the collector ed to Samue? of taxes of the town of Grafton, in the county of Rensselaer, be, and he is hereby authorised, under and by virtue of the warrant now in his hands, bearing date the fourteenth day of Noveinber one thousand eight hundred and twenty-six, signed by the supervisors of the county of Rensselaer, aforesaid, to proceed and collect of the several persons named in said tax list the amount due from them respectively, at any time before the first day of March next: hereby giving and granting unto him, the said collector, as full power, under and by virtue of said warrant, until the said first day of March next, as was and is now given him, until the first day of February next: Provided however, That the said Samuel Hewet shall renew his security, as such collector, in such manner as the supervisor of the said town shall reasonably require.

CHAP. 35.

AN ACT for the relief of the collector of taxes in the town of
Schodack, in the county of Rensselaer.

Passed January 31, 1827.

BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That it shall and may be lawful for Francis Baker, collector of the town of Schodack, in the county of Rensselaer, to have until the first day of March next, to make and complete the collection of taxes, in and for said town, and make return thereof, to the treasurer of said county: Provided, That the said collector and his sureties shall renew their security for such collector, in such manner as the supervisor of said town shall reasonably require.

CHAP. 36.

AN ACT to alter the time of holding town meetings in the town of
Windham, in the county of Greene.

Passed February 2, 1827.

BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That hereafter the annual town meetings, in the town of Windham, in the county of Greene, shall be held on the first Tuesday of April, instead of the first Tuesday of March, at such place as the electors of said town, at their annual town meeting, shall, from time to time, appoint: and that the several officers of said town of Windham, whose duty it is to meet on thể last Tuesday of February, shall meet on the last Tuesday of March, in each and every year hereafter, to transact such business as to their respective offices may appertain: Provided, That the first town meeting to be held in said town, by virtue of this act, shall be held at the place to which the annual town meeting now stands adjourned.

AN ACT to authorise the Supervisors of the County of Monroe, to raise money to build a Bridge across the Genesee river, at Cox's ferry.

BE it enacted by the People of the State of New-York, repre- Tax to be sented in Senate and Assembly, That the board of supervisors of the county of Monroe, shall be authorized, and are hereby directed at their next annual meeting, to cause to be levied, collected and paid, as the contingent charges of said county are by law directed to be levied and collected, a sum sufficient for building a good and sufficient bridge across the Genesee river at Cox's ferry, in said County: Provided, The sum so levied shall not exceed three thousand dollars, with the usual fees for collecting the same.
