CHAP. 97.

AN ACT to provide for the building an Asylum for the Deaf and Dumb in the City of New-York.

Passed March 23, 1827.

1. BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That the sum of ten thousand dollars be and the same is hereby appropriated, for the erection of an asylum for the deaf and dumb, to be located in the city of New-York, or in the village of Brooklyn, in Kings county: Provided, The directors of the institution for the deaf and dumb in the city of New-York, raise the same amount, for the same purpose; raise a like and whenever evidence is given to the comptroller of the state, that the like amount of ten thousand dollars is raised and deposited in some bank, applicable to the purposes aforesaid, then it shall be lawful for the directors of the "New-York institution for the instruction of the deaf and dumb," by their treasurer for the time being, to draw upon the comptroller of the state for ten thousand dollars, which sum, together with ten thousand dollars raised as aforesaid, shall be applied by the directors of the institution, for the purpose of obtaining a piece of ground by purchase or lease, and the erection thereon of a building or buildings for an asylum, and workshops. for the deaf and dumb: And provided further, That the directors of the said institution shall account to the comptroller for the expenditure of the sum hereby appropriated, and of the sum to be raised by the said directors; and that the price of the ground to be purchased, and the plan of the buildings to be erected, shall be submitted to the superintendent of common schools, and be by him approved, before the said sum of money shall be drawn from the treasury. 2. And be it further enacted, That it shall be the duty of the of common superintendent of common schools, from time to time, to enquire into the expenditures of the said institution, and the system of instruction pursued therein, to visit and inspect the schools and the lodgings of the pupils, to ascertain by a comparison with other similar institutions, whether any improvements can be made, and for that purpose to appoint such and so many persons as he shall from time to time deem necessary, visitors of the said schools, to suggest to the directors and to the legislature such improvements as he shall deem expedient, and to report annually to the legislature on all the matters aforesaid, and particularly the condition of the schools, the improvement of the pupils, and their treatment in respect to their board and lodging; and that no money shall be paid out of the treasury pursuant to this act, until the directors of the institution for the deaf and dumb in the city of New-York, shall have filed their assent to the provisions of this section, under their corporate seal, in the office of the secretary of state, and shall thereby consent at all times to submit to the inspection and inquiries herein directed.

3. And be it further enacted, That the directors of the said institution shall have power, in their discretion, to retain therein any of the pupils now authorised to be received by them, not exceeding eight at any one time, for a period not exceeding two

years beyond the time now allowed by law, and that the expense of such pupils, not exceeding one hundred and fifty dollars per annum for each, shall be paid in the same manner as is prescribed by law for the indigent pupils in the said institution.

4. And be it further enacted, That whenever notice shall be va cancyin given of any vacancy among the pupils, which any senate district pupils from is entitled to supply, and such vacancy shall not be filled within trict how two months after such notice, it shall and may be lawful for the directors of the said institution to receive pupils from any other district to fill such vacancy during the then current year, but for no longer time.

CHAP. 98.

AN ACT to amend the Act entitled "An Act to incorporate the
Parishville Turnpike Company.

Passed March 23, 1827.

1. BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That the commissioners of highways of the several towns in the county of St. Lawrence, through which the Parishville turnpike road passes, shall on or before the first day of June next, lay out the said turnpike into road districts, and shall assess and apportion the labour and money on said road, in the same manner as if said turnpike had been regularly laid out by the commissioners of highways: Provided, Nothing herein contained shall operate to discharge the said turnpike company from any liabilities which they may have heretofore

incurred.

2. And be it further enacted, That the said Parishville turnpike company shall be released from the whole of said road, and it shall not be lawful for said company to erect or keep up any gate on said turnpike road within the said county of St. Lawrence, but the said road shall be and remain a public highway in the said several towns through which the same passes.

CHAP. 99.

AN ACT to authorise the erection of additional Buildings and other improvements to the Greene County Poor-House, and for other purposes.

Passed March 23, 1827.

1. BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That a majority of the board of supervisors of the county of Greene, for the time being, be, and they are hereby authorised to erect, or cause to be erected, such additional buildings and improvements to the poor-house, in said county, for the support of the poor therein, as they may deem needful; and to levy and collect the amount of money necessary to defray the expenses of such improvements, as a contingent charge of the said

county: Provided however, That the expenditure for said additional buildings and improvements shall not exceed three thousand dollars.

2. And be it further enacted, That it shall and may be lawful for the overseers of the poor of the several towns of this state, by and with the directions and consent in writing of any justice of the peace in such town, at their discretion, to afford temporary relief or support to any poor person in their respective towns, without being compelled to send such poor person or persons to the county poorhouse, pursuant to the third section of the act to provide for the establishment of county poor-houses, passed November 27th, 1824.

AN ACT to amend the act, entitled "An act for the relief the Legal Representatives of John McDonald, deceased, and Archibald McIntyre," passed April 17, 1822.

Passed March 24, 1827.

BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That so much of the act hereby amended as requires that the water thereby contemplated to be drawn from the canal shall be drawn from some point between the Mohawk river and the city of Albany, be and the same is hereby repealed; and that it shall be lawful for the said Archibald McIntyre, by and with the consent of the canal commissioners, or a majority of them, to draw the said water from the canal at any point between the city of Albany and a point upon the canal, one mile north of the village of Waterford: Provided always, That any privilege to draw water from the canal, to be granted by virtue of this act, shall be subject to the same discretion of the canal commissioners as was the grant to be made by the act hereby amended, shall be the same in extent as the privilege in that act mentioned, shall in no wise operate to interfere with, prevent or injure the navigation of the canal, and shall be subject to the same power of the canal commissioners, or a majority of them, from time to time, to modify or wholly revoke any and every such privilege, and shall in all other respects be subject to the provisions, restrictions, limitations and conditions in that act mentioned and contained, except as is herein otherwise provided.

CHAP. 101.

AN ACT to change the name of Hiram Crabb.

BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That it shall be lawful for Hiram Crabb, of the city of Troy, to assume the name of Hiram Harrison, and by that name he shall hereafter be known, in all places whatso

ever.

CHAP. 102.

AN ACT extending the time allowed the North American Insurance Company to fill up their Capital Stock.

BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That the time allowed by the act, entitled " an act to incorporate the North American insurance company," passed 13th April, 1826, for filling up the stock of said company, shall be, and the same is hereby extended and continued until the first day of November, one thousand eight hundred and twenty

seven.

CHAP. 103.

AN ACT relative to the Tradesmen's Bank.

WHERES the president, directors and company of the Tradesmen's bank, of the city of New-York, by their petition under their common seal, have represented to the legislature that in consequence of various losses sustained by them, their capital is so far deficient as to prevent them from carrying on their business with advantage to the stockholders, without legislative aid, and have prayed relief in the premises: Therefore,

AN ACT to authorise Ohel Spelman and others to erect a Dam across the Genesee River, in the Town of Castile, in the County of Genesee.

the said Ohel Spelman, Sylvester Lathrop, Benjamin Damon, Stephen Rolph and Stephen Town, shall erect and keep in repair an apron or lock in said dam, of such construction as to render the passage safe and easy for rafts, arks and other boats used in said river, and suffer them to pass and repass without toll or any expense during the continuance of said dam: And provided further, That nothing in this act shall be so construed as to affect the rights of individuals who may be injured by reason of said dam.

2. And be it further enacted, That it shall be lawful to take the ters for ca- water from the said river at any time, for canals or other internal improvements, without reference to the rights granted by this act; and it shall not be lawful for the owners of the said dam to recover any damages therefor.

CHAP. 105.

AN ACT relative to the Canaan and Union Village Turnpike Road.
Passed March 26, 1827.

1. BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That from and after the passing of this act, it shall not be lawful for any person or persons to pass the bridge over Kinderhook creek, erected by the president, directors and company of the Canaan and Union Village turnpike road, near the mills of the widow Barton, in Chatham, with any beast or beasts, carriage or team, faster than a walk: and every person who shall pass the said bridge, or any part thereof, contrary to the provisions of this section, or the owner or owners of such beast or beasts, carriage or team, shall forfeit and pay, for each offence, the sum of one dollar, to be recovered by action of debt, with costs, by the said president, directors and company: Provided, That this prohibition shall not apply to sleighs when the bridge is not covered with snow or ice: And provided further, That it shall be the duty of the said president and directors to affix in a conspicuous place, on each end of the bridge, the usual notice that persons are liable to a fine of one dollar, for passing the bridge faster than on a walk.

2. And be it further enacted, That it shall be lawful for the said company to choose five directors instead of nine; and that three directors shall constitute a quorum for the transaction of business.

3. And be it further enacted, That it shall and may be lawful for the legislature, at any time, to alter, modify, or repeal this act.
