And be it further exacted, That the freeholders and inhabitants of each of the refpective towns hereby erected fhall be and hereby are impowered to hold town meetings and elect town officers as the freeholders and inhabitants of other towns in this flate may do by law; and that the inhabitants of each of the faid towns refpectively, and the towns officers to be by them elected, fhall have the like powers and privileges, and be fubject to the like regulations and penalties as the freeholders, inhabitants and town officers of other towns in this ftate are entitled and fubject to by law.

And be it further enated, That as foon as may be after the firft Tuesday of April next, the fupervisors and overfeers of the poor of the towns aforefaid, fhall by notice to be given for that purpose by the fupervifors thereof, meet together and apportion the poor maintained by the faid town of Schuyler and the poor money belonging to the fame previous to the divifion thereof, in an equitable manner. And if the fupervisors and overfeers of the poor cannot agree upon fuch divifion of the poor and poor money as aforefaid then and in fuch cafe the fupervisors of the County of Herkemer fhail at their next meeting apportion and divide the poor maintained and the poor money as aforefaid, in fuch manner as fhall appear to thein moft juft and equitable, and the faid towns thereafter refpectively fhall maintain their own poor.

CHA P. XLVII.

An ACT for dividing the Town of Sangerfield, in the County of Herkemer, Paffed 24th March, 1797. E it enacted by the People of the State of New-ork, reprefented in Senate end Affembly, That from and after the Monday preceding the first Tuefday of April next, all that part of the town of Sangerfield lying cafterly of the divifion line between the third and fourth quarters of the twentieth townthip fo called, be, and is hereby erefted into a feparate town by the name of Bridgewater, and that the first town meeting ia the faid town fhall be held at the dwelling houfe of Thomas Convers in faid town.

And be it further enacted, That all the remaining part of the town of Sangerfield be and remain a feparate town by the name of Sangerfield, and that the first town meeting in faid town fhall be held at the dwelling

houfe of Ebenezer Hale.

And be it further enacted, That the freeholders and inhabitants of the faid towns refpectively fhall be and hereby are impowered to hold town meetings and elect fuch town officers and enjoy all the previleges that the freeholders and inhabitants of other towns in this ftate may do by law.

And be it further enacted, That as foon as may be after the first Tuesday of April next, the fupervifors and overfeers of the poor of the towns aforefaid, fhall by notice to be given for that purpose by the fupervifors of the towns aforefaid meet together and apportion the poor main

CHAP. XLVIII.

An ACT for the better extinguishment of Fires in the Village of New Burgh in the County of Ulfter. Paffed 24th March, 1797.

E it enacted by the People of the State of New-York, reprefented in Senate and Affembly, That it fhall and may be lawful for the freeholders and inhabitants living in the town of New Burgh, having a right to vote at town meetings, and refiding within the following limits, to wit, beginning at a place on the weft bank of Hudfon's river, where a due west line will run fix rods north of the academy, the fame line to be continued to the weft line of the German patent, then fouth along the faid weft line to the fouth line thereof, then easterly along the fouth line of faid patent to Hudfon's river, then northerly along the fame to the place of beginning, to be called the village of New Burgh, to meet together at fuch place in the faid village of New Burgh, as the trustees herein after directed to be chofen fhall appoint, on the first Monday in may in every year, and then and there proceed to choose by ballot not less than three nor more than five trustees, to be called the trustees of the fire company in the village of New Burgh.

And be it further enacted, That the firft meeting of the freeholders and inhabitants in faid village for the purposes aforefaid, shall be holden at the house of Francis Brewfter..

Trustees to appoint And be it further enacted, That the faid trustees to he firemen to manage chofen as aforefaid, or a major part of them, fhall have the engines, &c. full power and authority to nominate and appoint a fufficient number of firemen (willing to accept) not exceeding twenty to every fire engine now provided or hereafter to be provided for the ufe of the faid village, out of the inhabitants being freeholders, or perfons renting tenements to the value of one hundred dollars per annum, to have the care, management, working and using the said fire engines, and the other tools and inftruments now or hereafter to be provided, for the extinguishing of fires within the faid village, which perfons fo to be nominated and appointed as aforefaid, fhall be called the firemen of the village of New Burgh, who are hereby required to be ready at all fres as well by night as by day, to manage, work and ufe the faid fire engines and other tools and inftruments aforesaid,

And be it further enacted, That upon the breaking out of any fire within the faid village, the trustees aforefaid and conftables of bies to attend on the faid town of New Burgh, then being in faid village, upon notice thereof, fhall immediately repair to the place where fuch fire fhall happen, with ftaves and fuch other badges of authority as fhall be ordained by a majority of them to be worn, and be aiding and affiling as well in extinguishing the faid fires as in preventing any goods from being ftolen, and alfo in removing and fecuring the fame, and in the execution of the duties required of them by this act, together with the juftices of the peace if any fhall be prefent. They are hereby authorized to command the affiftance of all and every of the able bodied inhabitants of faid village, whofe duty it shall be to obey and execute all orders and directions of the truftees and magiftrates aforesaid, in extinguishing faid fires, removing and fecuring of goods, providing water for the engines, and affifting the firemen in working the fame. And be it further enacted, That it fhall be lawful for the trustees aforefaid or a major part of them to direct and require the ininhabitants to forth habitants or owners of dwelling houfes and other buildings in faid village to provide themselves with fuch and fo many fire buckets, to be ready in fuch houfes and buildings for the purpofe of extinguishing fires, and to impofe fuch reafonable fines and penalties for dilobedience thereof as they fhall think proper, not exceeding the fum of three dollars for each bucket which fhall be neglected to be furnished as aforefaid.

And be it further enacted, That all fines incurred and adrecovered and appli- judged to be levied by the truftees aforefaid, fhall be recovered by any one of faid trustees aforefaid in his own name, before any juftice of the peace in the fame county, with costs of fuit, to be reported to the faid board of trustees and appropriated by a majority of the fame for the purpofe of procuring and keeping in repair the fire engines and other inftruments neceflary for the extinguishing of fires in the faid village of New Burgh.

freeholders and commonalty of the town of Kingfton in the county of Ulter, or the major part of them, to nominate and appoint a fufficient number of men (willing to accept) refiding within half a mile of the court houfe, not exceeding twenty to every fire engine now provided or hercafter to be provided for the ufe of the faid town, to have the care, management, working and ufing the faid fire engines and other tools and implements now or hereafter to be provided for extinguishing fires within the faid town: which perfons fo to be nominated and appointed as aforefaid, fhall be called the firemen of the town of Kingston, who are hereby required to be ready at all fires, as well by night as by day, to manage, work and use the said fire engines and other tools and implements aforesaid.

An ACT to divide the Town of Burlington in the County of Otfgo, into two
Towns, and to ascertain the Boundaries of the Towns therein mentioned.

within the following boundaries, to wit: Beginning at town of Burlington the foutheast corner of Smith's patent on the north line wwn by the name of of the town of Otfego, thence wefterly on faid line and the north line of the town of Butternuts to the Unadilla river, thence up faid river about fix miles on a straight line to a tree marked A D T-thence north eighty eight degrees eaft to the west line of Veree's patent, thence northerly to the northweft corner thereof, thence along the north line of faid patent and the lands formerly owned by John Johnson, and the fame line continued to the weft line of the town of Otfego, thence foutherly on faid line to the place of beginning, fhall be and is hereby erected into a feparate town by the name of Pittsfield, and that the first town meeting fhall be held at the house of Daniel Watfon in faid town; and that all the remaining part of the town of Burlington, shall be and remain a separate town by the name of Burlington, and that the first town meeting in faid town shall be held at the house of Willard Church.
