AWARDS OF REFEREES

RUSSEL MORGART vs. JACOB AND SAM NICODEMUS.

Accident in the course of employment-Furthering employer's interests-Service rendered at the request of the employer. Referee: Jacob Snyder, District No. 6. Hearing at Woodbury, Pa., January 2, 1917. Claim Petition No. 1699.

Facts.

The claimant was employed by the defendant as a thresher. On November 17, 1916 he appeared at the farm of L. R. Webber for the purpose of discharging his duties in operating the engine. Upon his arrival he found that the machine was not in operation but the belt was adjusted ready to start. At this time the defendant requested the claimant, with others, to assist in moving a water tank belonging to the threshing outfit. While so engaged the claimant's arm was caught between the wheel and the tank, causing a fracture of the radius of the claimant's left arm.

Conclusion and Award.

The claimant in assisting to move the water tank at the request of his employer was furthering his employer's interests and the accident which occurred was an accident in the course of employment. He is accordingly entitled to compensation.
