VII. Provided always, and be it further enacted by the Authority aforefaid, That Right forfeited, when and fo often as any Perfon to whom fuch Hereditary Right fhall have defcended fhall, without the Permiffion of His Majefly, His Heirs or Succeffors, fignified to the, Legiflative Council of the Province by the Governor, Lieutenant Governor or Perfon adminiftering the Government there, have been abfent from the faid Province for the Space of Four Years continually, at any Time between the Date of his fucceeding to fuch Right and the Time of his applying for fuch Writ of Summons, if he fhall have been of the Age of Twenty-one Years or upwards at the Time of his fo fuccceding, or at any Time between the Date of his attaining the faid Age and the Time of his fo applying, if he fhall not have been of the faid Age at the Time of his fo fucceeding; and allo when and fo often as any fuch Perfon fhall at any Time, before his applying for fuch Writ of Summons, have taken any Oath of Allegiance or Obedience to any Foreign Prince or Power, in every fuch Cafe fuch Perfon fhall not be entitled to receive any Writ of Summons to the Legislative Council by virtue of fuch Hereditary Right, unless His Majefty, His Heirs or Succeffors, fhall at any. Time think fit, by Inftrument under His or their Sign, Manual, to direct that fuch Perfon fhall be fummoned to the faid Council; and the Governor, Lieutenant Governor, or Perfon adminiftering the Government in the faid Provinces refpectively, is hereby authorized and required, previous to granting fuch Writ of Summons to any Perfon fo applying for the fame, to interrogate fuch Perfon upon Oath touching the faid feveral particulars, before fuch executive Council as fhall have been appointed by His Majefty, His Heirs or Succeffors, witin fuch Province, for the Affairs thereof.

X. Provided alfo, and be it further enacted by the Authority aforefaid, That if any Member of either of the faid Legiflative Councils fhall be attainted for Treafon in any Court of Law within any of His Majefty's Dominions, his Seat in fuch Council fhall thereby become vacant, and any fuch Hereditary Right as aforefaid then vested in fuch perfon, or to be derived to any other perfons through him, fhall be utterly forfeited and extinguished.

XI. Provided alfo, and be it further enacted by the Authority aforefaid, that whenever any Queftion fhall arife refpecting the Right of any perfon to be fummoned to either of the laid Legislative Councils refpectively, or refpecting the Vacancy of the Seat in fuch Legiflative Council of any Perfon having been fummoned thereto, every fuch Question fhall, by the Governor or Lieutenant Governor of the Province, or by the Person adminiftering the Government there, be referred to fuch Legislative Coun. cil, to be by the faid Council heard and determined; and that it fhall and may be lawful either for the Perfon defiring fuch Writ of Summons, or respecting whofe Seat fuch Queftion fhall have arifen, or for His Majefty's Attorney General of fuch Province in His Majefty's Name, to appeal from the Determination of the faid Council, in fuch Cafe, to His Majefty in His Parliament of Great Britain; and that the Judg. ment thereon of His Majefty in His faid Parliament fhall be final and conclufive to all Intents and Purposes whatever.

XII. And be it further enacted by the Authority aforefaid, That the Governor or Lieutenant Governor of the said Provinces refpectively, or the Perfon administering His Majefty's Government therein refpectively, fhall have Power and Authority from Time to Time, by an Inftrument under the Great Seal of fuch Province, to conftitute, appoint and remove the Speakers of the Legislative Councils of fuch Provinces refpectively.

XIII. And be it further enacted by the Authority aforefaid, That, for the Purpose of constituting fuch Affembly as aforefaid, in each of the faid Provinces respectively, it fhall and may be lawful for His Majefty, His Heirs or Succeffors, by an Inftrument under His or their Sign Manual, to authorize and direct the Governor or Lieutenant Governor, or Perfon adminiftering the Government in each of the faid Provinces refpectively, within the Time herein-after mentioned, and thereafter from Time to Time, as Occafion fhall require, in his Majefty's Name, and by an Inftrument un der the Great Seal of fuch Province, to fummon and call together an Affembly in and for fuch Province.

XV. Provided nevertheless, and be it further enacted by the Authority aforesaid, That the Provifion herein-before contained, for impowering the Governor, Lieutenant Governor, or Perfon adminiftering the Government of the faid Provinces refpectively; under fuch Authority as aforefaid from his Majefty, His Heirs or Succeffors, from Time to Time, to nominate and appoint proper Perfons to-execute the Office of Returning Officer in the faid Districts, Counties, Circles, and Towns or Townships, fhall remain and continue in force in each of the faid Provinces refpectively, for the Term of Two Years, from and after the Commencement of this Act, within fuch Pro. vince, and no longer; but fubject nevertheless to be fooner repealed or varied by any Act of the Legiflative Council and Affembly of the Province, affented to by His Majefty, His Heirs or Succeffors.

XVI. Provided always, and be it further enacted by the Authority aforefaid, That no perfon fhall be obliged to execute the faid Office of Returning Officer for any longer Time than one Year, or oftener than Once, unless it fhall at any Time be other wife provided by any A&t of the Legiflative Council and Affembly of the Province, alfented to by His Majefty, His Heirs or Succeffors.

XVII. Provided alfo, and be it enacted by the Authority aforefaid, That the whole Members in cach Number of Members to be chofen in the Province of Upper-Canada fhall not be less than fixteen, and that the whole Number of Members to be chofen in the Province of Lower-Canada shall not be lefs than fifty.

XVIII. And be it further enacted by the Authority aforefaid, That Writs for the Election of Members to ferve in the faid Allemblies refpectively, fhall be iffued by the Governor, Lieutenant Governor, or Perfon adminiftering His Majefty's Government within the faid Provinces refpectively, within fourteen Days after the fealing of fuch Inftrument as aforefaid for fummoning and calling together fuch Affembly, and that fuch Writs fhall be directed to the refpective Returning Officers of the faid Dif tricts, or Counties, or Circles, and Towns or Townfhips; and that fuch Writs fhall be
