Preamble. OF THE Governor in Council. PROVINCE OF To wit. AT His Majefty's Executive Council of and for the faid Province of Lower-Canada, held at the Castle of Saint Lewis, in the City of Quebec, in the faid Province, on Thurfday, the feventh day of July, in the Thirty-fixth year of His Majefty's reign, and in the year of our Lord, one thousand seven hundred and ninety-fix. PRESENT, HIS EXCELLENCY THE GOVERNOR IN COUNCIL. WHER HEREAS by an Act made and paffed in the laft feffion of the Provincial Parlia ment of Lower-Canada, intituled, " An Act for making temporary Provifion for "the Regulation of Trade between this Province and the United States of America by Land or by Inland Navigation," it is amongst other things enacted, that for and during the continuance of the said A&t, it fhall and may be lawful for the Governor, Lieutenant Governor or Perfon adminiftering the Government of this Province for the time being, with the advice and confent of His Majefty's Executive Council, by order or orders to be from time to time iffued and publifhed, to fufpend the operation of the whole, or of any part or parts of any Ordinance or Ordinances, or of any Act or Acts of the Legislature of this Province, relative to Trade and Intercourfe by Land or Inland Navigation, and to give directions and make regulations with refpect to Importations, Exportations, Duties or otherwife, for carrying on the Trade by Land or Inland Navigation, between the People and Territories of His Majefty in this Province, and the People and Territories of the United States of America, any Law, Statute, Cuftom or Ulage to the contrary in any wife notwithstanding. And whereas by a Treaty of Amity, Commerce and Navigation lately concluded between His Majefty and the United States of America, figned at London, the nineteenth day of November, in the year of Our Lord, one thousand feven hundred and ninety-four, a free Intercourse between His Majesty's Subjects and the Citizens of the faid United States of America, for the purposes of Commerce under certain Regulations therein contained, hath been stipuÎated and agreed upon: And whereas many articles of Goods and Merchandize, by the Laws of this Province of Lower-Canada, are now prohibited as well to be imported into the said Province of Lower-Canada from the faid United States as to be Exported therefrom to the faid United States, whereby it is become neceffary to make certain Provisions for carrying into effect the aforefaid Treaty according to the Tenor thereof; His EXCELLENCY the GOVERNOR doth therefore, by and with the advice and con fent DU Gouverneur en Confeil. VU que par un Acte fait et paffé dans la derniére Seffion du Parlement Provincial du Bas-Canada, intitulé," Alle qui fait une provifion temporaire pour le Reglement du Commerce, entre cette Province et les Etats Unis de l'Amérique, par terre ou par la navigation intérieure; il eft parmi d'autres chofes ftatué, que pour et durant la continuation du dit Acte il fera et pourra être loifible pour le Gouverneur, Lieutenant Gouverneur ou la Perfonne adminiftrant le Gouvernement de cette Province pour le tems d'alors, avec l'avis et confentement du Confeil Exécutif de Sa Majefté, par ordre ou ordres à être de tems à autre émanés et publiés, de fufpendre l'opération du tout, ou d'aucune partie ou parties d'aucune Ordonnance ou Ordonnances, ou d'aucun Acte ou Actes de la Législature de cette Province, relativement au Trafic et Commerce par terre ou par la navigation intérieure, et de donner des directions et faire des Réglemens à l'égard des importations, exportations, droits ou autrement, pour faire le Commerce par terre ou par la navigation intérieure, entre le Peuple et les Territoires de Sa Majefté dans cette Province, et le Peuple et les Territoires des Etats Unis de l'Amérique, nonobflant aucune Loi, Statut, Coutume ou Ufage au contraire. Et vu que par un Traité d'Amitié, de Commerce et de Navigation derniérement conclu entre fa Majefté et les Etats Unis de l'Amérique, figné à Londres le dix-neuvième jour de Novembre, dans l'Année de notre Seigneur, mil fept cens quatrevingt-quatorze, un Commerce libre entre les Sujets de Sa Majefté et les Citoyens des dits Etats Unis de l'Amérique pour les fins du Commerce fous de certains Reglemens y contenus, a été ftipulé et convenu. Et vu que plufieurs articles d'Effets et de Marchandifes, par les Loix de cette Province du Bas Canada, font présentement prohibés, auffi bien pour être importés dans cette Province du Bas-Canada des dits Etats Unis, que pour être exportés de là aux dits Etats Unis, c'eft pourquoi il eft devenu néceffaire de faire certaines provifions pour mettre en effet le Traité fufdit felon la teneur d'icelui; c'eft pourquoi Son EXCELLENCE le GOUVER NEUR Acta and Ordi 6.6 fent of His Majefty's Executive Council of and for the faid Province hereby order and direct, that the operation of an Ordinance, paffed in the Twenty-eighth year of the reign of His prefent Majefty, intituled, "An At or Ordinance further to regulate the Inland nances fufpended."Commerce of this Province and to extend the fame;" alfo of an Ordinance paffed in the fame twenty-eighth year of his prefent Majefly, intituled," An Ordinance for promoting "the Inland Navigation," alfo of an Ordinance paffed in the Thirtieth year of the reign of His prefent Majefty, intituled, "An Act or Ordinance in addition to the A&t intituled, an "All or Ordinance further to regulate the Inland Commerce of this Province and to extend the fame paffed in the Twenty-eighth year of His Majefly's reign;" alfo of an Ordinance paffed in the Thirty-firft year of the reign of His prelent Majefty, intituled, "An A&t or Or"dinance to explain and amend the Act intituled, an Act or Ordinance for promoting the Inland Navigation and to promote the Trade to the Western Country;" alfo of an Ordinance paffed in the fame Thirty-first year of the reign of His prefent Majefty, intituled," An A to prevent Obstructions to the Inland Commerce upon the Death of a Superintendant;" alfo of an Act of the Provincial Parliament of Lower- Canada palled in the thirty-third year of the reign of His prefent Majefty, intituled, " An All to permit the Importation of Wampum from the neighbouring States by the Inland communication of Lake Champlain and the River Ri"chelieu or Sorel;" allo of an Act of the Provincial Parliament of Lower-Canada, paffed in the Thirty-fifth year of the reign of His prefent Majefty, intituled, “An Act for allowing Pot and Pearl Afhes to be brought into this Province by Land or Inland Navigation, for prohibiting the Importation of Tobacco from the United States; for Regulating the Fees of "the Cuftom Houfe Officer of Saint John's, and for repealing the Act or Ordinance therein "mentioned;" and alfo of an Act of the Provincial Parliament of Lower-Canada, paffed in the present year of the reign of His prefent Majefly, intituled, "An Alt for allowing "the Importation of Salted Beef and Pork and Hog's Lard for a limited time from the United "States of America;" be fufpended, and the operation of the said Ordinances and Acts, and of each and every of them, and of every part thereof, is hereby fufpended. Duties. 66 AND His Excellency the Governor, by and with the advice and confent of the faid Executive Council doth hereby further order that it fhall and may be lawful to and for the Citizens of the United States of America and alfo to and for the Indians dwel ling on either fide of the boundary line between the faid Province of Lower-Canada and the faid United States freely to pafs and repass by land, or inland Navigation into and out of the faid Province of Lower-Canada, or any part or parts thereof, and to navigate all the Lakes, Rivers and Waters thereof and freely to carry on Trade with His Majesty's Subjects in the faid Province, provided always, that this order shall not be conftrued to extend to the admiffion of Veffels of the faid United States into the Sea Ports, Harbours, Bays or Creeks of the faid Province or into fuch parts of the Rivers in the faid Province,. as are between the mouth thereof and the highest Port of entry from the Sea, except in fmall Veffels trading bond fide between Montreal and Quebec. AND it is further ordered, that all goods and Merchandize, whose importation into this Province is not or fhall not be entirely prohibited, may freely, for the purpoles ment of the legal of Commerce, be carried, brought and imported into the fame, from the said United States in manner aforefaid, by His Majesty's Subjects and by the Citizens of the faid United States upon payment of the feveral and refpective Duties due and payable by His Majefty's Subjects on the importation of the like goods and Merchandize from Europe into the faid Province. Provifo. PROVIDED always that nothing in this order fhall extend or be construed to extend, to permit or allow any fuch goods or Merchandize to be unladen at any place or pla ces Actes et Ordon. Auffi d'une Ordonnance paffée dans la même trente-et-uniéme année du Règne de fa présente Majesté; intitulée," Acte "qui leve les obftacles dans le Commerce intérieur dans le cas de mort d'un Surintendant." Auffi d'un Acte du Parlement Provincial du Bas-Canada, paffé dans la trente-troifiéme année du Règne de fa préfente Majefté intitulé, "Acté qui permet l'importation de la Porcelaine ou Wampum des Etats veifins par la communication intérieure du Lac Champlain et la riviére Richelieu cu Sorel." Auffi d'un Acte du Parlement Provincial du Bas-Canada, paffé dans la trente-cinquième année du Règne de fa présente Majeflé, intitulé, "Acte qui permet l'entrée de la Potaffe et Perlaffe en cette Province par terre cu par la navigation interieure; qui défend l'importation du Tabac des Etats Unis, qui régle les honoraires "de l'Officier de la Douane à Saint Jean et qui rappelle un Acte ou Ordonnance Et aufli d'un Acte du Parlement Provincial du Bas-Canada palé dans la préfente année du Règne de fa préfente Majefté, intitulé, "Acte qui permet pour un tems limité "l'importation du Boeuf et Lard fales et du Saindoux des Etats Unis de l'Amérique," foit fufpendue et l'opération des dits Ordonnances et Actes, et de chaque et de chacun d'iceux, et de toute partie d'iceux, eft par la préfente fufpenduc. 66 mentionné." Er fon Excellence le Gouverneur, par et de l'avis et confentement du dit Confeil Exécutif, ordonne encore par la prefente, qu'il fera et pourra être loifible pour les Citoyens des Etats Unis de l'Amérique, et aufli pour les Sauvages qui demeurent fur les deux côtés de la ligne qui fépare la dite Province du Bas-Canada des Etats Unis, de paffer et repaffer librement par terre ou par la navigation intérieure, dans et hors de la dite Province du Bas-Canada ou dans aucune partie ou parties d'icelle, et de naviguer fur tous les Lacs, Riviéres et Eaux d'icelle et de commercer librement avec les Sujets de fa Majeflé dans la dite Province: Pourvu toujours, que cet ordre ne s'étendra pas à permettre l'entrée des vaiffeaux des dits Etats Unis dans les ports de mer, havres, baies ou ances de la dite Province, ni dans telles parties des rivieres de la dite Province qui font entre l'embouchure d'icelles et les plus hauts ports d'entrée de la mer, excepté dans des petits vailicaux trafiquant bona fide entre Montréal et Québec. Et il eft encore ordonné que tous effets et mai chandifes dont l'importation dans cette Province n'eft pas ou ne fera pas entiérement prohibée peuvent, pour les fins du commerce, être emmenés et importés librement des Etats Unis dans icelle de la maniére fufdite par les Sujets de la Majefté et les Citoyens des dits Etats Unis; en payant les différens droits refpecufs dus et payables par les Sujets de fa Majeflé sur l'importation de pareils effets et marchandife's venant d'Europe dans la dite Province. Pourvu toujours que rien dans cet ordre ne s'étendra où s'entendra s'etendre à permettre ou fouffrir qu'aucuns tels effets ou marchandifes foient déchargés, dans aucune place ou places ni dans aucun autre tems ou heures que les tems et heures ciaprès mentionnés et permis. St. John's decla◄ of entry. ees or any other times or hours, than is or are hereinafter mentioned and allowed. AND His Excellency the Governor, by and with the advice and confent of the faid Executive Council, doth hereby further order that no Duty of Entry fhall be payable or be levied or demanded by any Cuftom Houfe Officer or other perfon or perlons on any Peltries brought by land or inland Navigation into the faid Province, and that Indians paffing or repaffing with their own proper goods and effects of whatever nature, fhall not be liable to pay for fuch goods and effects, any Impoft or Duty whatever, unlefs the fame fhall be goods in Bales or other large Packages, unusual among Indians, which fhall not be confidered as goods belonging bonâ fide to Indians or as Goods intitled to the foregoing Exemption from Duties and Impofts; that no higher or other Tolls or Rates of Ferriage than what are or fhall be payable by His Majefty's Subjects, fhall be demanded by any perfon or perfons, of the Citizens of the faid United States of America, and that no Duties, under or by virtue of this order, fhall be payable on any Goods which fhall merely be carried over any of the portages or carrying places, within the faid Province of Lower-Canada, for the purpofe of being immedi ately re-imbarked and carried to fome other place or places, it being nevertheless hereby ordered, that this laft mentioned Exemption from Duty fhall extend only to fuch goods as are carried in the ufual and direct road across fuch portages or carrying places and are not attempted to be in any manner fold or exchanged during their pallage across the fame. AND His Excellency the Governor, by and with the advice and confent of the faid red the fole Port Executive Council, doth hereby further order that the Town of Saint John's, fituate upon the Weft fide of the River Richelieu or Sorel in the District of Montreal in the faid Province, fhall be and is hereby eftablished and declared to be the fole Port of entry and clearance for all Goods and Merchandize to be imported from the faid United States of America, into this Province by land or inland Navigation, and that it fhall not be lawful elfewhere to make entry of any Vellel, Boat, Raft or Carriage or of any Cargo or Load or of any goods, Warcs or Merchandize imported into this Province from the faid United States; and that the officers of Cuftoms of and for the faid Port of Saint John's fhall attend every day, Sundays excepted, in the Cuftom Houfe of the faid Port, for the discharge of the Duties of their Office between the hours of eight and twelve of the Clock in the forenoon and three and fix of the clock in the afternoon, from the first day of May to the first of October and from ten to three from the first day of October to the last day of April. AND His Excellency the Governor, by and with the advice and confent of the faid Executive Council, doth hereby further order that no Register, Manifeft, Certificate or other Document fhall be required for any Veffel belonging to the faid United States of America, arriving from thence at the faid Port of Saint John's, except the Documents and Papers which hereby are required. AND His Excellency the Governor, by and with the advice and confent of the faid Executive Council, doth further order that all Veffels, Boats, Rafts and Carriages of what kind or nature foever, containing Goods, Wares or Merchandize paffing by or through the faid Port of Saint John's, fhall be reported at the Custom Houle of the faid Port and be fubject to Vifitation and Search by the Officer or Officers of the Cuftoms established at the faid Port; and that upon the arrival of any Veffel, Boat, Raft or Carriage from any Port or Place in the faid United States, at the faid Port of Saint John's, the |
