legal Forms now refpectively exifting in the Two Countries, or in fuch other Manner as the faid Commiffioners fhail fee Caufe to require or allow.

The Award of the faid Commiffioners, or of any Three of them as aforefaid, shall in all Cafes be final and conclufive, both as to the Juftice of the Clain, and to the Amount of the Sum to be paid to the Creditor or Claimant: And the United States undertake to caufe the Sum fo awarded to be paid in Specie to fuch Creditor or Claimant without Deduction; and at fuch Time or Times, and at fuch Place or Places, as fhall be awarded by the faid Commiffioners; and on Condition of fuch Releafes or Affignments to be given by the Creditor or Claimant, as by the laid Commiffioners may be directed: Provided always, that no fuch Payment thall be fixed by the faid Commiflioners to take Place fooner than Twelve Months, from the Day of the Exchange of the Ratifications of this Treaty.

ART. VII. Whereas Complaints have been made by divers Merchants and others, Citizens of the United States, that, during the Courfe of the War in which His Majefty is now engaged, they have fuftained confiderable Loffes and Damage, by Reafon of irregular or illegal Captures or Condemnations of their Vellels and other Property, under Colour of Authority or Commillons from Ilis Majefty; and that, from various Circumftances belonging to the faid Cafes, adequate Compenfation for the Loffes and Damages fo fuftained cannot now be actually obtained, had, and received by the ordinary Courfe of judicial Proceedings; It is agreed, that in all fuch Cafes where adequate Compenfation cannot, for whatever Reafon, be now actually obtained, had and received by the faid Merchants and others in the ordinary Courfe of Juftice, full and complete Compenfation for the fame will be made by the British Government to the faid Complainants. But it is diftinctly understood that this Provifion is not to extend to fuch Loffes or Damages as have been occafioned by the manifeft Delay or Negligence, or wilful Omiffion of the Claimants.

That, for the Purpose of ascertaining the Amount of any fuch Loffes and Damages, Five Commiffioners fhall be appointed and authorized to act in London, exactly in Manner directed with refpect to those mentioned in the preceding Article; and after having taken the fame Oath or Affirmation (mutatis mutandis) the fame Term of Eighteen Months is alfo affigned for the Reception of Claims, and they are in like Manner authorized to extend the fame in particular Cafes. They fhall receive Teftimony, Books, Papers and Evidence in the fame Latitude, and exercise the like Difcretion and Powers refpecting that Subject; and fhall decide the Claims in Queftion according to the Merits of the feveral Cafes, and to Juftice, Equity, and the Laws of Nations. The Award of the faid Commillioners, or any fuch Three of them as aforelaid, shall, in all Cafes, be final and conclufive, both as to the Juftice of the Claim, and to the Amount of the Sum to be paid to the Claimant; and His Britannick Majefly undertakes to cause the fame to be paid to fuch Claimant in Specie, without any Deduction, in fuchi Place or Places, and at fuch Time or Times, as fhall be awarded by the fame Commiffioners, and on Condition of such Releases or Affignments to be given by the Claimants, as by the faid Commiffioners may be directed.

And whereas certain Merchants and others, His Majefty's Subjects, complain, that, in the Course of the War, they have fuftained Lofs and Damage by Reason of the Capture of their Veffels and Merchandize taken within the Limits and Jurifdiction of the States, and brought into the Ports of the fame. or taken by Veffels originally armed in Ports of the faid States:

It is agreed, that in all fuch Cafes, where Reftitution fhall not have been made agreeably to the Tenor of the Letter from Mr. Jefferfon to Mr. Hammond, dated at Philadelphia. September, 5, 1793 (a Copy of which is annexed to this Treaty:) the Complaints of the Par ties fhall be, and hereby are referred to the Commiflioners to be appointed by virtue of this Article, who are hereby authorized and required to proceed in the like Manner relative to these as to the other Cafes committed to them; and the United States undertake to pay to the Complainants or Claimants in Specie, without Deduction,

ART. VII. Et vu que des plaintes ont été faites par divers négociants et autres, Citoyens des Etats Unis, que pendant le cours de la guerre dans laquelle Sa Majefté eft actuellement engagée, ils ont foutenu des pertes et des dommages confidérables par les prifes illégales et irrégulieres ou condamnations de leurs vaiffeaux et propriétés fous pretexte d'autorité ou commiffions de Sa Majefté, et que par différentes circonftances attachées aux dits cas, une compenfation équivalente pour les pertes et dommages ainfi foutenus ne peut pas être maintenant obtenue ni reçue par le cours ordinaire de la Juftice, il eft convenu que dans tous les cas ou une conpenfation équivalente ne pourra pas, pour quelque raifon que ce foit, être maintenant obtenue et reçue par les dits négociants et autres, dans le cours ordinaire de la Juftice, le Gouvernement Britannique donnera aux dits demandeurs une ample et entiere compensation pour iceux. Mais il eft bien entendu que cette provifion ne s'étendra pas à telles pertes ou dommages qui ont été occafionnés par un retardement manifefte ou par la négligence ou omiffion volontaire des prétendants.

Qu'à l'effet détablir le montant de telles pertes et dommages, cinq Commiffaires feront nommés et autorifés d'agir à Londres, exactement dans la maniére dirigée pour ceux mentionnés dans l'article précédent, et après avoir pris le même ferment ou affirmation [mutatis mutandis] le même terme de dix-huit mois eft auffi alloué pour la reception des prétentions, et de la même maniere ils font autorités de le prolonger dans des cas particuliers. Ils recevront témoignage, livres, papiers et évidence dans la même étendue et exerceront à ce fujet les mêmes pouvoirs et difcretion; et décideront les pretentions en question fuivant les mérites des différents cas et conformément à la Juftice, l'équité et aux loix des nations. Le jugement des dits Commillaires ou de trois d'entre eux comme fus-dit, fera dans tous les cas final et conclufif, foit quant à la juftice de la prétention, ou quant au montant de la fomme à être payée au prétendant et fa Majefté Bruannique s'engage de le faire payer à tel prétendant en efpece, fans aucune déduction, à telle place et en tel tems qui feront affignés par les dits Commiffaires et fous condition de telles décharges et ceffions à être accordées par les prétendants, que les dits commiflaires pourront ordonner.

Et vu que certains negociants et autres, fujets de Sa Majefté, fe plaignent que dans le cours de la guerre ils ont foutenu des pertes et dommages par la prife des vaiffeaux et marchandifes pris en dedans des limites et jurifdiction des Etats, et conduits dans leurs ports, ou pris par des vaiffeaux originairement armés dans les ports des dits Etats; il eft reglé que dans tous femblables cas, où reftitution n'aura pas été faite conformément à la teneur de la lettre de Mr. Jefferson à Mr. Hammond, datee à Philadelphie, 5 Sept. 1793, dont copie eft annexée à ce traité, les plaintes des parties feront et font par le préfent référées aux Coinmiffaires qui feront nommés en vertu de cet article, qui font par le préfent autorifés et requis de procéder en la même maniere fur celles-ci que fur les autres cas; et les Etats Unis s'engagent de payer aux demandeurs ou prétendants, en efpece, et fans déduction, le montant de telles fommes qui leur feront allouées refpectivement par les dits Commillaires, et à tels tems et places fpecifiés

the Amount of fuch Sums as fhall be awarded to them refpectively by the faid Commissioners, and at the Times and Places which in fuch Awards fhall be specified; and on Condition of such Releases or Affignments to be given by the Claimants as in the faid Awards may be directed. And it is further agreed, that not only the now exifting Cafes of both Defcriptions, but also all such as fhall exift at the Time of exchanging the Ratifications of this Treaty, fhall be confidered as being within the Provisions, Intent and Meaning of this Article.

ART. VIII. It is further agreed, that the Commiffioners mentioned in this and in the Two preced. ing Articles shall be refpectively paid in fuch a Manner as fhall be agreed between the Two Par ties; fuch Agreement being to be fettled at the Time of the Exchange of the Ratifications of this Treaty. And all other Expences attending the faid Commiffions fhall be defrayed jointly by the Two Parties, the fame being previously afcertained and allowed by the Majority of the Com miffioners. And in the Cafe of Death, Sickness or neceffary Abfence, the Place of every fuch Commiffioner refpectively fhall be fupplied in the fame Manner as fuch Conmiffioner was firft appointed, and the new Commiffioner fhall take the fame Oath or Affirmation, and do the fame Duties.

ART. IX. It is agreed, that Britifh Subjects, who now hold Lands in the Territories of the United States, and American Citizens, who now hold Lands in the Dominions of His Majesty, shall continue to hold them according to the Nature and Tenure of their respective States and Titles therein; and may grant, fell or devife the fame to whom they pleafe, in like Manner as if they were Natives; and that neither they, nor their Heirs or Affigns, Thall, fo far as may refpect the faid Lands, and the legal Remedies incident thereto, be regarded as Aliens.

ART. X. Neither the Debts due from Individuals of the one Nation to Individuals of the o ther, nor Shares, nor Monies, which they may have in the Public Funds, or in the Public of Private Banks, fhall ever, in any Event of War or National Differences, be fequeftered or confifcated, it being unjuft and impolitic that Debts and Engagements contracted and made by Individuals having Confidence in each other, and in their refpective Governments, should ever be deftroyed or impaired by National Authority, on Account of National Differences and Dif

ART. XI. It is agreed between His Majesty and the United States of America, that there fhall be a reciprocal and entirely perfect Liberty of Navigation and Commerce between their respective People, in the Manner, under the Limitations, and on the Conditions fpecified in the following Articles.

ART. XII. His Majefty confents, that it fhall and may be lawful, during the Time herein af ter limited for the Citizens of the United States to carry to any of His Majefty's Iflands and Ports in the Weft Indias from the United States, in their own Vefleis, not being above the Burthen of Seventy Tons, any Goods or Merchandizes, being of the Growth, Manufacture or Produce of the faid States, which it is or may be lawful to carry to the faid lilands or Ports from the faid States in British Veffels; and that the said American Veffels fhall be fubject there to no other or higher Tonnage Duties or Charges than fhall be payable by British Veffels in the Ports of the United States; and that the Cargoes of the faid American Veffels fhall be fubject there to no other or higher Duties or Charges than fhall be payable on the like Articles, if imported there from the faid States in British Veffels.

And His Majefty also confents, that it shall be lawful for the faid American Citizens to purchase, load, and carry away, in their faid Veifels, to the United States, from the faid Islands and Ports, all fuch Articles, being of the Growth, Manufacture or Produce of the faid Iflands, as may now by Law be carried from thence to the faid States in British Veffels, and fubject only to the fame Duties and Charges on Exportation to which Brigh Veffels and their Cargoes are or ll be fubject in fimilar Circumftances,

ART. VIII. ART. IX. Il est arrêté que les sujets Britanniques qui maintenant poffedent des terres fur les territoires des Etats Unis, et les Citoyens Américains qui maintenant poffedent des terres dans les domaines de Sa Majefté, continueront à les poffeder, conformément à la nature et à la tenure de leurs biens et titres refpectifs; et pourront les concéder, donner et léguer à qui ils voudront de la même maniere que s'ils étoient natifs; et que ni eux, ni leurs hoirs et ayans caufe ne feront regardés comme étrangers pour ce qui regarde les dites terres et les droits lé gaux qui en dépendent.

ART. X. Que les dettes dues par les individus d'une nation aux individus de l'autre, ainsi que les parts ou argents qu'ils pourroient avoir dans les fonds publics, ou dans les banques publiques ou particulieres, dans un événement de guerre ou de contefte nationale, ne feront jamais fequeftrés ou confifqués, étant injufte et contraire à la politique que des dettes et engagements contractés et faits par des individus qui ont confiance l'un en l'autre ou dans leurs gouvernements refpectifs, foient jamais attaqués ou détruits par l'autorité nationale, rapport à des conteftes ou mécontentements qui regardent la nation.

ART. XI. Il eft arrêté entre Sa Majefté et les Etats Unis de l'Amérique, qu'il y aura réciproquement une entiere et parfaite liberté de navigation et de commerce entre leurs peuples refpectifs, dans la maniere, et fous les reftrictions et conditions fpécifiées dans les articles fui

ART. XII. Sa Majeflé consent qu'il fera et pourra être loifible pendant le tems ci-après limité aux Citoyens des Etats Unis. de tranfporter des Etats dans aucune des Ifles de Sa Majefté, et ports des Indes Occidentales, dans leurs propres vaiffeaux, n'étant pas audeffus du port de foixante et dix tonneaux, aucunes marchandifes et effets du cru, manufacture ou produit des dits Etats, qu'il eft ou peut être légal de porter des dits Etats aux dites Ifles ou ports dans des vaiffeaux Britanniques; et que les dits vaiffeaux Américains ne feront point fujets à d'autres ou à de plus forts droits de tonnage que ceux qui feront payables par les vaiffeaux Britanniques dans les ports des Etats Unis, et que les cargaifons des dits vaiffeaux Américains ne feront point fujets à d'autres ou à de plus grands droits ou frais que ceux qui feront payables fur les mêmes articles lorfqu'ils feront importés des dits Etats dans des vaiffeaux Britanniques.

Et Sa Majeflé confent auffi qu'il fera loifible aux dits Citoyens Américains d'acheter, charger et emporter dans leurs dits vaiffeaux aux dits Etats Unis, des dites Illes et ports tous les articles étant du cru manufacture ou produit des dites Ifles, qui par la loi peuvent maintenant être tranfportés de là aux Etats Unis dans des vaiffeux Britanniques, lefquels feront fujets feulement aux droits et frais d'exportation auxquels les vaiffeaux Britanniques et leurs cargaifons font ou feront fujets en femblables circonftances,

Provided always, that the faid American Veffels do carry and land their Cargoes in the United States only, it being exprefsly agreed and declared, that during the Continuance of this Article, the United States will prohibit and reftrain the carrying any Melaffes, Sugar, Coffee, Cocoa or Cotton, in American Veffels, either from His Majefty's Ilands or from the United States, to any Part of the World, except the United States, reasonable Sea Stores excepted.

Provided alfo, that it fhall and may be lawful, during the fame Period, for British Vellels to import from the faid Iflands into the United States, and to export from the United States to the faid Illands, all Articles whatever, being of the Growth, Produce or Manufacture of the faid Iflands, or of the United States refpectively, which now may, by the Laws of the faid States, be fo impor ted and exported. And that the Cargoes of the faid British Veffels fhall be subject to no other or higher Duties or Charges than fhall be payable on the fame Articles, if fo imported or exported in American Vellels.

It is agreed that this Article, and every Matter and Thing therein contained, fhall continue to be in Force during the Continuance of the War in which His Majefly is now engaged; and alfo for Two Years from and after the Day of the Signature of the Preliminary or other Articles of Peace by which the fame may be terminated.

And it is further agreed, that, at the Expiration of the faid Term, the Two Contracting Parties will endeavour further to regulate their Commerce in this Refpect, according to the Situation in which His Majefty may then find himself with refpect to the Wift Indias, and with a View to fuch Arrangements as may beft conduce to the mutual Advantage and Extenfion of Commerce.

And the faid Parties will then alfo renew their Difcuffions, and endeavour to agree, whether in any or what Cafes Neutral Veffels fhall protect Enemy's Property; and in what Cafes Provifions and other Articles, not generally Contraband, may become fuch. But, in the mean Time, their Conduct towards each other in thefe Refpects fhall be regulated by the Articles hereinafter inferted on thofe Subjects.

ART. XIII. His Majefty confents that the Veffels belonging to the Citizens of the United ·States of America fhall be admitted and hofpitably received in all the Sea-Ports and Harbours of the British Territories in the Eaft Indias. And that the Citizens of the faid United States may freely carry on a Trade between the faid Territories and the faid United States in all Articles, of which the Importation or Exportation refpectively to or from the faid Territories fhall not be entirely prohibited. Provided only, that it fhall not be lawful for them, in any Time of War between the British Government and any other Power or State whatever, to export from the faid Territories, without the fpecial Permiffion of the British Government there, any Military Stores or Naval Stores, or Rice. The Citizens of the United States fhall pay for their Veffels, when admitted into the faid Ports, no other or higher Tonnage Duty than fhall be payable on British Veffels when admitted into the Ports of the United States. And they fhall pay no other or higher Duties or Charges on the Importation or Exportation of the Cargoes of the faid Veffels than fhall be payable on the fame Articles when imported or exported in British Veffels. But it is exprefsly agreed, that the Veffels of the United States fhall not carry any of the Articles exported by them from the faid British Territories to any Port or Place, except to fome Port or Place in America, where the fame fhall be unladen; and fuch Regulations fhall be adopted by both Parties as fhall, from Time to Time, be found necellary to enforce the due and faithful Obfervance of this Stipulation.

It is alfo understood, that the Permiffion granted by this Article is not to extend to allow the Veffels of the United States to carry on any Part of the Coafting Trade of the faid Britifh Territories; but Veffels going with their original Cargoes, or Part thereof, from one Port of Discharge to another, are not to be confidered as carrying on the Coafting Trade. Neither is this Article to be conftrued to allow the Citizens of the faid States to fettle or refide within the faid Territories, or to go into the interior Parts thereof, without the Permiffion of the Bri
