Preamble. Governor to appoint Commissioner or Commissioners for the estab lishment of a Fever Hospital out of the li its of Quebec. Governor to CA P. XVIII. AN ACT for the establishment of a Temporary Fever Hospital for the reception of persons infected with Contagious Diseases. MOST GRACIOUS SOVEREIGN, Wcommended the (26th March. 1830.) WHEREAS His Excellency the Administrator of the Government has recommended the adoption of certain Legislative provisions for preventing the introduction of contagious diseases into this Province; May it therefore please your Majesty, that it may be enacted and be it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Lower-Canada, constituted and assembled by virtue and under the authority of an Act passed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act passed in the "fourteenth year of His Majesty's Reign, intituled, "An Act for making more "effectual provision for the Government of the Province of Quebec in North "America," and to make further provision for the government of the said "Province;" and it is hereby enacted by the authority of the same that it shall be lawful for the Governor, Lieutenant Governor or person administering the Government to appoint one or more persons to be Commissioner or Commissioners for the establishment of a temporary Fever Hospital in a retired situation outside the limits of the City of Quebec for the reception and medical treatment of such persons arriving in this Province from Seaward, as shall be found labouring under typhus fever, yellow fever, scarlet fever, plague, small pox or measles and of paupers infected with any of the said diseases; which temporary Hospital and the patients therein shall be under the care, direction management and superintendance of the Health Officer, to be appointed under the authority of this Act. II. And be it further enacted by the authority aforesaid, that the Governor, appina M Lieutenant Governor or person administering the Government may appoint a Medical Practitioner to be Health Officer for the purposes of this Act. dical Practitio oner to be Health Officer. And be it further enacted by the authority aforesaid, that the Harbour Master of the Port of Quebec, shall immediately after his first visit to any ves sel arriving in the said Port, report to the said Health Officer, whether such Vessel has on board any steerage passengers and if there be no such passengers whether there be on board such vessel any person infected with any of the diseases CAP. Mars, 1830.) 66 TRES-GRACIEUX SOUVERAIN, Ꮩ U que Son Excellence l'Administrateur du Gouvernement a recommandé l'adoption de certaines dispositions Législatives afin de prévenir l'introduction de maladies contagieuses dans cette Province ;-Qu'il plaise donc à Votre Majesté qu'il puisse être statué, et qu'il soit statué par la Très-Excellente Majesté du Roi, par et de l'avis et consentement du Conseil Législatif et de l'Assemblée de la Province du Bas-Canada, constitués et assemblés en vertu et sous l'autorité d'un Acte passé dans le Parlement de la Grande-Bretagne, intitulé, "Acte qui "rappelle certaines parties d'un Acte passé dans la quatorzième année du Règne "de Sa Majesté, intitulé, "Acte qui pourvoit plus efficacement pour le Gouver"nement de la Province de Québec, dans l'Amérique Septentrionale; Et qui pourvoit plus amplement pour le Gouvernement de la dite Province;" et il est par le présent statué par la dite autorité, que le Gouverneur, Lieutenant-Gouverneur ou la Personne ayant l'Administration du Gouvernement, pourra nommer une ou plusieurs personnes comme Commissaire ou Commissaires à l'effet d'établir une Hôpital temporaire pour les cas de Fievres, dans un endroit retiré en dehors de la Cité de Québec, pour la réception et le traitement médical des personnes venant de la mer en cette Province, qui se trouveront atteintes soit de la fièvre appellée typhus, de la fièvre jaune, de la fièvre rouge ou scarlatine, de la peste, de la petite vérole ou de la rougeole, et des indigens qui seront atteints d'aucune des dites maladies, lequel Hôpital temporaire et les malades qui y auront été admis seront sous les soins, direction, régie et surveillance de l'Officier de santé nommé sous l'autorité de cet Acte. II. Et qu'il soit de plus statué par l'autorité susdite, que le Gouverneur, Lieutenant-Gouverneur ou la Personne ayant l'Administration du Gouvernement pourra nommer un Médecin pratiquant pour être l'Officier de santé pour les objets de cet Acte. Et qu'il soit de plus statué par l'autorité susdite, que le Maître du Havre du Port de Québec, immédiatement après sa première visite abord d'aucun vais- Maitre du seau arrivant dans le Port susdit, fera rapport au dit Officier de santé s'il se trouve rivée des vaisà bord de tel vaisseau des passagers de l'avant, et s'il ne s'y trouve aucun tel pas-de sager, alors s'il y a à bord de tel vaisseau quelque Personne infectée de quel- Québec. qu'une X eaux dans le Who is to is any person any conta Officer, and herein before enumerated and if there be any such passengers or any person infected it shall be the duty of the said Health officer within forty-eight hours afreport if there ter receiving such report to visit and examine the said Vessel; and for the purinfected with pose of making such visit and examination the said Harbour Master shall furnish ious disease to the said Health officer a Boat and Boats Crew whenever he shall be thereunto to the Health required; and such vessel shall remain at anchor in the stream and no person assist him in shall be permitted to be disembarked therefrom or to quit such vessel in any way without a written permission signed by the said Health Officer under a penalty of twenty-five pounds currency, which penalty shall be incurred by the Master of the vessel from which any person shall have so disembarked or which he shall have left without such permission, and shall be sued for, recovered and enforced in the manner provided with respect to the penalty mentioned in the following section of this Act. the execution of his duty. And be it further enacted by the authority aforesaid, that the said Health Officer shall cause every person on board such vessel, who shall be afflicted with any of the diseases herein before enumerated, to be conveyed to the Temporary Hospital to be established under the authority of this Act and if he shall consider such vesssel or the cargo on board the same or any part thereof to be impregnated with the miasme of any contagious disease he shall cause such vessel or cargo to be disinfected by the use of the chloride of any oxide, or by any other means which he shall consider better adapted for effecting such disinfection, and any master of any such vessel who shall refuse to afford every possible facility to the said Health Officer or to assist him in conveying such persons so infected to the said temporary Hospital or in effecting such disinfection in the manner deemed most advisable by the said Health Officer, shall for such refusal incur a penalty of ten pounds currency, which penalty shall be recovered before the Justices of the Peace for the District of Quebec in any one of their Weekly Sessions, and if the said penalty be not paid by the offender immediately after his conviction, the said Justices of the Peace shall commit such offender to the common Gaol of the District until the same be paid. V. And be it further enacted by the authority aforesaid, that it shall be lawful for the Governor, Lieutenant Governor or person administering the Government to advance and pay during the present year one thousand eight hundred ed for the hire and thirty to the said Commissioner or Commissioners by a Warrant or Warrants under his hand and out of any unappropriated monies in the hands of the Receiver General, and at the disposal of the Provincial Legislature, a sum not exceeding seven hundred and fifty pounds currency, for the hire of a House to be used as such temporary Hospital, and for the purchase of articles of diet for of a House, &c. and other expences the qu'une des maladies ci-devant mentionnées; et s'il se trouve quelques passagers ou quelque Personne ainsi infectés, il sera alors du devoir du dit Officier de santé, dans les quarante-huit heures après la réception du dit rapport, de faire la visite et examen du dit vaisseau, et à l'effet de faire la dite visite et examen le Maître du Havre susdit sera tenu de fournir au dit Officier de santé une chaloupe avec ses Hommes d'équipage toutes les fois qu'il en sera requis, et le dit vaisseau demeurera à l'ancre enrade, et il ne sera permis à aucune Personue quelconque de débarquer du dit vaisseau, ou de laisser le dit vaisseau en aucune manière sans en avoir la permission par écrit signé par le dit Officier de santé, sous la pénalité de la somme de vingt-cinq livres courant, laquelle sera encourue par le Maître du vaisseau duquel telle Personne aura ainsi débarqué, ou qu'elle aura laissé comme il est dit ci-dessus sans la dite permission, et elle sera poursuivie et recouvrée en la manière prescrite à l'égard de la pénalité mentionnée dans la section suivante de cet Acte. IV. Et qu'il soit de plus statué par l'autorité susdite, que le dit Officier de santé fera tranporter hors de tout tel vaisseau toutes et telles Personnes qui s'y trouveront infectées d'aucunes des Maladies ci-dessus mentionnées et les fera conduire à l'Hôpital temporaire qui doit être établi sous l'autorité de cet Acte, et s'il juge que tel vaisseau ou la cargaison qui se trouve à bord d'icelui,ou aucune partie d'icelle est infectée de Miasme de quelque Maladie contagieuse, il procédera à la dèsinfection de tel vaisseau ou de sa cargaison, en employant la chlorure d'aucun des oxydes, ou en employant tous autres moyens qu'il jugera plus efficaces pour opérer telle désinfection, et tout Maître de tel vaisseau qui refusera de donner toutes les falicités possibles au dit Officier de santé, ou qui refusera de l'aider à transporter telles Personnes ainsi affectées à l'Hôpital temporaire, ou à effectuer telle dèsinfection en la manière la plus convenable que jugera le dit Officier de santé, encourra pour tel refus la pénalité de dix livres courant, laquelle sera poursuivie devant les Juges de Paix pour le District de Québec, dans leurs Sessions Hebdomadaires; et si la dite pénalité n'est pas payée par le contrevenant sur le champ, après condamnation, alors les dits Juges de Paix pourront ordonner que tel contrevenant soit détenu dans la Prison Commune du District, jusqu'à ce que la dite pénalité ait été payée. V. Et qu'il soit de plus statué par l'autorité susdite, que le Gouverneur, Lieutenant Gouverneur ou la Personne ayant l'Administration du Gouvernement pourra avancer et payer, durant le présente année Mil huit cent trente, au dit Commissaire ou Commissaires par un Warrant ou des Warrants sous son Seing à même les argens non affectés entre les mains du Receveur Général, et qui se trouveront à la disposition de la Législature Provinciale, une somme n'excédant pas sept cents cinquante livres courant, pour le Loyer d'une Maison pour être employée comme telle Hôpital temporaire, et pour l'achat d'objets propres à la nourriture X 2 des Application of the monies ed for to His Majesty. the sick and of bedding, kitchen utensils and medicines and for the payment of servants wages and for paying a just and reasonable remuneration to the said Health Officer for his services and the purchase of the articles by him required for the disinfection of vessels as aforesaid; and the said Commissioner or Commissioners shall within fifteen days after the opening of the next Session of the Provincial Legislature, lay before the several branches thereof a detailed account of the manner in which the sums of money to him or them advanced under the authority of this Act shall have been expended and applied; and the surplus of such monies (if any) shall be repaid to the Receiver General to remain in his hands at the future disposal of the Provincial Legislature. VI. And be it further enacted by the authority aforesaid, that the due application of the monies hereby appropriated, shall be accounted for to His Majesty, his Heirs and Successors through the Lords Commissioners of His Majesty's Treasury in such manner and form as His Majesty, his Heirs and Successors shall direct. CA P. XIX. AN ACT to appropriate a certain sum of Money for the purchase of a (26th March, 1830.) Preamble. Most Gracious SovEREIGN, HEREAS it is expedient to provide means for deepening and clearing out the several Ports and Rivers in this Province; May it therefore please your Majesty that it may be enacted, and be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Lower Canada, constituted and assembled by virtue and under the authority of an Act passed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act "passed in the fourteenth year of His Majesty's Reign, intituled, "An Act for making more effectual provision for the Government of the Province of Quebec in "North America, 'and to make further provision for the Government of the said “ Province,” and it is hereby enacted by the authority of the same, that it shall 19000 grant be lawful for the Governor, Lieutenant-Governor, or person administering the Government, to purchase a Steam Dredging Vessel, of about thirty-six horse power, with the necessary machinery and apparatus, and to pay for the same by warrant under his hand, a sum not exceeding three thousand pounds currency, ed for the purchase of a steam dredg ing Vessel for the purposes of this Act. ،، out |
