The expence of superin not to exceed XI. And be it further enacted by the authority aforesaid, that the expenses of tendance &c. administration and superintendence the salary of the Clerk and of the Overseer, and other contingent expenses herein-before mentioned and hereby authorised, shall not exceed in any case two and one half per cent, upon the amount of the monies which shall be expended by virtue of this Act. a certain sum &c. Said Gaol when built &c. to be the of the District of Montreal XII. And be it further enacted by the authority aforesaid, that when the said Gaol shall be erected and completed, and public notice by Proclamation to that Common Gaol effect shall have been given by the Governor, Lieutenant Governor, or Person administering the Government of the Province, for the time being, the same shall become and be a Common Gaol for the District of Montreal, and shall be placed under the charge of the Sheriff of that District for the use of which it is intended. &c. Monies to be accounted jesty &c. XIII. And be it further enacted by the authority aforesaid, that all the mofor to His Manies appropriated by this Act shall be paid and applied for the purposes therein set forth, and shall be accounted for to His Majesty, His Heirs and Successors, through the Lords Commissioners of His Majesty's Treasury for the time being, in such manner and form as His Majesty, His Heirs and Successors shall direct, and that the surplus of the monies not expended by virtue of this Act, shall remain at the future disposal of the Legislature. And be it further enacted by the authority aforesaid, that this Act shall be deemed a public Act, and shall be judicially taken notice of as such by all Judges, Justices of the Peace, and all other persons whomsoever, without being specially pleaded. Preamble. CA P. XXXII. AN ACT to repeal a certain Act therein-mentioned, and for the encouragement of the Trade and intercourse between the Ports of this Province and Halifax. 'HEREAS it is expedient that more effectual encouragement be offered for the establishment of an easy direct intercourse by means of Steam Vessels, between this Province and the Province of Nova Scotia, and that a Act 5 Geo. certain Act passed in the fifth year of Your Majesty's Reign, and intituled, "An IV. II. And be it further enacted by the authority aforesaid, that it shall be lawful for the Governor, Lieutenant Governor or person Administering the Government, to issue his Warrant for the payment out of any unappropriated monies in the hands of the Receiver General, of a sum not exceeding three thousand pounds currency, which sum shall be paid in the manner and under the provisions hereinafter set forth, to the person or company who shall first cause a steam vessel of not less than five hundred tons burthen, to be regularly navigated for four successive years, (the first of which may commence in all the month of August) between the Port of Quebec and other Ports in the River Saint Lawrence, and the Port of Halifax, during such part of the year as the navigation between the said Ports shall remain safe and open, the dangers of the navigation always excepted. III. And be it further enacted by the authority aforesaid, that of the sum hereby appropriated, the sum of one thousand two hundred and fifty pounds cursum shall be rency, shall be paid to the person or company immediately after the close of the first season during which the said vessel shall have been so navigated; a further sum of one thousand pounds currency, immediately after the close of the second season, during which such vessel shall have been so navigated; and the remaining sum of seven hundred and fifty pounds currency, immediately after the close of the third season, during which such vessel shall have been so navigated. No payment to be made upless the IV. Et qu'il soit de plus statué par l'autorité susdite, que le Gouverneur, Lieutenant Gouverneur ou la Personne ayant l'Administration du Gouvernement pourra émaner son Warrant pour qu'il soit payé sur les deniers non affectés qui se trouveront entre les mains du Receveur-Général, une somme n'excédant pas trois mille livres courant, laquelle somme sera payée en la manière et d'après les dispositions ci-après mentionnées, à la personne ou à l'association qui la première fera naviguer régulièrement entre les Ports de Québec et autres Ports dans le fleuve Saint Laurent et le Port d'Halifax pendant quatre années consécutives, dans la première desquelles le premier voyage pourra être fait dans le mois d'Août (les dangers de la navigation exceptés) un Vaisseau à Vapeur du Port de cinq cens tonneaux au moins, durant telle partie de chaque telle année que la navigation entre les dits Ports sera pratiquable et restera ou verte. III. Et qu'il soit de plus statué par l'autorité susdite, que sur la somme affectée par le présent, la somme de mille deux cents cinquante livres courant, sera payée à la personne ou à l'association susdite, aussitôt après la clôture de la première saison pendant laquelle le dit Vaisseau sera ainsi navigué; une somme ultérieure de mille livres courant, aussitôt après la clôture de la deuxième saison pendant laquelle tel Vaisseau aura ainsi navigué; et la somme restante de sept cents cinquante livres courant, aussitôt après la clôture de la troisième saison, pendant laquelle tel Vaisseau aura ainsi navigué. IV. Et qu'il soit de plus statué par l'autorité susdite, qu'il ne sera fait aucun tel payement ou avance à la clôture de chaque saison, à moins que le dit Vaisseau et son appareil à Vapeur n'aient été assurés jusqu'à la clôture de la saison alors prochaine, pour une somme qui ne sera pas moindre que celle de la somme qui doit être alors avancée, et aussi au montant de toute somme qui aura déjà été avancée. And be it further enacted by the authority aforesaid, that such repayment to be paid to the (if any there be,) shall be made to the Receiver-General of this Province, and the neral, for the sum or sums so repaid, shall remain in his hands, and await the disposal of the disposal of the Provincial Legislature for the public uses of the Province.
