Szc. 12. There shall be twelve stated meetings of the City Council in each year, at such times and places as may be prescribed by the City Council.

ARTICLE III.

OF THE EXECUTIVE OFFICER.

SEC. 1. The Chief Executive officer of the city shall be a Mayor, who shall be elected by the qualified voters of the city, and hold his office for two years, and until his successor shall be elected and qualified, and shall only be entitled to vote upon questions pending before, or which may be determined by the City Council when there is a tie vote of the Aldermen present, at which time he shall give the casting vote.

SEC. 2. No person shall be eligible to the office of Eligibility. Mayor who shall not have been a resident of the city for one year next preceding his election, or who shall be under twenty-five years of age, or who shall not at the time of his election be a citizen of the United States.

SEC. 3. It shall be the duty of the City Council, at their first meeting after the organization of the new Council, in each year, to elect one of their number Vice-Mayor, who shall perform the duties of Chairman of the Conncil in the absence of the Mayor and who shall be Mayor pro tem. during any temporary absence of the Mayor from the city, or in case of a vacancy occurring in the office of Mayor, during the interim until such vacancy shall be filled by an election as hereinafter provided.

SEC. 4. Whenever a vacancy shall occur in the City Council, either of the Mayor or Board of Aldermen, it is hereby made the duty of the City Council to immediately order an election to fill the vacancy. Provided, that no election shall be ordered in case of a vacancy in the office of Mayor when less.

than six months shall intervene between the occurrence of said vacancy and the next general city election.

SEC. 5. Whenever there shall fail to be an election of Mayor, voted for by the people, in consequence of two or more candidates receiving an equal number of votes for the said office, the election shall be determined by the casting of lots, in the presence of the City Council, and the result shall be entered upon their proceedings.

SEC. 6. Whenever an election for Mayor shall be contested, the City Council shall determine the same, as may be prescribed by ordinance.

ARTICLE IV.

OF ELECTIONS.

SEC. 1. On the first Monday of April, A. D. 1874, an election shall be held in each ward of said city for one Mayor of said city, one City Treasurer, and one Alderman in each ward, who shall hold their offices for two years, and until their successors are elected and qualified. And forever afterward there shall be held an election each year on the first Monday of April for the election of one Alderman for cach ward, and biennially on said day an election for one Mayor and one City Treasurer for said city. In all cases where two Aldermen are to be chosen from the same ward, at any annual election, the Alderman having the highest number of votes shall be declared elected for two years, and the candidate having the next highest number of votes, for one year. And in the case of the two successful candidates having an equal number of votes, the term of service to which they shall respectively be entitled, shall be determined by the casting of lots, in the presence of the City Council, and the result shall be .entered upon their proceedings.

SEC. 2. All male inhabitants over the age of twenty-one years, who are entitled to vote for members of the Territorial Legislature, and who shall have been actual residents of said city thirty days next preceding said election, shall be entitled to vote for city officers. Provided, that the said voters shall give their votes in the wards in which they respectively reside.

SEC. 3. All laws which may be passed by the Legislative Assembly of the Territory of Colorado in relation to the registration and qualification of electors shall be taken and held to apply to the electors and all elections held under this act.

ARTICLE V.

THE MAYOR.

SEC. 1. The Mayor shall preside at all meetings of the City Council, and in case of non-attendance of the Mayor or Vice-Mayor at any meeting, the Board of Aldermen shall appoint one of their own number as Chairman, who shall preside at the meeting.

SEC. 2. The Mayor or any two Aldermen may call special meetings of the City Council.

SEC. 3. The Mayor shall, at all times, be vigilant paties of the and active in enforcing the laws and ordinances for the government of the city; he shall inspect the conduct of all the subordinate officers of said city, and cause negligence or positive violation of duty to be prosecuted and punished; he shall from time to time. communicate to the Aldermen such information, and recommend all such measures as in his opinion may tend to the improvement of the finances, the police, the health, security, comfort, and ornament of the city. He shall be the head of the police force of the city, and shall have power to release prisoners confined in the city jail under judgment of the Police Magistrate for violation of the city ordinances.

Punishment of Mayor for alfeasance.

SEC. 4. He is hereby authorized to call upon every male inhabitant of said city over the age of eighteen years, to aid in enforcing the laws and ordinances, and in case of riots, to call out the militia to aid him in suppressing the same, or other disorderly conduct, preventing and extinguishing fires, for securing the peace and safety of the city, or in carrying into effect any law or ordinance, and any person who shall not obey such call, shall forfeit to said city a fine not exceeding twenty dollars.

SEC. 5. He shall have power, whenever he shall deem it necessary, to require of any of the officers of said city an exhibit of his books and papers.

SEC. 6. He shall have power to execute all acts that may be required of him by any ordinance made in pursuance of this act.

SEC. 7. He shall also have such power as may be vested in him by ordinance of the city, in and within all places within five miles of the boundaries of the city, for the purpose of enforcing the health and quarantine ordinances and regulations thereof.

SEC. S. In case the Mayor shall at any time be guilty of a palpable omission of duty, or shall willfully or corruptly be guilty of oppression, mal-conduct, or partiality in the discharge of the duties of his office, he shall be liable to be indicted in the District Court of the proper county, and on conviction he shall be fined not more than five hundred dollars, and the Court shall have power, on the recommendation of the jury, to add to the judgment of the court that he be removed from office.

SEC. 9. In case the Mayor shall absent himself from the city for the period of three consecutive months, or in case he shall cease to reside within the limits of the city, his office shall thereby be vacated.

SEC. 10. In all cases of examination of charges against policemen or other officers of the city, the

Mayor shall have power to administer oaths and to compel the attendance of witnesses and the production of books and papers.

ARTICLE VI.

THE CITY COUNCIL.

SEC. 1. The City Council shall have power to pro-fiv vide by ordinance for the appointment of a City Clerk, City Attorney, City Surveyor, and all other officers necessary to enfore aud carry into effect the • provisions of this act and the ordinances of the City of Denver, and to provide for their compensation, duties, the time for which they shall hold their respective offices, and their removal from office, and also to provide by ordinance for the removal from office of the City Marshal for nonfeasance or malfeasance in official duties, and fill any vacancy in said office until the next general election.

SEC. 2. The City Council shall have power to re-offers may be quire of the officers appointed or elected in pursu-d ance of this act, bonds with penalty and security for the faithful performance of their respective duties, as may be deemed expedient, and also to require all officers appointed or elected as aforesaid, to take such oath, or make such affirmation as the City Council may prescribe, for the faithful performance of the duties of their respective offices, before entering upon the discharge of the same.

SEC. 3. The City Council shall have, subject to the provisions hereinafter named, the general management and control of the finances and all property, real, personal, and mixed, belonging to the corporation, and shall likewise have power, within the jurisdiction of the city, by ordinance not repugnant to the constitution of the United States or the organic law of this Territory:

First-To establish a system of sewerage.

General powers

Second-To appropriate money and provide for or the Counci the payment of the debts and expenses of the city.
