power, their majefties fo understanding it, according to the principle, the foundation of this treaty, that whoever at, tacks one crown, attacks the other;' yet the two contracting parties have judged it advisable to afcertain the first fuccours, which the required power fhall be obliged to furnish the requiring power with.

V. It is ftipulated and agreed between the two kings, that the crown required to furnish the fuccours, fhall have in one or feveral of its ports, three months after the requifition, twelve armed fhips of the line, and fix frigates, at the entire disposal of the requiring court.

VI. The required power fhall have in the fame space of three months, at the difpofal of the requiring power, eighteen thousand foot and fix thousand horfe, if France be the required power; and Spain, in cafe of being the required power, ten thoufand foot and two thousand horse. In this difference of number, a confideration has taken place in regard to the greater number of troops in the actual pay of France, than thofe maintained by Spain; but if it should happen hereafter, that there was an equal number of troops on foot on both fides, the obligation would then be equally binding to furnish reciprocally the fame number. The required power engages to affemble its quota, and keep it int readiness for its deftination, yet without immediately fending it forth from its ftates, but ftationing it in that part of its states as fhall be directed by the requiring party, that it may lie

VII. As to what alfo regards the difference of the faid number of troops to be furnished, his Catholic majefty excepts the cafe wherein they might be neceffary for defending the dominions of the king of the Two Sicilies, his fon, or those of the Infant duke of Parma, his brother; fo that acknowledging the obligation by preference, though voluntary, which the ties of blood fhould then lay him under, the Catholic king promifes in these two cafes, to furnifh the fuccours of eighteen thousand foot and fix thoufand horfe, and even all his forces, without requiring any thing from his moft Chriftian majesty, but the number of troops above ftipulated, and the endeavours his tender friendship for the princes of his blood might inspire him to do in their favour.

VIII. His moft Chriftian majefty excepts likewife on his fide, the wars wherein he might enter or take part, in confequence of the engagements he has contracted by the treaties of Weftphalia, and other alliances with the powers of Germany and the North; and confidering that the faid wars cannot concern in any thing the crown of Spain, his moft Chriftian majefty promises to require no fuccours from the Catholic king, unlefs fome maritime powers fhould take part in the faid wars, or the events fhould prove fo contrary to France, as to be attacked in her own country by land; and

M. cath. excepte le cas où elles feroient néceffaires pour défendre les domaines du Roi des Deux-Siciles, fon fils, ou ceux de l'Înfant Duc de Parme,' fon frere; de forte que reconnoiffant l'obligation de préférence, quoique volontaire, que les liens du fang & de la proche parenté lui impoferoient alors, le Roi cath. promet dans ces deux cas de fournir le fecours de 18 mille hommes d'infanterie & de 6 mille de cavalerie, & même toutes fesforces fans rien exiger de S. M. Très-chrétienne que le nombre de troupes ci-deffus ftipulé, & les efforts que fa tendre amitié pour les princes de fon fang pourra lui infpirer de faire en leur faveur.

VIII. S. M, Très-chrétienne excepte auffi de fon cóté les guerres, dans lefquelles elle pourroit entrer ou prendre part en conféquence des engagemens qu'elle a contractés par les traités de Weftphalie & autres alliances

IX. It fhall be free to the requiring power, to fend one or feveral commiffioners, chofen among their fubjects, to be certain of themselves that the required power has affembled in three months, reckoning from the requifition, and has in one or feveral of its ports the twelve armed fhips of the line, and fix frigates, as well as the ftipulated number of land troops, all ready for marching.

X. The said ships, frigates and troops, are to act according to the will of the power that shall have an occafion for, and fhall have demanded them, and the required power shall make but one only reprefentation on the motives or objects alledged and pointed out for the employment of the said land and fea forces.

M. T. C. fa majefté cath. s'engageant, fi le cas arrive, de n'avoir aucun égard á la difproportion qui fe trouve entre les forces de terre de la France & celles de I'Espagne.

IX. Il fera libre à la puiffance requérante d'envoyer un ou plufieurs commiffaires choifis parmi les fujets, pour s'affurer par eux-mêmes que la puiffance requife a raffemblé dans les 3 mois, à compter de la réquifition, & tient dans un ou plufieurs de fes ports les 12 vaiffeaux de ligne & 6 frégates armées en guerre, ainsi que le nombre ftipulé des troupes de terre, le tout prêt à marcher.

X. Lefdits vaiffeaux, frégates & troupes agiront, felon la volonté de la puiffance, qui en aura befoin & qui les aura demandés, fans que fur les motifs ou fur les objets indiqués pour l'emploi defdites forces de terre & de mer, la puiffance requife puiffe faire plus d'une feule & unique, repréfenta

XI. Whatever here has been agreed upon, fhall take place every time the requiring power may afk fuccours for fome offenfive or defenfive enterprize by land or fea, of immediate execution, and ought to be understood in the cafe, when the fhips and frigates of the required power repair to fome port of its ftates, because it will then be fufficient to keep its land and fea forces ready, in the parts of its dominions fpecified by the requiring power, as ufeful to its views.

XII. The demand which one of the two fovereigns makes on the other for the fuccour ftipulated by the present treaty, fhall be fufficient for afcertaining the want on one part, and the obligation on the other, of furnishing the faid fuccours, without its being neceffary to enter into any manner of explanation, on any pretext whatfoever, to elude the moft prompt and the most perfect execution of this engagement.

XIII. In confequence of the foregoing article, the difcuffion of the offenfive and defenfive cafe cannot take place in regard to the twelve ships, the fix frigates, and the land forces to be furnished, as these forces are to be considered in all cafes, "and three months after the requifition," as belonging in property to the power that fhall have required them.

XIV. The power that furnishes the fuccours, either in Thips and frigates, or troops, fhall pay them wherever its ally fhall make them act, as if thefe forces were employed directly for itfelf; and the requiring power fhall be obliged, whether the said ships, frigates, or troops, remain for a long or short time

XII. La demande que l'un des deux fouverains fera à l'autre des fecours ftipulés par le préfent traité, fuffira pour conftater le befoin d'une part & l'obligation de l'autre, de fournir ledit fecours, fans qu'il foit néceffaire d'entrer dans aucune explication, de quelque efpece qu'elle puiffe être, ni fous quelque prétexte que ce foit, pour éluder la plus prompte & la plus parfaite exécution de cet engagement.

XIII. En conféquence de l'article précédent, la difcuffion du cas offenfif & défenfif ne pourra point avoir lieu par rapport aux douze vaiffeaux, aux 6 frégates, & aux troupes de terre à fournir, ces forces devant être regardées dans tous les cas, & trois mois après la requifition, comme appartenant en propriété à la puiffance, qui les aura requifes.

XIV. La puiffance, qui fournira le fecours, foit en vaiffeaux & frégates foit en troupes, les payera par-tout où fon allié les fera agir, comme fi ces forces étoient employées directement pour elle-même ; & la puiffance requérante fera obligée, foit que lesdits vaiffeaux, frégates ou troupes reftent peu

time in the ports, to provide for them all neceffaries, at the fame price as if they were its own, and to make them enjoy the fame prerogatives and privileges, its own troops enjoy. It has been agreed, that in no wife the faid fhips or troops fhall be at the charge of the power to which they are fent, and that they fhall remain at its difpofal, during the continuance of the war in which it fhall have engaged.

XV. The moft Chriftian king and the Catholic king, bind themselves to keep compleat and well armed the fhips, frigates and troops, which their majestics are to furnish reciprocally; fo that as foon as the required power shall have furnished the fuccours ftipulated by the articles V. and VI. of the present treaty, it fhall procure the fitting out and arming in its ports of a fufficient number of fhips, for immediately replacing those which may be loft from accidents of the war or fea; and the fame power fhall equally keep ready the reéruits, and the neceffary repairs for the land troops it fhall have furnished.

XVI. The fuccours ftipulated in the foregoing articles, pursuant to the time and manner fet forth, are to be confidered as an obligation infeparable from the ties of confanguinity and friendship, and the intimate union the two contracting monarchs defire to perpetuate among their defcendants; and thefe ftipulated fuccours are what the required power can leaft do for the power that fhall have an occafion for them: but as the intention of the two kings is, that war commencing for or against one of the two crowns, ought to become peculiar and perfonal to the other, it is agreed and determined,

M. fe fourniront réciproquement de forte qu'auflitot que la, puiffance requife aura fourni les fecours ftipulés par les art. 5 and 6 du préfent traité, elle fera armer dans fes ports un nombre fuffifant de vaiffeaux pour remplacer fur le champ ceux qui pourroient être perdus par les événemens de la guerre ou de la mer: cette même puiflance tiendra également prêtes les recrues & les réparations néceffaires pour les troupes de terre qu'elle aura à fournir.

XVI. Les fecours ftipulés dans les art. précédens felon le tenis & la maniere qui a été expliquée, doivent être confidérés comme une obligation inféparable des liens de la parenté & amitié & de l'union intime que les deux monarques contractans defirent de perpétuer entre leurs defcendans ; & ces
