that as foon as the two kings fhall engage in a war, declared against the fame enemy or enemies, the obligation of the faid ftipulated fuccours fhall ceafe, and in lieu thereof, for the two crowns fhall fucceed the obligation of waging war conjointly, by employing in it all their forces; and for this purpofe, the two high contracting parties fhall then ftipulate between them particular agreements, relative to the circumftances of the war in which they are engaged, and fhall concert their efforts, and their respective and reciprocal advantages, as alfo their military and political plans and operations; and these agreements being ratified, the two kings fhall execute them together, and with one common and perfect accord.

XVII. His moft Chriftian and his Catholic majefty engage and promife, in cafe of being at war, neither to execute, nor make any propofal of peace, nor treat of, nor conclude any with their enemy or enemies, but with one common accord and mutual confent, and to communicate reciprocally whatever might come to their knowledge, which fhould intereft the two crowns, and in particular the object of the pacification; fo that in war, as well as in peace, each of the two crowns fhall confider as its own interefts, those of the crown its ally.

XVII. L. L. M. M. T. chr. & cath. s'engagent & fe promettent pour le cas ou elles fe trouveroient en guerre, de n'exécuter, ni faire aucune propofition de paix, de ne la traiter ni conc'ure avec l'ennemi ni les chinemis qu'elles auront, que d'un accord & confentement mutual & commu), & de fe communiquer réciproquement tout ce qui pourroit venir à leur connoiffance qui intérefferoit les deux couronnes & en particulier fur l'objet de la pacification; de forte qu'en guerre comme en paix, chacune des deux couronnes regardera comme fes propres intérêts ceux de la conronne, fon alliée.

XVIII. Conformably to this principle, and the engages ment contracted in confequence thereof, his most Christian and his Catholic majefty agree, that when the war they have fupported in common is terminated by peace, they fhall compenfate the advantages one of the two powers may have had, with the loffes the other may have fuftained, so that in regard to the conditions of peace, as well as the operations of war, the two monarchs of France and Spain, through the whole extent of their dominion, fhali be confidered and shall act as if they formed but one only and the fame power.

XIX. His majefty the king of the Two Sicilies, having the fame connection of kindred and friendship, and the fame interefts that intimately unite his moft Chriftian and his Catholic majefty, his faid Catholic majefty ftipulates for the king of the Two Sicilies, his fon, and takes upon him to make him ratify, as well for himself as for his defcendants in perpetuity, all the articles of the present treaty; and further, that whatever regards the proportion of the fuccours to be furnished by his Sicilian majefty, it fhall be determined by his act of acceffion to the faid treaty, according to the extent of his power.

XX. His moft Chriftian majefty, and their Catholic and Sicilian majefties, engage not only to concur to the support and fplendour of their kingdoms in their actual state, but

XIX. S. M. le Roi des Deux-Siciles ayant les mêmes liaifons de parenté & d'amitié & les mêmes intéréts, qui uniffent intimement L. L. M. M. T. chr. & cath. S. M. cath. ftipule pour le Roi des Deux-Siciles, fon fils, & s'oblige à lui faire ratifier, tant pour lui que pour les defcendans à perpétuité, tous les articles du préfent traité; bien entendu que pour ce qui regarde la proportion des fecours à fournir par S. M. Sicilienne, ils feront déterminés dans fon acte d'acceffion audit traité, fuivant l'étendue de fa puiffance.

XX. L. L. M. M. T. chr. cath. & Sicilienne s'engagent non seulement à concourir au maintien & à la fplendeur de leurs Royaumes dans l'état ou ils le trouvent actuellement, mais encore à foutenir fur tous les objets, fans exception, la dignité & les droits de leurs maifons; de forte que chaque

XXI. The prefent treaty being to be confidered, as fet forth in the preamble, a Family-Compact between all the branches of the auguft houfe of Bourbon,' no other power but those of this house, can be invited or admitted to accede to it.

XXII. The ftrict friendship that unites the contracting monarchs, and the engagements they enter into by this treaty, determine them alfo to ftipulate, that their respective ftates and fubjects fhall partake of the advantages and union established between these fovereigns; and their majefties promise not to suffer in any cafe, nor under any pretence what foever, their faid fubjects and ftates to do or undertake any thing contrary to the prefent correfpondence, that ought to fubfift inviolably between the three crowns.

XXIII. To cement in as great a degree as the nature of the matter may admit this good understanding, and those reciprocal advantages between the fubjects of the two crowns, it is agreed that the Spaniards fhall be no longer reputed Aubains in France, and confequently his most Christian majesty engages to abolish in their favour the Droit d'Aubaine,' whence they may difpofe by donative wills or otherwife, of all their goods and effects without exception, of what nature soever, they may poffefs in his kingdom; and their heirs, fubjects of his Catholic majefty, refiding as well in France as elsewhere,

XXII. L'amitié étroite qui unit les monarques contractans, & les engagemens qu'ils prennent par ce traité, les déterminent auffi à ftipuler que leurs etats & fujets refpectifs participer ont aux avantages & à la liaison établie entre ces fouverains, & L. M. fe promettent de ne pas fouffrir qu'en aucun cas, ni fous quelque prétexte que ce foit, leurs dits etats & fuje s puiffent rien faire ou entreprendre de contraire à la parfaite correfpondance, qui doit fubfifter inviolablement entre les trois couronnes.

XXIII. Pour cimenter d'autant plus cette intelligence & ces avantages réciproques entre les fujets des deux couronnes, il a été convenu que les Efpagnols ne feront plus réputés Aubains en France, & en conféquence S. M. T. C. s'engage à abolir en leur faveur le Droit d'Aubaine, enforte qu'ils pourront difpofer par teftamens donatifs ou autrement, de tous leurs biens

elsewhere, may recover and enjoy their fucceffions, even tho they should die inteftate, either by themselves, their attorneys, or order, without having previously obtained letters of naturalization, and may tranfport them out of the states of his moft Chriftian majefty, notwithftanding all laws, edicts, ftatutes, cuftoms, or rights hereto contrary, which his moft Chriftian majefty relinquifhes, in as great a degree as the occafion may require. His Catholic majefty engages on his fide, to procure the enjoyment of the fame privileges, and after the fame manner, in all the ftates and countries of his dominions in Europe, for all the French and fubjects of his most Christian majefty, in regard to the free disposal of whatever they may poffefs through the whole extent of the Spanish monarchy; fo that the fubjects of the two crowns fhall be generally treated in every particular regarding this article, in the countries of the two dominions, as the proper and natural fubjects of the power in the ftates of which they may refide. All that is faid above in regard to the abolition of the Droit d'Aubaine,' and the advantages the French are to enjoy in the ftates of the kingdom of Spain in Europe, and the Spaniards in France, is granted to the subjects of the king of the Two Sicilies, who are comprehended on the fame conditions in this article; and reciprocally the fubjects of his moft Chriftian majefty and his Catholic majefty, are to enjoy the fame exemptions and advantages in the ftates of his Sicilian majesty.

S, M. cath. s'engage de fon coté à faire jouir des mêmes priviléges & de la même maniere dans tous les etats & pays de fa domination en Europe tous les François & fujets de 3. M. T. C. par rapport à la libre difpofition des biens qu'ils poffederont dans toute l'etendue de la monarchie Efpagnole de forte que les fujets des deux couronnes feront généralement traités en tout & pour tout ce qui regarde cet article, dans les pays des deux dominations, comme les propres & naturels fujets de la puiffance, dans les etats de laquelle ils réfideront. Tout ce qui eft dit ci-deffus par rapport à l'abolition du Droit d'Aubaine & aux avantages dont les François doivent jouir dans les etats du Royaume d'Efpagne en Europe, & les Efpagnois en France, eft accordé, aux fuj ts du Roi des Deux-Siciles, qui fe ront compris aux mêmes conditions dans cet article; et reciproquement les fujets de L. XXIV. The subjects of the high contracting parties fhall be treated relatively to commerce and impofts in each of the two kingdoms in Europe, as natural fubjects of the country where they fhall arrive or refide, fo that the Spanish flag fhall enjoy in France the fame rights and prerogatives the French flag does, and in like manner the French flag fhall be treated in Spain with the fame favour as the Spanish flag. The subjes of the two monarchies declaring their merchandizes, Thall pay the fame duties as are paid by nationals; importation and exportation fhall be equally free to them, as to natural fubjects, and no duties fhall be payable on either fide, but those the fovereign's own fubjects are liable to, nor other things fubject to confifcation, but thofe prohibited to nationals themselves; and as to what regards thefe particulars, all prior treaties, conventions, or engagements between the two monarchies, fhall remain abolished: furthermore, no other foreign power fhall enjoy in Spain no more than in France, any greater emolumental privilege than that of the two nations; the fame regulation fhall be obferved in France and Spain, in regard to the flag and subjects of the king of the Two Sicilies, and his Sicilian majefty fhall have it recipro cally obferved in regard to the flag and fubjects of the crowns of France and Spain.

XXV. If the high contracting parties make hereafter fome treaty of commerce with other powers, and grant them, or

Les sujets des hautes parties contractantes feront traités relativement au commerce & aux impofitions, dans chacun des deux Royaumes en Europe, comme les propres fujets du pays ou ils aborderont ou réfidederont, de forte que le pavillon Espagnol jouira en France des mêmes droits & prérogatives que le pavillon François, & pareillement que le pavillon François fera traité en Espagne avec la même faveur que le pavillon Espagnol. Les fujets des deux monarchies en déclarant leurs merchandifes payeront les mêmes droits qui feront payés par les nationaux. L'importation & exportation leur fera égalment libre, comme aux fujets naturels, & il n'y aura de droits à payer de part & d'autre, que ceux qui feront percus fur les propres fujets du fouverain, ni de matieres fujettes à confifcation, que celles qui feront prohibées aux nationaux eux-mêmes; & pour ce qui regarde ces objets, tout traité, conventions ou engagemens antérieurs entre les deux monarchies, refteront abolis: bien entendu que mulle autre puiffance étran→ gere ne jouira en Efpagne non plus qu'en France d'aucun privilége plus avantageux que celui des deux nations. On obfervera les mêmes régies en France & en Espagne à l'égard du pavillon & des fujets du Roi des Deux Siciles, & S. M. S. le fera réciproquement obferver à l'égard du pavillon & des fujets des couronnes de France & d'Efpagne.

XXV. Si les hautes parties contractantes font dans la fuite quelque traité de commerce avec d'autres puiffances: & leur accordent ou leur ont déjà accordé dans leurs ports ou etats le traitement de la nation la plus favc
