Neceffaries, according to the Cuftom of the Royal Marine Corps (being provided for the Marine and paid for by the Deductions out of his Pay), or caufe the Colour of fuch Clothes to be changed, every fuch Perfon fo offending shall forfeit for every fuch Offence the Sum of Five Pounds; and upon Conviction by the Oath of Penalty. One or more credible Witness or Witneffes before any One or more of His Majefty's Juftices of the Peace, the faid Penalty fhall be levied, by Warrant under the Hands of the faid Juftice or Juftices of the Peace, by Diftrefs and Sale of the Goods and Chattels of Distress. the Offender, One Moiety thereof to be paid to the Informer, and the other Moiety to be paid to the Paymaster of the Royal Marine Forces, who fhali report the fame to the Secretary of the Admiralty, and credit the fame in his public Accounts; and in cafe any fuch Offender who shall be convicted as aforefaid, of having knowingly received any Arms, Clothes, Caps or other Furniture belonging to The King, or any fuch Articles as are generally deemed Regimental Neceffaries, or of having caused the Colour of fuch Clothes to be changed contrary to the Intent of this Act, fhall not have fufficient Goods and Chattels whereon Diftrefs may be made to the Value Goods, &c. not of the Penalty recovered against him or her for fuch Offence, or futficient. fhall not pay fuch Penalty within Four Days after fuch Conviction, then and in fuch cafe fuch Juftice or Juftices of the Peace shall

and Seals, either commit fuch Offender to the Common Gaol, Imprisonment, there to remain without Bail or Mainprize, for the Space of &c. Three Months, or caufe fuch Offender to be publicly or privately whipped, at the Discretion of such Justice or Juftices.

LIX. And whereas Marines abfent on Furlough granted to them by their Commanding Officers are fometimes prevented by Sicknefs, or other unvoidable Cafualty, from returning to their Duty before the Expiration of the time limited by fuch Furlough; and Doubts have arisen whether in fuch cases the Extenfion of a Marine's Furlough by a Juftice of the Peace be fanctioned by legal Authority, and effectual for preventing fuch Marine from being apprehended upon Sufpicion of his having deferted; Be Furlough exit further enacted, That any Infpecting Field Officer, ftationed on tended in cafe of the Recruiting Service, or any Officer of the Rank of Captain Sicknets, &c. or of fuperior Rank, or any Adjutant of Local Militia ftationed within the District; or in cafe there be no fuch Officer as aforefaid within a convenient Distance, that any Juftice of the Peace may and he is hereby authorized to grant in Writing under his Hand an Extenfion of Furlough to any Non Commiffioned Officer or Marine applying for the fame on account of Sickness or other Cafualty which fhall on due Enquiry appear to render fuch Extenfion neceffary; and that every fuch Officer or Justice of the Peace, who fhall grant to any Non Commiffioned Officer or Marine an Extenfion of Furlough as aforefaid, fhall immediately certify the fame with the Caufe of its being fo granted to the Secretary of the Admiralty, and that fuch Non Commiffioned Officer or Marine during the Period to which his Furlough fhall have been fo extended as aforefaid shall not be liable to be apprehended or otherwife molefted on the Ground of his having deferted, or of criminally abfcuting himfelf from his Divifion: Provided always, that nothing in this A& Provifo contained shall be conftrued to exempt any Non Commiffioned Officer

or Marine, whofe Furlough fhall have been fo extended as aforefaid, from being proceeded against and punished according to the Provifions of this Act, fhould it thereafter appear that fuch Non Commiffioned Officer or Marine had obtained the Extenfion of his Furlough by falfe Reprefentation made to fuch Officer or Juftice of the Peace as aforefaid, or in applying for and obtaining the fame, had committed any Offence to the Prejudice of good Order and Military Difcipline: Provided alfo, that no fuch Furlough fhall be extended by any Juftice of the Peace for any longer Period than One Month, unless with the Approbation of the General Officer commanding in the District where fuch Marine fhall be.

LX. Provided always, and be it further enacted, That in all cases in which any Extenfion of Furlough fhall be granted as aforefaid in England, and upon the Requeft of any fuch Non Commiffioned Officer or Marine to whom the fame fhall be granted, it shall be lawful for the Juftice of the Peace granting the fame, or where the fame fhall be granted by any fuch Officer as aforefaid, for any Juftice of the Peace upon the Production of a Certificate in Writing from fuch Officer, which he is hereby required to give, to make an Order in Writing in the Form in the Schedule to this A&t annexed, marked (D.), under his Hand, upon the Churchwardens and Overfeers of the Poor of the Parish, Township or Place wherein such Non Commiffioned Officer or Marine fhall refide, requiring them to pay to fuch Non Commiffioned Officer or Marine any Sum of Money directed in fuch Order, not exceeding what the Pay of fuch Non Commiffioned Officer or Marine fhall amount to for the Period to which fuch Furlough fhall be extended as aforefaid; fuch Juftice of the Peace taking particular Care to ftate upon the Furlough in Words, the Amount fo directed by him to be paid, and the Periods from and to which the fame has been ordered to be iffued, both inclufive, corroborating the Statement of his Signature, and further fpecifying upon the Order to the Parish Officer the Date of the Furlough originally granted, and the Name of the Commanding Officer by whom figned, and the fame fo authorized fhall be paid accordingly upon Production and Delivery to him of fuch Order by any fuch Parish Officer out of any Money in his Hands applicable to the Relief of the Poor; and the fame fo advanced by fuch Parish Officer hall, upon the Production and Delivery of fuch Order to the Collector of Excife of the District within which fuch Parish, Township or Place shall be fituated, or any Perfon officiating for fuch Collector, be repaid to fuch Parish Officer to be applied to the Relief of the Poor by fuch Collector of Excife or other Perfon out of any Public Monies in his Hands, and the fame fhall be allowed in his Accounts; and fuch Orders of Juftices fhall be taken as Cafh in the Payment of Duties of Excife received by him, and all Sums of Money fo advanced out of any Duties of Excife fhall be repaid to the Account of the faid Duties by the Paymafter of the Royal Marines, to any Person or Perfons authorized by the Commiffioners of Excife in England, or any Three or more of them, to draw for and receive the fame: Provided always, that if any Juftice of the Peace shall not think fit to make fuch Order for paying any fuch Money as aforefaid, he fhall ftate his Reafons for fuch Refufal in Writing at the Back of the Furlough.

LXI. Provided always, and be it further enacted, That it shall be His Majefty lawful for His Majefty to make any fuch further or other Regulations may make fur. for the advancing of any fuch Sums of Money in all fuch cafes of ther Orders re Specting fuch Extenfion of Furlough, and for the Re-imbursement thereof, as may Payments. be from time to time neceffary for the carrying the fame into Effect, and infuring the immediate Advance of fuch Money, where neceffary, in Great Britain or Ireland, and the due and regular Re-imbursement thereof.

LXXVI. And be it further enacted, That if any Perfon who fhall Concealing Inenlift into His Majefty's Marine Forces, and who fhall be discovered firmity how to be incapable of active Service, by reafon of any Infirmity, which dealt with. fhall have been concealed by fuch Perfon, or not declared before the Justice of the Peace at the time of his Atteftation, and mentioned at the Foot thereof, may be transferred into any Garrifon, or Veteran or Invalid Battalion, or into His Majefty's Regular Forces, and fhall be entitled to receive fuch Proportion or Refidue of Bounty only as fhall be allowed by His Majefty, by any Regulation made in that behalf, in lieu and inftead of the Bounty upon which fuch Man fhall have been enlisted; any thing in any Act or Acts of Parliament or any Rules and Regulations relating to Soldiers or Marines to the contrary notwithstanding.

LXXVII. Provided always, and be it further enacted, That it Concealing Infhall be lawful for any Two Juftices of the Peace, or Magiftrates, firmity. before whom any Perfon fhall be brought who has enlifted, and who fhall be proved upon Oath before them and convicted of having wilfully concealed any Infirmity, upon being attefted, or of having knowingly, wilfully and defignedly made any fuch falfe Reprefentation as aforefaid, to adjudge fuch Perfon to be a Rogue and Vagabond, and fuch Perfon fhall thereupon be fubject to fuch Punish- Punishment. ment as by and under any Statutes or Laws now in force may inflicted upon Rogues, Vagabonds and Vagrants and incorrigible Rogues, to be adjudged by the Juftices of the Peace or Magistrates fo convicting any fuch Perfon as aforefaid.

LXXX. And be it further enacted, That no Mafter in Scotland Apprentices in fhall be entitled to claim any Apprentice who fhall, after the paffing Scotland. of this Act, enlift as a Marine, unless fuch Apprentice hall have been bound to him for the full Term of at leaft Four Years by a regular Contract or Indenture of Apprenticeship, duly extended, figned and tefted, and binding on both Parties by the Law of Scotland, prior to the Period of Enlistment, and unlefs fuch Contract or Indenture, fo duly executed, fhall within Three Months after the Commencement of the Apprenticeship, and before the Period of Enliftment, have been produced to a Juftice of the Peace of the County wherein the Parties refide, and there fhall have been indorsed thereon by fuch Juftice, a Certificate or Declaration figned by him, fpecifying the Date when, and the Perfon by whom fuch Contract or Indenture shall have been fo produced, which Certificate or Declaration fuch Juftice of the Peace is hereby required to indorfe and fign, and unlefs fuch Apprentice fhall, when claimed by fuch Mafter, be under Twenty one Years of Age, and unless fuch Master shall, within One Calendar Month after fuch Apprentice fhall have abfconded or left his Service, go before fome Juftice of the Peace, and before fuch

fuch Juftice of the Peace take the Oath mentioned in the Schedule to this Act annexed, marked (B.), and produce the Certificate of fuch Juftice of the Peace of his having taken fuch Oath, which Certificate fuch Juftice of the Peace is hereby required to give in the Provifo for Ap Form in the Schedule to this Act annexed, marked (C.): Provided prentices in Sca always, that any Mafter of an Apprentice indentured for the Sea Service. Service fhall be entitled to claim and recover any fuch Apprentice in the Form and Manner above directed, notwithstanding fuch Apprentice may have been bound for a lefs Term than Seven Years in England, Five Years in Ireland, or Four Years in Scotland.

LXXXI. Provided always, and be it further enacted, That if any Perfon who fhall have been hired to ferve any Matter for a Year, or otherwife, fhall before the Expiration of his time of Service under fuch Hiring enlift into His Majefty's Royal Marine Forces, fuch Perfon fhall be entitled to fuch Proportion of Wages as the Magistrate fhall think proper from his Master for the time he has actually ferved under fuch Hiring; notwithstanding he fhall have failed in confequence of fuch enlifting in completing the full Term of Service agreed for under fuch Hiring, and the Magiftrate fhall give an Order and take fuch other Steps as fhall be neceffary to enforce the Payment of fuch Proportion within Five Days after the Amount shall have been declared by fuch Magiftrate.

And be it further enacted, That this Act and every thing herein contained fhall be and continue in force, within Great Britain, from the faid Twenty fifth Day of March in the Year of our Lord One thoufand eight hundred and fourteen, until the Twenty fifth Day of March in the Year of our Lord One thoufand eight hundred and fifteen; and fhall be and continue in force within Ireland, from the First Day of April One thoufand eight hundred and fourteen, until the First Day of April One thoufand eight hundred and fifteen; and fhall be and continue in force within the Garrison of Gibraltar, and in Spain or Portugal, from the Twenty fifth Day of May One thoufand eight hundred and fourteen, until the Twenty fifth Day of May One thoufand eight hundred and fifteen; and fhall be and continue in force in all other Parts of Europe where Royal Marine Forces may be ferving, and in the Weft Indies and North America, and Cape of Good Hope, from the Twenty fifth Day of July One thoufand eight hundred and fourteen, to the Twenty fifth Day of July One thoufand eight hundred and fifteen; and fhall be and continue in force in all other Places from the Twenty fifth Day of September One thoufand eight hundred and fourteen, to the Twenty fifth Day of September One thousand eight hundred and fifteen; and that this Act, fo far as relates to the Allowances to be made for the quartering of Royal Marines, and providing for their Horfes, may be altered and varied by any Act or Acts to be made in this prefent Seffion of Parliament.

Distillation of Spirits in Ireland. [17th December 1813.]

WHEREAS,

WHEREAS by an Act made in the Forty feventh Year 47 G. 3. Seff. 2. of the Reign of His prefent Majefty, intituled An Aa to amend an A& made in the Forty fixth Year of His prefent Majefty's Reign for the regulating and fecuring the Collection of the Duties on • Spirits diflilled in Ireland, it is, amongst other things, enacted, That it fhall and may be lawful for any Juftice of the Peace in Ireland, upon Information upon Oath to him given, that any unlicensed Still, or any Part of a Still, or any Appendage to a Still, or any • Worm, or any Utenfil for diftilling Spirits has been found or used in any Place within the Jurifdiction of the faid Juftice, or that any fuch Wash, Pot Ale, Low Wines or Singlings as in the faid Act is mentioned and described has or have been found in any Place within the Jurifdiction of fuch Juftice, to examine into the Truth • of the said Information; and if he shall find Reason to believe that fuch Still, or Part of a Still, or Appendage to a Still, or fuch • Worm or other Utenfil had been fo found or used as the cafe may be, or that fuch Wafh, Pot Ale, Low Wines or Singlings has or have been fo found, he shall sign a Notice of fuch Information • directed to, and the faid Notice fhall be ferved upon any Two Inhabitants, being Householders of the Parish (or if fuch Still, or Part of a Still, or Appendage to a Still, or fuch Worm or other • Utenfil fhall be found or used, as the cafe may be, or if such Wash, Pot Ale, Low Wines or Singlings fhall be found in any Extraparochial Place, then fuch Notice fhall be directed to and ferved on Two fuch Inhabitants of the Townland, Manor or Lordship), in which it fhall appear by fuch Information that the Place is fituate where any fuch Still, or Part of a Still, or Appendage to a Still, or fuch Worm or other Utenfil fhall have been fo found or used, or any fuch Wafh, Pot Ale, Low Wines or Singlings fhall have been fo found: And whereas there are many Townlands in Ireland which contain but few Inhabitants being Householders therein, and it is expedient to provide for the more effectual Service of the Notices required by the faid Act;' Be it therefore enacted by The King's Moft Excellent Majesty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, Manner of
