V. And be it further enacted, That it fhall be lawful for His Majefty, from time to time to form the Officers, Non Commiffioned Officers, Drummers and Private Men, who fhall fo extend their Services from the faid Regiments of London Militia, into fuch Provifional Regiments or Battalions as may be deemed moft expedient for His Majesty's Service, either by themselves or together with the Officers, Non Commiffioned Officers, Drummers and Private Men, who fhall have extended their Services from the Regiments of Militia of the United Kingdom: Provided always, that in all cafes in which a Field Officer of Militia fhall have volunteered for Extended Service in any Part of Europe, the Officer having the Chief Command in fuch Provifional Battalion fhall be a Field Officer of Militia.

VI. Provided always, and be it further enacted, That no Officer of the London Militia fhall, while out of the United Kingdom upon any fuch Extended Service, rank with the Officers of His Majefty's Regular Forces higher than as a Lieutenant Colonel of the Militia.

VII. Provided always, and be it further enacted, That in case the Number of Officers of each Rank fo volunteering to extend their Services to any Part of Europe, and accepted by His Majefty, fhall not be in due Proportion to the Number of Men fo volunteering from the fame Regiment, it fhall be lawful for His Majefty to appoint any fit and proper Perfons to be Officers in fuch Provifional Battalions of Militia, without regard to the Qualifications now required by Law for fuch Officers in the Militia, and from time to time to fupply any Vacancies which may occur in fuch Provifional Battalions of Militia, in confequence of the Death, Refignation or Difmiflal of any fuch Officer who fhall have been fo appointed by His Majefty: Provided always, that no Person so appointed by His Majefty fhall hold a Commiffion in any fuch Provifional Battalion of higher Rank than that of a Subaltern, unless he shall at the time of fuch Appointment have been an Officer in His Majefty's Regular Forces or Militia: Provided always, that nothing herein contained fhall be conftrued to affect. the Appointment of Officers as eftablished by the faid Acts of the Thirty fixth and Thirty ninth Years of the Reign of His prefent Majefty, in any cafe of Vacancy which may occur in confequence of the Death, Refignation or Difmiffal of any London Militia Officer who may have volunteered for Extended Service in Europe.

VIII. And be it further enacted, That all Commiffioned Officers of the London Militia whofe Offers of extending their Services to all Parts of Europe under the Provifions of this Act fhall be acare accepted, in cepted by His Majefty, fhall be entitled to Half Pay, according to the Ranks in which their Services fhall be accepted, to ferve out of the United Kingdom, in like manner, and under fuch and the like circumftances, as Officers of His Majesty's Regular Forces; and the Widows of all fuch Commiffioned Officers killed in fuch Extended Service shall be entitled to receive fuch Penfions for Life as are given to Widows of His Majefty's Regular Forces: Provided always, that no Officer who fhall be appointed to fupply any Vacancy which may arife in the Militia on fuch Extended Service, fhall be entitled to fuch Half Pay, unless he fhall actually join the Militia upon fuch Extended Service.

IX. And be it further enacted, That all Officers, Non Commif- Subject to fioned Officers, Drummers and Private Men of the London Militia, Mutiny Act. extending their Services to any Part of Europe, fhall, upon leaving the United Kingdom upon fuch Extended Service, and during fuch Service until their Return to the United Kingdom, be subject to all the Laws in force for the Punishment of Mutiny and Desertion, in like manner, in every refpect, as His Majefty's Regular Forces; and all Officers of His Majefty's Regular Forces fhall be entitled to fit in any Court Martial upon the Trial of any Officer, Non Commiffioned Officer, Drummer or Private Man of the London Militia, while fio ferving out of the United Kingdom under this Act; and all Officers of the London Militia fhall, during fuch Extended Service, be entitled to fit in any Court Martial upon the Trial of any Officer, Non Commiffioned Officer or Soldier, of His Majefty's Regular Forces; any thing in any Act or Acts of Parliament to the contrary notwithstanding.

X. Provided always, and be it further enacted, That all the London Militia enrolled and formed for Extended Service as Militia to any Part of Europe under this Act, fhall, notwithstanding fuch Extenfion of Service, remain fubject to all the Provifions and Regulations contained in the faid Acts of the Thirty fixth and Thirty ninth Years of the Reign of His prefent Majefty (except in fuch cases as are in this Act particularly specified), and shall be entitled to all fuch Privileges and Immunities, and to fuch Provifions for their Wives and Families as they would have been entitled to by virtue of fuch Acts if they had continued serving as the London Militia in the United Kingdom.

XI. And be it further enacted, That it fhall be lawful for His Majesty, from time to time to make fuch Regulations as His Majefty may deem moft expedient, in relation to the retaining upon the Eftablishment of the London Militia, Supernumeraries or otherwife, any Officers, Non Commiffioned Officers and Drummers of each or either Regiment of London Militia, as may not fo volunteer to extend their Service to any Part of Europe, or as may not be fo employed upon fuch Extended Service; any thing in the said recited Act or Acts of Parliament of the Thirty fixth and Thirty ninth years of the Reign of His prefent Majefty to the contrary notwithstanding.

XII. And, in order that the Rights and Privileges of the City of Provifo for City London may not be infringed, be it further enacted, That this Act or of London. any thing herein contained, shall not diminish, or be prejudicial to the Rights, Privileges, Immunities and Exemptions to which the Mayor and Commonalty and Citizens of the City of London or the Freemen, Citizens or Inhabitants of the faid City, or the Suburbs and Liberties of the fame or of all privileged Places within the Limits and Precincts thereof, as well within the Liberties as without, are entitled to enjoy by Prescription, Act of Parliament, Charter or Ufage; but the faid Mayor and Commonalty and Citizens and Freemen, Citizens and Inhabitants of the faid City, fhall and may continue to enjoy all and fingular the faid Rights, Liberties, Ufages, Cuftoms, Privileges, Immunities and Exemptions, in as full, ample and beneficial a manner as if this Act had not been made.

XIII. Provided always, and be it further enacted, That this A&t Act altered, &c. or any of the Provifions thereof, may be altered, varied or repealed

by any A&t or Acts to be made in this present Seffion of Parliament.

XIV. And be it further enacted, That this Act fhall be deemed and taken to be a Public Act, and fhall be judicially taken Notice of as fuch by all Judges, Juftices and others, without being specially pleaded.

'TREASURY empowered to raise £10,500,000 by Exchequer Bills, in manner prefcribed by 48 G. 3. c.1.1, 2. Treafury to apply Money raifed, f3. Principal of faid Bills charged on firft Supplies of next Seffion, §4. Intereft thereon of 3 per Cent. per Diem, § 5. Said Bills to be current at the Exchequer after April 5, 1815, $6. Bank of England empowered to advance £6,500,000. on the Credit of Act, notwithstanding 5 & 6 W. & M. c. 20.-7. Act altered, &c. this Seffion, $8.

An Act to enable His Majefty to accept the Services of the
Local Militia out of their Counties, under certain Restric-
tions, and until the Twenty fifth Day of March One thousand
eight hundred and fifteen.
[10th December 1813.]

WHERE, that His Majelty should be enabled to make the

moft effectual Ufe of the Difpofable Military Force of His Realms, in aid of the Efforts now making upon the Continent of Europe, and for that Purpose should be empowered to accept of a limited • Extenfion of Service of the Local Militia, for a fhort Period, for the Internal Defence of Great Britain;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That it fhall be lawful for His Majefty to accept the Services of fuch Parts of the Local Militia of Great Britain as may make voluntary Offers, duly certified by their refpective Commanding Officers, of ferving under the Act, out of the Counties within which they shall be enrolled, and as His Majefty may think proper, to permit fo to extend their Services in confequence of fuch voluntary Offers as aforefaid; and it fhall be lawful for His Majefty, by any Order figned by the Principal Secretary of State, directed to the Commanding Officer of any Regiment, Battalion or Corps, of the faid Local Militia Forces of Great Britain, to propofe to fuch Regiment, Battalion or Corps, or any Part or Parts thereof, fo to extend their Services under fuch Rules and Regulations, and upon fuch Allowances, as His Majefty may think fit to make and appoint in that behalf, fubject nevertheless to the Reftrictions contained in this Act; and it fhall be lawful for His Majefty to call out and employ from time to time, any fuch Parts or Proportions of any Local Militia fo volunteering as aforefaid, at fuch times and in fuch manner as He shall think

think fit, out of their Counties, for any Period not exceeding fuch as are allowed by this Act; any thing in any Act or Acts of Parliament relating to the Local Militia to the contrary notwithstanding.

II. Provided always, and be it further enacted, That no Local Services not to Militia fhall be allowed to extend its Services, or be liable to be kept than 42 Days. affembled upon any fuch Extended Service under this Act, for any longer Period than Forty two Days in the whole in any One Year, including the Days of affembling and difembodying; and all Days of Service, under any fuch voluntary Offers as aforefaid, fhall be deemed Part of the Days of Training and Exercife under the Acts already in force for the Regulation of the Local Militia of England and Scotland refpectively; and if they fhall exceed the Number of Twenty eight Days, fhall be deemed to include the Period of Training and Exercise under the said Acts.

III. And be it further enacted, That all the Rules, Regulations, Regulations as Provifoes, Powers, Authorities, Penalties, Forfeitures, Claufes, to embodied Matters and Things, in the faid Acts refpectively contained, as to the Local Militia when embodied for Service in cafe of Invafion, fhall extend and be conftrued to extend to the Local Militia when ferving under any fuch voluntary Offers under this Act, out of the Counties within which they are enrolled, as fully and effectually as if the fame were feverally and refpectively re-enacted as to fuch Service of the Local Militia.

IV. And be it further enacted, That every Perfon who fhall have Provifion for ferved as a Serjeant in the Local Militia for Twenty Years, or any Serjeants after Perfon who, having previously ferved as a Serjeant in the Regular vice. Army, or in the Regular Militia, fhall, by Service in the Local Militia, make up in the whole fuch Period of Twenty Years Service in the Army, Militia and Local Militia taken together, and who fhall be discharged on account of Age or Infirmity fhall, on the Recommendation of the Commandant of the Regiment, Battalion or Corps to which he belongs, or of the Lieutenant, or Two or more Deputy Lieutenants of the County, Riding or Place to which the faid Regiment, Battalion or Corps belongs, be entitled to Examination at the Chelsea Board, and be capable of being placed on the Establishment of Chelsea Hofpital, if the faid Board fhall judge him deferving thereof, at fuch Rate of Penfion as fhall be affigned to the Serjeants of the Regular Militia by any Rules or Regulations made by His Majefty in their behalf.

V. And be it further enacted, That this A&t fhall continue in Continuance. force until the Twenty fifth Day of March One thousand eight hun- A&t altered, &c. dred and fifteen, and no longer; and may be altered, varied or repealed, by any A&t or Acts which may be paffed in the prefent Sef

fion of Parliament.

CAP. XX.

An Act to explain and amend an Act paffed in the present
Seffion of Parliament for enabling His Majesty to accept
the Services of a Proportion of the Militia out of the United
Kingdom, for the vigorous Profecution of the War; and to
extend the Provifions thereof to the Regiment of Miners of
Cornwall and Devon.

WHEREAS, an A&t was paled in the release mance of

Parliament, intituled An Act to enable His Majefty to accept the Services of a Proportion of the Militia out of the United Kingdom, for the vigorous Profecution of the War: And whereas it is expedient that further Provifions fhould be made for the more effectually carrying the faid Act into Execution, and that the Provifions of the faid Act fhould be extended to the Regiment of • Miners of Cornwall and Devon;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That it fhall be lawful for His Majefty to appoint any fuch Number of Officers of his Regular Forces or Militia as His Majefty fhall think fit, to ferve during any Period of Extended Service, out of the United Kingdom, as Field Officers in the Provifional Regiments or Battalions of Militia, formed under the faid recited A&t for Extended Service, in addition to the Officers of the Militia allowed to volunteer for Extended Service, in Proportion to the Number of Men who fhall extend their Service; and all Perfons fo appointed to ferve as Field Officers in any fuch Provifional Regiments or Battalions fhall rank as Field Officers therein, in fuch manner as His Majefty fhall direct, fubject nevertheless to the Provifions in the faid recited A& contained as to the Officer having the Chief Command in every fuch Provifional Battalion being a Field Officer of Militia.

II. And be it further enacted, That all Officers of Militia who fhall be appointed by His Majefty to serve in any Provifional Battalion of Militia, formed for Extended Service, with higher Rank than that which they previously held in the Militia, fhall be deemed and taken to be Militia Officers within the Meaning of the faid recited A&t paffed in the prefent Seffion of Parliament, and as fuch fhall be capable of commanding fuch Provifional Battalions.

III. And be it further enacted, That all Commiffioned Officers of Militia whofe Services fhall be accepted by His Majefty, and who fhall hereafter ferve upon Extended Service out of the United Kingdom, fhall be entitled to Half Pay according to the Rank in which they fhall fo actually ferve, and not according to the Rank in which their Services fhall have been fo accepted; any thing in the faid Act contained to the contrary notwithstanding.

IV. And be it further enacted, That it fhall be lawful for His Majefty, from time to time, to make fuch Regulations as His Majefty fhall deem expedient for the retaining at the Expiration of any Extended Service out of the United Kingdom any Field Officers, Captains or other Officers of Militia, who fhall have actually served upon any fuch Extended Service in any higher Ranks than those in
