which they shall have volunteered their Services, either as Supernumeraries or otherwife, upon the Establishment of the Militia to which they belonged, with the Rank in which they fhall have fo actually ferved, or upon fuch other Terms in refpect to Rank and Service in the Militia as His Majefty fhall think fit; any thing in any Act or Acts of Parliament relating to the Militia to the contrary notwithftanding.

V. Ånd be it further enacted, That all the Powers, Authorities, Provifions, Regulations, Penalties, Forfeitures, Claufes, Matters and Things in the faid recited Act of this Seffion of Parliament, and in this A&t contained, in relation to the Regular Militia of Great Britain and Ireland, fhall extend and be conftrued to extend to the Regiment of Miners of Cornwall and Devon, raised under an A&t paffed in the Forty fecond Year of the Reign of His prefent Majefty, intituled An A& for repealing an A& made in the Thirty eighth Year of the Reign of His prefent Majefty, intituled An Aă for raifing a Body of Miners in the Counties of Cornwall and Devon, for the Defence of the Kingdom during the prefent War; and for the more effectually raifing and regulating a Body of Miners for the Defence of Great Britain, in like manner and as fully and effectually to all Intents and Purposes as if the faid Regiment of Miners had been comprised within the Provisions of the said Act, and made Part thereof, and as if the fame were severally and separately repeated

An Act for charging an equalizing Duty on Scotch Salt brought
to England.

HEREAS for the Purpose of equalizing the Duties for or

• England, and Salt brought from Scotland into that Part of Great • Britain called England, it is expedient to impofe the additional • Duty hereinafter mentioned;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That, from and after the Fifth Day of January One thoufand eight hundred and fourteen, there fhall be raised, levied, collected and paid, to and for the Ufe of His Majefty, his Heirs and Succeffors, the additional Duty hereinafter mentioned; that is to fay, For every Bufhel of Salt or Rock Salt which shall be brought from Scotland into that Part of Great Britain called England, accompanied with a Certificate from the proper Officer that it hath paid the Duty of Four Shillings, impofed by an A&t made in the Forty third Year of the Reign of His prefent Majefty King George the Third, intituled An Aa to repeal the Duties of Excife payable in Great Britain, and to grant other Duties in lieu thereof; and alfo the additional Duty of Two Shillings, impofed by an A&t made in the

(a) [Query, What is the Duty meant to be impofed on the firft mentioned Salt?]

II. And whereas Contracts or Agreements may have been made before the paffing of this Act by Dealers in Salt or Rock Salt refpectively in that Part of Great Britain called England upon which the additional Duty is by this Act impofed for fuch Salt or Rock Salt refpectively, to be delivered after the faid Fifth Day of January; Be it therefore enacted, That fuch Dealers delivering any fuch Salt or Rock Salt after the faid Fifth Day of January in purfuance of any fuch Contract or Agreement, fhall be allowed to add fo much Money as will be equivalent to the Duty by this Act impofed for or in refpect of fuch Salt or Rock Salt which fhall have been charged with the faid Duty to the Price thereof, and shall be entitled by virtue of this Act to be paid for the fame accordingly.

III. And be it further enacted, That the faid Duty by this Act impofed fhall be afcertained, raised, levied, collected, anfwered, paid, recovered and adjudged in fuch and the like manner as the Duties of Four Shillings and Two Shillings per Bufhel refpectively impofed by the faid Acts made in the Forty third and Forty fifth Years of the Reign of His prefent Majefty King George the Third, for Salt or Rock Salt brought from Scotland into that Part of Great Britain called England, accompanied with a proper Certificate, is by any Law or Laws in force at the time of paffing this Act to be ascertained, raised, levied, collected, anfwered, paid, recovered or adjudged.

IV. And be it further enacted, That all the Monies arifing by the Duty by this Act impofed (the neceffary Charges of raifing and accounting for the fame excepted) fhall from time to time be paid into the Receipt of His Majefty's Exchequer together with the faid recited Duties impofed by the faid Acts made in the Forty third and Forty fifth Years aforefaid, and fhall be carried to and made Part of the Confolidated Fund of Great Britain.

An Act to continue, until the Twenty fifth Day of March One

An Act to amend an Act of the Fifty third Year of His Ma-
jefty's Reign, intituled An Act for the Relief of Infolvent
Debtors in England.

HEREAS an A&t paffed in the Fifty third Year of His 53 G. 3. c.102.
Majefty's Reign, intituled An Ad for the Relief of Infol

vent Debtors in England, and it is expedient to amend the faid
Act;' Be it therefore enacted and declared by The King's Moft
Excellent Majefty, by and with the Advice and Confent of the
Lords Spiritual and Temporal, and Commons, in this prefent Parlia-

ment affembled, and by the Authority of the fame, That it fhall be Place for holdlawful for the Commiffioner appointed or to be appointed by virtue ing Court. of the faid Act, to hold the Court established by virtue of the faid Act, and to exercife his Office as occafion fhall require in any Part of England; but nevertheless such Commiffioner shall at all times have an Office in fome convenient Place, either in the Cities of London or Weftminster, or in the County of Middlefex, within the Bills of Mortality, for the Dispatch of Bufinefs.

II. And whereas it is required by the faid A&t that every 53 G. 3.c. 102. • Prisoner applying by Petition to the faid Court to be difcharged $1. by virtue of the faid Act fhall previously take the Oath required • by the faid Act, and that fuch Petition, with the Schedule in the • faid Act mentioned, and the faid Oath, fhall be filed as in the faid • A& mentioned; and it has been found inconvenient that fuch Oath ⚫ should be taken previous to fuch Petition, and the Order thereon ;' Be it therefore further enacted, That so much of the said Act as requires fuch Oath to be taken before the prefenting of fuch Petition, and to be filed therewith, and that Notice thereof should be given as provided by the faid Act, be and the same is hereby repealed from in Part repealed. and after the paffing of this Act.

III. And be it enacted, That instead thereof, from and after Petition to conthe paffing of this Act, fuch Petition fhall contain an Offer to take tain an Offer to the Oath required by the faid Act, in fuch Form as the circumftances take Oath. of the cafe shall require; and that the faid Oath fhall be taken upon or after the Examination of fuch Prisoner under the faid Act, and fhall thereupon be filed as the faid Act directs; and that the Notice required by the said A&t to be given upon the Order made on fuch Petition fhall not extend to fuch Oath: Provided always, that in all cafes in which fuch Oath fhall have been taken before the paffing of this Act, the fame fhall be of the fame Force and Effect as if this Act had not been made, and the faid Court fhall proceed therein accordingly, if the faid Court fhall think fit.

IV. And be it further enacted, That in all cafes in which No- Notices under tices of the Petition of any Prisoner for Discharge under the faid recited Act how Act, and of the Schedule of fuch Prifoner, and a Copy of the Order given

on fuch Petition, are required by the faid Act (a) to be served on

A.D. 1813Creditors, or Perfons claiming to be Creditors of such Prisoner, it fhall be lawful for the Court established by virtue of the faid Act to difpenfe with fuch Service, and to order that Notice of fuch feveral Matters may be in the Form or to the Effect expreffed in the Schedule to this Act marked (A), or in fuch other Form or to fuch other Effect as the faid Court shall direct, and that fuch Notice may be given either by Advertisement in the London Gazette or other Newspaper or Newspapers, or in fuch other manner as the faid Court fhall fee fit; and it fhall be lawful to comprife Notices on behalf of feveral Prisoners in the fame Advertisement or Inftrument, if the faid Court fhall fo order; and it fhall be lawful for the faid Court either to direct Lifts of the Creditors or Perfons claiming to be Creditors of each of fuch Prisoners to be annexed to fuch Notice, or to direct that fuch Notice fhall refer to the Schedule delivered by each of fuch Prifoners filed in the proper Office of the faid Court; and fuch Notice fo given according to the Order of the faid Court shall be deemed fufficient Notice to the Creditors defcribed in fuch Lift, or described in fuch Schedule, as the cafe may be; any thing in the faid Act to the contrary notwithstanding; and it shall in like manner be lawful for the faid Court to order any other Notice required or authorized by the faid Act or by this Act to be given by Advertisement in any Newspaper or Newspapers, or in any other manner as to the faid Court fhall feem fit.

V. And be it further enacted, That in cafe of Defect in the Form or Manner of Service of any Notice required or authorized by the faid Act (a) or by this Act, or in the Infertion of fuch Notice in the London Gazette or in any Newspaper, or in any Mode of Notice ordered by the faid Court, it fhall be lawful for the faid Court from time to time to adjourn the Hearing of any Petition, and to make fuch further Order refpecting the fame, or refpecting fuch Notice, as to the faid Court fhall appear to be reasonable.

VI. And be it further enacted, That in cafe any Advertisement to be inferted under the Authority of the faid Act (b) or of this Act, in any Newspaper, fhall contain more than Fifty Words, there fhall be paid for the Infertion thereof at the Rate of Six pence for every Ten Words contained in fuch Advertisement beyond the Number of Fifty Words over and above the Sum of Three Shillings mentioned in the faid Act, and no more.

VII. And be it further enacted, That in the Adjudication of the faid Court that any Prisoner is entitled to the Benefit of the faid Act and the Order thereon, it fhall not be neceffary to fpecify the feveral Creditors and Perfons claiming to be Creditors of fuch Prifoner, as required by the faid Act (c), but it fhall be fufficient, if the faid Court fhall think fit, to refer in fuch Order to the Schedule fworn to by fuch Prifoner, fpecifying fuch Creditors or Perfons claiming to be Creditors of fuch Prifoner, either generally or fpecially, or with fuch Exceptions as the circumftances of the cafe fhall appear to the Court to require. VIII. And be it further declared and enacted, That the faid Court fhall have full Power, and the fame is hereby authorized, by any Order for that Purpose, to require the Sheriff or Sheriffs, Keepers

or

or Gaolers of any Prifon, or any other Officer having the Cuftody of any Prifoner, to bring before fuch Court, or any Juftices of the Peace, at any Quarter Seffion or Adjourned or Special Seffion of the Peace, or out of Seffion, as to the faid Court fhall feem fit, any fuch Prifoner, for any of the Purposes authorized by the said Act or by this A&t; which Order every fuch Sheriff, Keeper, Gaoler or other Officer fhall obey; and for fo doing such Order shall be a fufficient Warrant.

IX. And be it further enacted, That in case the said Court, instead Court may orof ordering any Prisoner to be brought before the faid Court for Ex- der Prifoners amination, fhall direct fuch Prifoner to be examined before His be ore Justices Majesty's Juftices of the Peace for any County, Riding, Divifion or in Quarter Place, at a General Seffion of the Peace or any Adjournment thereof, and it fhall appear to the faid Court, from the circumstances of the cafe, to be proper to authorize fuch Juftices to certify their Opinion, whether fuch Prisoner is entitled to be discharged under the Authority of the faid Act, it fhall be lawful for any Creditor or Creditors of fuch Prifoner to oppofe fuch Discharge before fuch Juftices, who fhall thereupon proceed to determine whether fuch Prisoner is or is not entitled to the Benefit of the faid Act, and fhall certify fuch Determination to the faid Court eftablished by virtue of the faid Act, and it shall thereupon be lawful for the faid Court to proceed to adjudge accordingly, as the faid Court might have done in cafe fuch Prifoner had been brought before the faid Court; and it fhall Creditor opponot be lawful for any Creditor or Perfon claiming to be a Creditor of ting Dilcharge. fuch Prifoner to oppofe the Discharge of fuch Prisoner before the faid Court, unless due Notice fhall not † have been given or, to fuch Credit or Perfon claiming to be a Creditor, according to the Order of the faid Court for that Purpose, or unless fome Fraud or improper Conduct of fuch Prifoner, or fome Irregularity not in question before the faid Juftices, fhall be made appear to the Satisfaction of the faid Court.

X. And be it further enacted, That the Notice to be given of Notice given of the Examination of any Prifoner before Juftices of the Peace, at their Quarter Seffion, or any Adjournment thereof, may be given by Advertisement in fome public Newspaper, according to the Order of the faid Court, for Relief of Infolvent Debtors, in the Form or to the Effect expreffed in the Schedule to this Act marked (B), or in fuch other Form or to fuch other Effect as the faid Court shall direct; and it shall be lawful to include any Number of Prisoners in fuch Notice, if the faid Court fhall fo order.

Quarter Seffions

XI. And be it further enacted, That the faid Court, and also the Gaolers exaJuftices of the Peace, to whom the Examination of any Prifoner mined on Oath fhall be referred by the faid Court, fhall refpectively have full Power, by Court or and they are hereby authorized, by Order of the faid Court, or of the faid Juftices refpectively, as the cafe fhall require, to cause the Keepers or Gaolers, or other Officers of any Prifon, or any other Perfon, to come before fuch Court or Juftices, as the cafe fhall require, and to examine fuch Gaolers, Keepers, Officers or other Perfons refpectively, on Oath, touching any Matter relating to the Execution of the faid Act, and of this Act, as to the faid Court and the faid Juftices refpectively fhall feem fit; and if any fuch Gaoler, Keeper, Officer or other Perfon, who fhall be fo examined,
