XII. And be it further enacted, That all and every Sheriffs, Gaolers indem Gaolers, Keepers or other Officers of any Prifon or Prifons, who have done or shall do any thing in obedience to any Order of the faid Court, or of any Juftice or Juftices of the Peace, authorized by any Order of the faid Court by virtue of the faid Act or of this Act, fhall be and is and are hereby indemnified for and in refpect of any thing fo done, and every fuch Order fhall be a fufficient Difcharge to fuch Sheriffs, Gaolers, Keepers and other Officers refpectively, for whatfoever hath been or fhall be done by them refpectively in obedience thereto, and fhall indemnify them refpectively against any Escape or Action for Efcape, or any Action or Actions whatsoever, which hath been or fhall or may be brought against any fuch Sheriffs, Gaolers, Keepers or other Officers refpectively, for any thing which hath been or fhall be fo done as aforefaid; and fuch Sheriffs, Gaolers, Keepers and other Officers refpectively, fhall and may plead to any fuch Action the General Iffue, and give the faid Act and this Act in Evidence, and on Production of fuch Order or Orders as aforefaid, a Verdict fhall be given for the Defendant or Defendants in any fuch Action; and on fuch Verdict, or if the Plaintiff or Plaintiffs in any fuch Actions fhall be nonfuited, or discontinue his, her or their Action, or if Judgment fhall be had for the Defendant or Defendants on Demurrer, the Defendant or Defendants shall have Treble Costs.

XIII. And be it further enacted, That in cafe no fit Perfon fhall be willing to accept the Office of Affignee of the Eftate and Effects of any Prifoner under the faid Act, it fhall be lawful for the faid Court to order fuch Estate and Effects to be affigned to an Officer of the faid Court to be appointed for that Purpofe, and to be called The Provifional Affignee of Infolvent Debtors in England, and fuch Estate and Effects fhall be thereby vefted in fuch Provifional Affignee and his Succeffors, and fhall not remain in him if he fhall refign or be removed from his Office, or in his Heirs, Executors or Administrators in cafe of his Death, but fhall in every such case go to and be vested in his Succeffor in Office; but fuch Officer shall not be bound to do any Act with refpect to fuch Eftate or Effects, except to convey or affign the fame to any Perfon or Perfons to be appointed by the faid Court, Affignee or Affignees thereof for the Purposes of the faid Act; but in cafe no Perfon will accept the Office of Affignee of fuch Eftate and Effects, and the fame fhall therefore remain vefted in fuch Provifional Affignee, and it fhall appear that there are or may be Eftate or Effects which may be applicable to Payment of the Debts of fuch Prifoner, it shall be lawful for the faid Court to make fuch Order for the Preservation and Care thereof as to fuch Court fhall feem neceffary, and to appoint a Receiver or Receivers of fuch Eftate or Effects, with fuch Allowances and giving fuch Security for the fame as to the faid Court shall feem fit; and fuch Receiver or Receivers fhall duly account for and apply fuch Eftate and Effects under the Order of the faid Court, and fhall fell and dispose of or let and fet the fame,

XIV. XV. And be it further enacted, That in cafe the faid Court fhall think fit, it fhall be lawful for the faid Court to receive Affidavits of the Service of any Notice, or of any formal Proceeding in the Execution of the faid Act or of this Act, fuch Affidavits being fworn either before any Officer of the faid Court appointed by the faid Court for that Purpose, or before any Mafter Extraordinary in Chancery, or any Commiffioner for taking Affidavits in the Court of King's Bench, Common Pleas or Exchequer, which Affidavits fuch Officer, Mafter or Commiffioner Perjury. is hereby authorized to take; and if any Person making any fuch Affidavit before any fuch Officer, Mafter or Commiffioner, fhall wilfully forfwear and perjure himself or herself, and shall be lawfully convicted thereof, he or the fo offending fhall fuffer fuch Punishment as by Law may be inflicted on Perfons convicted of wilful and corrupt Perjury.

XVI. And be it further enacted, 1 t fo much of the faid Act 53 G. 3. c. 102. as provides a Court of Appeal from the Court established by virtue § 58. repealed. of the faid Act, fhall be and the fame is hereby repealed.

And be it further enacted, That if it fhall appear by Notice in the London Gazette published on the Saturday which shall happen next after the First Wednesday in May, the First Wednesday in September One thousand eight hundred and fourteen, or the Firit Wednefday in January One thoufand eight hundred and fifteen, that the Average Prices of Brown or Mufcovado Sugar taken in manner directed by an Act made in the Thirty fecond Year of the Reign of 32 G. 3. c. 43. His prefent Majefty, intituled An Ad for regulating the Allowance of

the Drawback and Payment of the Bounty on the Exportation of Sugar, and for permitting the Importation of Sugar and Coffee into the Bahama and Bermuda Islands in Foreign Ships, for the Four preceding Months, computed to the Wednesday immediately preceding fuch Saturday aforefaid, fhall not have exceeded Seventy Shillings for an Hundred Weight exclufive of the Duties of Customs paid or payable thereon on the Importation into Great Britain, then and in every fuch cafe the Drawback or Bounty in the Schedules to the faid recited Acts paffed in the Forty ninth and Forty fifth (b) Years of His prefent Majefty aforefaid refpectively annexed mentioned, as correfponding to or with the Price of which fuch Notice in the London Gazette fhall have been given as aforefaid, fhall be paid or allowed until Notice of any other Average fhall in like manner appear in the London Gazette on any other of fuch Saturdays as before mentioned; and fuch Drawback or Bounty fhall be paid or allowed in like manner in every refpect, and fubject and under and according to the like Rules and Regulations, Reftrictions, Penalties and Forfeitures, as Drawbacks or Bounties were paid or allowed before the paffing of the faid first recited Act (except as any fuch Rules or Regulations are altered by the faid recited Acts of the Forty ninth and Forty fifth Years aforefaid). III. And whereas Doubts may arife in certain cafes refpecting the Duty that would be chargeable on Raw or Clayed Sugar of the Produce of the British Plantations, or of the Iflands of Martinique, Mariegalante, Guadaloupe, Saint Euftatia, Saint Martins and Saba, exported from the Warehouse in which any fuch Sugar shall have been fecured on Importation into Great Britain; Be it therefore enacted and declared, That, from and after the paffing of this Act any fuch Sugar fo warehoufed on which the Duties of Cuftoms shall not have been paid, which fhall be exported or fhipped for Exportation from any fuch Warehouse, fhall be fubject and liable only to the Payment of fuch Portion (if any) of the Duties of Cuftoms due and payable on the Importation of British Plantation Sugar into Great Britain as fhall exceed the Amount of the Drawback that would have been paid or allowed on the Exportation of any fuch Sugar, at the time any fuch Sugar as aforefaid fhall be fo exported or fhipped for Exportation in cafe the full Duties due and payable thereon had been previously paid.

IV. And whereas by an Act paffed in the Forty ninth Year of the Reign of His prefent Majefty, intituled An Ad for repealing the feveral Duties of Customs chargeable in Great Britain, and for 'granting other Duties in lieu thereof, the Lord High Treasurer or the Lords Commiffioners of His Majefty's Treafury, or any Three or more of them, are authorized to fufpend the Payment of the additional Duties of Cuftoms on Sugar granted by the faid laft recited A&t, either in the Whole or in Part, whenever the Average Price
