form the faid Statute Duty which they have fo neglected or refufed to perform, either in the same or in the following Year; the Payment of fuch Forfeitures, and the Arrears of fuch Statute Duty, Forfeitures and to be enforced and applied to the Benefit of the Highway or Turn- Arrears how enpike Road, as the cafe may be, to which the original neglected Duty forced, &c. was due or owing, by the Surveyor or Surveyors for the time being, and under the fame Regulations and in the fame manner as other Forfeitures may be levied, and Statute Duty may in other cafes be enforced by any of the Provifions of any of the faid hereinbefore recited Acts.

VIII. And be it further enacted, That the Juftices of the Peace Juftices of and Magiftrates of all Cities, Corporations, Boroughs, Precincts, Liberties and other separate Jurifdictions, are hereby authorized and required to put in Execution every Part of this Act within their refpective Jurifdictions, fo far as the Provifions thereof are applicable, in as full and ample a manner as the Juftices of any County or of any Divifion thereof.

Provided alfo, and be it further enacted, That nothing in Not to alter this Act contained shall alter the feveral hereinbefore recited Acts, former Acts but nor any A&t or Acts paffed fubfequently to the said herein before where expressly recited Acts, regarding the Highways or Turnpike Roads in England and Wales; but that the fame, where not exprefsly amended or altered by this Act, fhall remain in as full force as at the time of paffing this Act; and that all their Powers, Authorities, Provisions, Regulations and Forms, fhall be applicable, not only to the carrying those Acts refpectively into Execution, but also this Act, so far as the fame are adapted thereto, and are not exprefsly varied or altered by this Act, in as full and ample a manner as if the fame had been re-enacted in this A&.

Payments to Out Penfioners of the faid Hospital residing in
Ireland.

feveral of the and Nurses the

Hofpital for Seamen at Greenwich, have of late pawned or otherwife difpofed of the Clothes, Linen, Stores and other Goods, delivered to them to wear or use, and it is expedient to 6 prevent fuch Practices in future;' Be it therefore enacted by The King's Most Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That the Commiffioners and Governors of the faid Royal Hof- Clothes, &c. bepital, their Succeffors and Affigns, fhall or may, and they are here- longing to Hofby authorized and empowered to caufe the Clothes, Linen, Stores pital marked. and other Articles capable of being marked, from time to time, belonging to the faid Hofpital, to be marked, ftamped or branded with an Anchor furmounted with a Naval Crown, with Two Flags over the Crown, and the Letter G. on the one Side of fuch Device, and the Letter H. on the other Side thereof; and that if any Pawnbroker

A.D. 1814. Pawnbrokers or broker or other Perfon or Perfons shall take in pawn, buy, exchange others taking in or receive any Clothes, Linen or other Goods marked, ftamped or Goods marked, branded as aforefaid, from any Perfon or Perfons upon any Account or Pretence whatever (fuch Mark, Stamp or Brand thereon to be confidered and taken to be fufficient Evidence without further Proof of the Right of Property in the faid Commiffioners and Governors), or hall caufe fach Mark or Stamp, Marks or Stamps to be taken out, obliterated or defaced, the Perfon or Perfons fo offending fhall forfeit for every fuch Offence the Sum of Ten Pounds, upon Conviction thereof, by the Oath of One or more credible Witnefs or Witneffes before any One or more of His Majefty's Juftices of the Peace of the County wherein the faid Offence or Offences fhall be committed, which Penalty fhall be levied by Warrant under the Hand and Seal or Hands and Seals of the faid Juftice or Juftices of the Peace, by Diftrefs and Sale of the Goods and Chattels of the faid Offender or Offenders, one Moiety of which faid Penalty or Penalties fhall be paid to the Informer or Informers, and the other Moiety fhall go and be paid to the Use of the faid Hofpital; and in cafe any fuch Offender or Offenders, who fhall be convicted as aforefaid of having bought, exchanged, received or taken in pawn any fuch Clothes, Linen or other Goods as aforefaid, or of having caufed fuch Mark or Stamp, Marks or Stamps as aforefaid, to be taken out or defaced, fhall not have fufficient Goods and Chattels whereon Diftrefs may be made to the Value of the faid Penalty recovered against him, her or them for fuch Offence or Offences, or fhall not pay fuch Penalty or Penalties within Four Days after fuch Conviction, then and in fuch cafe fuch Juftice of the Peace fhall and may, by Warrant under his Hand and Seal, either + commit fuch Offender or Offenders to the Common Gaol of the County where fuch Offence or Offences fhall be committed, there to remain without Bail or Mainprize, for the Space of Three Calendar Months; and that if any Penfioner or Nurfe of the faid Hofpital fhall defert or run away from the fame, and carry away with them any Clothes, Linen or other Goods belonging to the faid Hofpital, fuch Perfon or Perfons being lawfully convicted thereof, by the Oath or Oaths of One or more credible Witnefs or Witneffes, fhall be committed to the Common Gaol or Houfe of Correction of the Town, City or County where he, the or they fhall be apprehended, for the Space of Six Calendar Months, without Bail or Mainprize.

II. And Whereas by an Act paffed in the Parliament of Ireland, in the Thirty third Year of His prefent Majefty, intituled An Að 'for the Encouragement of Seamen and Marines employed in the Royal Navy, by rendering it more eafy to Petty Officers and Seamen, Non Commiffioned Officers of Marines and Marines, to remit their Wages to this Kingdom, and by providing for the Payment in this Kingdom of the Wages due to deceafed Officers, Seamen and Marines as aforefaid, Provifion was made for enabling Seamen • refident in that Kingdom to receive Out Penfions granted to them • by the faid Commiffioners or Governors of the faid Hofpital, and for preventing Frauds and Abuses attending the fame, which has not been found effectual for the Attainment of the good Purposes intended thereby ;' Be it therefore enacted, That fo much of the faid recited Act as relates to any Provifion or Provifions for

III. And be it further enacted, That the Treasurer of the faid Out Penfions Hofpital for the time being, or his Deputy, legally authorized, fhall, how paid. when and as often as Occafion fhall require, make out or caufe to be made out, Two Certificates for any Out Penfion granted by the faid Commiffioners and Governors to Seamen refiding in that Part of the United Kingdom called Ireland, which Certificates fhall be Duplicates and joined together with oblique Lines, Flourishes or Devices, and numbered, dated and figned by the faid Treafurer or his Deputy, or his First Clerk, and attefted by the Steward of the faid Hospital, or his First Clerk, or the Clerk of the Cheque of the faid Hofpital, or his First Clerk, and addreffed to the Collector of the District in Ireland in which the Perfon named in the Certificate as Out Penfioner fhall refide, and fhall be written or printed in the Form or to the Effect fet forth in the Schedule to this Act marked (A.), one of which Certificates fhall be tranfmitted to the Perfon named therein as an Out Penfioner of the faid Hofpital, and the other fhall be tranfmitted to the Collector to whom the fame fhall be addressed, and upon the Duplicate of fuch Certificate being produced and delivered to fuch Collector by the Perfon entitled, or claiming to be entitled to receive the Money therein mentioned, fuch Collector fhall examine the faid Duplicate and enquire into the Truth thereof, by the Oath of the Perfon producing the fame (which Oath fuch Collector is hereby empowered and directed to adminifter), and being duly fatisfied of the Truth thereof, he fhall immediately, without Fee or Reward on any Pretence whatever, pay to the Perfon specified in fuch Certificate, the Sum mentioned therein, taking his Receipt on the Back thereof for the fame: Provided always, that the Claim Provifo. upon or on account of fuch Duplicate fhall be made to the Collector within Nine Calendar Months from the Date thereof; and in cafe the Duplicate of fuch Certificate fhall not be produced and delivered, and the Payment of the Money therein mentioned be not demanded within Nine Calendar Months from the Date thereof, then the Collector fhall tranfmit the Certificate to the Treasurer of the faid Hofpital at Greenwich.

Provided always, and be it enacted, That if any Collector Collectors to to whom the Duplicate of any fuch Certificate fhall be tendered as whom Duplihereinbefore mentioned, in order to receive Payment of the Money cates of Certifi therein mentioned, fhall not have in his Hands Public Money fufficient ca es tendered, to answer the fame, or fhall refufe or delay immediate Payment thereof, Money in Hand, fuch Collector fhall indorce on the Back of the Duplicate of fuch to inderfe Certificate, the Day of its being tendered to him, and the Cause of thereon Cause his Refufal or Delay to pay the fame; and fhall appoint thereon of Delay, &c. for Payment of fuch Certificate fome future Day, within the Space of One Month at fartheft from the Day of its being prefented to him; which Duplicate, with the Indorsement thereon, fhall immediately be delivered back to the Perfon prefenting the fame; and if on Complaint made to the Commiffioners of His Majesty's Revenue in Ireland, who, or any Three or more of them, are hereby authorized to hear and determine the fame, it fhall be proved to the Satisfaction of fuch Commiffioners, or any Three or more of them, that any

fuch Collector hath unneceffarily or wilfully refufed or delayed Pay. ment of fuch Certificate as aforefaid, the fame having been presented to him, or that fuch Collector, or any Perfon employed by or under him, hath directly or indirectly received or taken any Fee, Gratuity, Discount or Deduction whatever, on account of Payment of fuch Money, it fhall and may be lawful for the faid Commiffioners to fine fuch Collector in a Sum not exceeding Fifty Pounds; which Fine fhall be recovered and levied in fuch and the fame manner as any Penalty for any Offence against any Law by which any Duties of Cuftoms or Excife is impofed or levied in Ireland; and the faid Fine, when recovered, fhall be paid to the Informer or Informers against fuch Offender or Offenders.

V. And be it enacted, That every Collector who fhall pay any Sum or Sums of Money to any Perfon entitled to receive the fame in purfuance of this Act, fhall return the Duplicate on which the Acknowledgment of the Receipt of fuch Money fhall be endorfed, to the aforefaid Commiffioners of His Majefty's Revenue, who shall once in every Quarter of a Year caufe a Certificate to be given to fuch Collector, fpecifying the Amount of the Money appearing by fuch Receipts to have been in purfuance of this Act, by fuch Collector paid within fuch Quarter; and every fuch Collector fhall be credited by the faid Commiffioners for the Payment of fuch Money, in like manner as if the fame had been advanced and paid, in pursuance of the Orders of the faid Commiffioners, for any other Purpofes for which they are entitled to issue Orders for Collectors for the Payment of Money.

VI. And be it further enacted, That whofoever willingly or knowingly fhall perfonate or falfely affume the Name or Character of, or procure any other to perfonate or falfely to affume the Name or Character of any Person to whom any fuch Certificate as aforefaid fhall have been granted, in order to receive the Money mentioned in fuch Certificate, or fhall willingly and knowingly perfonate or falfely affume the Name or Character of, or procure any other to perfonate or falfely to affume the Name or Character of any Perfon, in order to receive any Money due or fuppofed to be due for or on account of any Out Penfion granted by the faid Hofpital; or fhall forge or counterfeit, or procure to be forged or counterfeited, any Bill, Certificate, Letter of Attorney, Ticket, Certificate, Affignment, laft Will or any other Power or Authority, or other Document what foever, in order to receive any fuch Money; or fhall willingly and knowingly take a falfe Oath, or procure any other Perfon to take a falfe Oath, in order to receive Payment of any Money due or fuppofed to be due for or on account of any Out Penfion granted by the faid Hofpital; or fhall utter or publish as true any falfe, forged or counterfeited Letter of Attorney, Bill, Ticket, Certificate, Aflignment, laft Will or any other Power or Authority, in order to receive Payment of any Money due, or fuppofed to be due, for or on account of any Out Penfion; being lawfully convicted of any of the faid Offences, fhall be deemed guilty of Felony, and fhall fuffer Death as a Felon, without the Benefit of Clergy.

VII. And be it further enacted, That this A&t fhall be and the fame is hereby declared to be a Public Act; and all Judges, Juftices and others, are hereby required to take Notice thereof as fuch, without fpecially pleading the fame.

The perfonating or falfely affuming the Name and Character of any Out Penfioner of Greenwich Hofpital, in order fraudulently to receive the Penfion due to fuch Penfioner, is Felony without Benefit of Clergy.

The Officer to whom the within Bill is addreffed, is directed to examine the Duplicate thereof when presented, and enquire into the Truth by the Oath of the Perfon prefenting the fame, and being fatisfied, he is to certify to that Effect on the Back of the Bill, and pay the Amount without Fee or Reward; but if he shall not be able to pay the Amount from not having Public Money fufficient in his Hands, he is to note the Caufe of his refufing Payment, and fhall appoint another Day within One Month at farthest from that time, and shall deliver back the Bill so noted to the Perfon prefenting it, and if upon Complaint to the Commiffioners of His Majefty's Revenue in Ireland, it shall appear that the Officer to whom this is addreffed has unneceffarily delayed Payment, or taken any Fee, or made any Deduction whatever, he will be subject to a Fine not exceeding Fifty Pounds.

WHEREAS an Act was made in the Parliament of Ireland 36 G. 3. (1.)

in the Thirty fixth Year of the Reign of His prefent Majefty, c. 42. 'intituled An A to prevent the Importation of Arms, Gunpowder ' and Ammunition into this Kingdom; and the making, removing, felling and keeping of Gunpowder, Arms and Ammunition, without Licence; and which was to continue in force for the Term in the faid
