from fome lawful Caufe, and not from any fuch fraudulent or evasive Defign as aforefaid, every Perfon fo appearing to be Party, Privy or Acceffary as aforefaid, fhall be deemed and adjudged guilty of a Mifdemeanor, and shall suffer as hereinafter mentioned. XIX. And be it further enacted, That if on Information given on On Information Oath, it fhall appear to the said Juftices that there is reasonable Caufe that there is reasonable Caufe for fufpecting that any Materials, Furniture, Stores or any Part of for for fufpecting the Cargo of any fuch Ship or Veffel, lying or being in the faid that any of the River, or any Stores belonging to His Majefty, or configned to any Cargo of any Perfon or Perfons for His Majefty's Service, have been ftolen or unlawfully obtained, from or out of any fuch Ship or Veffel, or from or out of any Boat, Barge, Lighter or Craft lying or being in the faid River, or from any Wharf, Quay or other Landing Place adjacent to the fame, and within the Limits of the aforefaid Counties, City and Liberties, or from or in the way to or from any Warehouse into or from which fuch Articles had been removing or removed to or from any fuch Wharf, Quay or Landing Place, and that fuch Articles after having been fo ftolen or unlawfully obtained are concealed or otherwife lodged in any Dwelling Houfe, Warehouse, Yard, Garden or any other Place, it fhall be lawful for the faid Juftices or other Juftices in their respective Jurifdictions, or any One of them, by Special Warrant under their Hands and Seals directed to any fuch Thames Police Conftable or Surveyor as aforefaid, or other Constable within their respective Jurifdictions, to caufe every such Place to be fearched at any time of the Day, or by Night, if Power for that Purpose be especially given in and by fuch Warrant; and the faid Juftices, if it fhould appear to them requifite and neceffary, may moreover empower fuch Conftable or Surveyor with any fuch Affiftance as to them the faid Juftices may appear, or by fuch Constable or Surveyor be found neceffary (fuch Conftable or Surveyor having previously made known fuch his Authority), to use Force for the effecting of fuch Entry, whether by breaking open Doors or otherwife; and if upon Search thereupon made any fuch fufpected Article or Articles fhall accordingly be found, then and in fuch case to convey the fame forthwith to and before the faid Juftices, or to guard the fame on the Spot while the Offenders are taken before the faid Juftices, or otherwife difpofe thereof in fome Place of Safety, fubject to the Orders of the faid Juftices in manner as above mentioned, and moreover to apprehend and convey before the faid Justices the Perfon or Perfons in whofe Houfe, Lodging or other Place as aforefaid, the fame fhall fo have been found; as alfo every such other Perfon fo found in fuch House, Lodging or Place as fhall appear to have been privy to the depofiting of fuch Articles or any of them in fuch Place, knowing or having reasonable Caufe to fufpect the fame to have been stolen or otherwife unlawfully obtained; and if fuch Perfons refpectively fhall not immediately or within fome reasonable time to be affigned by the faid Juftices, make it appear to the Satiffaction of the faid Juftices by what lawful Means fuch Article or Articles came to be depofited or fituated in fuch Place as aforefaid, without any Default on the Part of such Perfons respectively, or that they respectively did not know that the fame were, or by what means the fame were depofited or fituated in fuch Place, then and in fuch cafe the Perfon or Perfons in whofe Houfe, Lodging or other Place such suspected Article or Articles was or were found, as alfo every 3Qa

other Perfon fo appearing to have been privy to the depofiting thereof, knowing or having Caufe to fufpect the fame to have been ftolen or otherwife unlawfully obtained, fhall be deemed and adjudged guilty of a Mifdemeanor, and fhall fuffer as hereinafter mentioned.

XX. And be it further enacted, That every Person who for the Purpose of protecting or preventing any Goods, Wares, Merchandize or other Articles what foever from being feized on fufpicion of their being stolen or otherwife unlawfully obtained, or of preventing the fame from being produced or made to ferve as Evidence of or concerning any Felony or Mifdemeanor, fhall frame or caufe to be framed, or be any ways concerned in framing or caufing to be framed any Bill of Parcels containing any falfe Statement in regard to the Name or Abode of any alleged Vendor, the Quantity or Quality of fuch Goods or Valuables, the Place from whence or Conveyance by which the fame were furnished, the Price agreed upon, or charged for the fame, or any other Particular or Particulars, knowing fuch Statement to be falfe, or who fhall fraudulently produce fuch Bill of Parcels, well knowing the fame to have been fraudulently framed, fhall be adjudged guilty of a Mifdemeanor, and fhall fuffer as hereinafter mentioned, and may moreover, at the Difcretion of the faid Juftices, or fuch other Juftices in whofe Jurifdiction fuch Offences fhall be committed, be published and advertised as a Fabricator of falfe Bills of Parcels, or as a convicted or reputed Receiver of Goods stolen, or otherwife unlawfully obtained, as the cafe may be.

XXI. And be it further enacted, That it fhall be lawful for every fuch Thames Police Surveyor (fubject to the Orders of the faid Juftices appointed as aforefaid), having juft Caufe to fufpect that any Felony has been or is about to be committed in or on board of any Ship, Hoy, Barge, Lighter, Boat or other Veffel lying or being in the faid River, and within the Limits aforefaid, to enter at all times as well by Night as by Day, into and upon every fuch Ship, Hoy, Barge, Lighter, Boat or other Veffel, and therein to take all neceffary Meafures for the effectual Prevention or Detection of all Felonies which he has juft Caufe to fufpect have been or are about to be committed in and upon the faid River, and within the faid Limits, and to apprehend and detain all Perfons fufpected to be concerned in the faid Felonies, and alfo all Property fo fufpected to be felonioufly ftolen, and the fame to produce before One or more Juftice or Juftices within his or their refpective Jurifdictions; and every fuch Thames Police Surveyor is hereby authorized at any time between Sun-rifing and Sun-fetting to enter any Ship or Veffel (except His Majefty's Ships) in the faid River, and within the Limits in the faid firft recited Act mentioned, and to fearch the fame for unlawful Quantities of Gunpowder, and alfo fhall have the fame Powers of feizing, removing to proper Places and detaining all fuch unlawful Quantities of Gunpowder found on board any fuch Ship or Veffel, and the Barrels in which fuch Gunpowder fhall be, as are given to Perfons fearching for unlawful Quantities of Gunpowder under a Warrant of a Juftice of the Peace, by virtue of an Act paffed in the 12 G. 3. c. 61. Twelfth Year of His prefent Majefty, intituled An Act to regulate the making, keeping and carriage of Gunpowder within Great Britain'; and to repeal the Laws heretofore made for any of thofe Purpofes.

XXII. And be it further enacted, That in all cafes in which it is directed in the faid Act that any Boat with her Tackle and Appur

tenances which fhall be forfeited, shall be burnt and destroyed, it shall being burnt be lawful for any Juftice or Juftices within their refpective Jurifdictions restored or fold. before whom any Perfon or Perfons fhall have been convicted of any Offence, whereby any Boat is or fhould be adjudged to be forfeited, either to direct fuch Boat with her Tackle and Appurtenances to be burnt and destroyed, or restored to the Owners thereof, or to be publicly fold, and the Produce of fuch Sale to be applied in like manner as all other Cafes of Forfeitures under the said A&; any thing in this A&t to the contrary thereof notwithstanding.

XXIII. And Whereas it is expedient, that indecent and improper bathing in the River Thames between the Entrance of the Eaft India Docks at Blackwall and Battersea Bridge should be C prevented;' Be it therefore enacted, That the faid Juftices fhall Bathing between and are hereby required to caufe a Notice or Notices to be affixed whereever they may think fit, on any Poft, or on the Front of any Wharf, Wall or Building adjoining the River Thames, between the Places aforefaid, thereby directing, that no Perfon fhall from and after Seven of the Clock in the Morning and during fo long as Day Light fhall continue, undrefs himself on the Shore of the faid River, or fhall expofe his naked Body to Public View for the Purpose of bathing within the Limits to be prescribed by fuch Notice or Notices; and if any Perfon fhall act contrary thereto, he fhall, for every fuch Offence, forfeit and pay any Sum not exceeding Twenty Shillings to any Perfon who fhall make Complaint thereof before the faid Juftices, or in Default of Payment thereof fhall be committed to Penalty. Prifon by the faid Juftices, or any One of them, for any time not exceeding Twenty four Hours.

• XXIV. And Whereas Difputes and Difficulties do frequently arife between Bargemen, Lightermen, Watermen, Ballaftmen, Coalwhippers, Coalporters, Sailors, Lumpers, Riggers, Shipwrights, Caulkers and other Labourers who work for Hire on or upon the River Thames, and the Docks, Creeks, Wharfs, Quays and Places adjacent, refpecting Wages or Money due to them for Work, and the Owner or Owners, Captains or Commanders of Veffels, and their Agents on the faid River, and the Docks and Creeks thereunto adjoining, and alfo the Owner or Owners, Wharfinger or Wharfingers, or Occupiers of fuch Wharfs or Quays, and their Agents and • other Perfons employing the faid Labourers;' Be it enacted, That, Difputes about from and after the paffing of this Act, all Differences, Complaints Wages for and Difputes which fhall happen and arife between any Bargemen, Labour done Lightermen, Watermen, Ballaftmen (except Trinity Ballaftmen), River, &c. Coalwhippers, Coalporters, Sailors, Lumpers, Riggers, Shipwrights, Trinity Ball(except by Caulkers or other Labourers who work for Hire on or upon the men) fetted by faid River, or the Docks, Creeks, Quays, Wharfs or Places adjacent, Justices; pro. and the Owner or Owners, Captain or Commander of any Veffel, or vided Sum in their Agents on the faid River, or the Docks or Creeks thereunto Queftion does adjoining, or the Owner or Owners, Wharfinger or Wharfingers, or not exceed 51, Occupiers of any Wharf or Quay, or their Agents cr other Employer or Employers refpecting Wages or Money due to any such Labourer or Labourers for Work, whether the fame Perfons be employed for any certain time, or in any other manner, fhall be heard and determined by the faid Juftices, or any One of them, or any other Juftice or Juftices within his or their respective Jurifdictions, and every fuch Justice or Juftices is and are hereby empowered to fummon before

him or them any fuch Captain or Commander of any fuch Vessel, or any fuch Owner or Owners thereof, or their Agents, or the Owner or Owners, Wharfinger or Wharfingers, or Occupier of any Wharf or Quay, or their Agents, or any other Employer or Employers; and if any fuch Captain, Commander or Owner of any fuch Veffel or their Agents, or the Owner, Wharfinger or Occupier of any fuch Wharf or Quay, or their Agents, or any fuch other Employer or Employers fhall refufe or neglect to attend fuch Summons, then every fuch Juftice or Juftices is and are hereby empowered to iffue his or their Warrant to bring fuch Perfon or Perfons before him or them, to answer fuch Complaint, and every fuch Juftice and Juftices is and are hereby empowered to examine upon Oath any fuch Bargeman, Lighterman, Waterman, Ballaftman (other than any Trinity Ballaftman), Coalwhipper, Coalporter, Sailor, Lumper, Rigger, Shipwright, Caulker or other Labourer, or any other Witnefs or Witneffes touching any fuch Complaint or Difpute, and to make fuch Order for Payment of fo much Wages to fuch Bargeman, Lighterman, Waterman, Ballaftman (other than any Trinity Ballastman,) Coalwhipper, Coalporter, Sailor, Lumper, Rigger, Shipwright, Caulker or other Labourer, as to fuch Juftice or Juftices fhall feem juft and reasonable; provided that the Sum in queftion do not exceed the Sum of Five Pounds, befides all reasonable Cofts attending the Profecution of the faid Complaint, which Cofts the faid Juftice or Juftices are hereby empowered to order; and in cafe of Refufal or Nonpayment of any Sum or Sums fo ordered by the Space of Twenty four Hours next after such Determination, fuch Justice or Justices shall and may iffue forth his or their Warrant to levy the fame by Diftrefs and Sale of the Goods and Chattels of fuch Captain or Commander aforefaid, or of any Owner or Owners of any Veffel, or their Agents, or the Owner or Owners, Wharfinger or Wharfingers, or Occupier of any Wharf or Quay, or of any other Employer or Employers, or any fuch Bargeman, Lighterman, Waterman, Ballaftman (other than any Trinity Ballaftman), Coalwhipper, Coalporter, Sailor, Lumper, Rigger, Shipwright, Caulker or other Labourer working for Hire on the River Thames, or the Docks, Creeks, Wharfs, Quays and Places adjacent, rendering the Overplus (if any) to the Owner after Payment of the Sums fo ordered for Wages or Money due to them for Work and neceffary Cofts, together with all Charges of fuch Diftrefs and Sale.

XXV. Provided always, and be it further enacted, That all fuch Orders as fhall be made as aforefaid by any Juftice or Juftices fhall be final and conclufive to all Intents and Purposes, and from which faid Orders no Appeal shall be allowed.

XXVI. And, for the more effectual Prevention of Accidents by Fire and other Mischiefs upon the faid River of Thames, it is hereby further enacted, That if any Master or Commander or other Officer of any Ship or Veffel (except His Majefty's Ships) fhall while fuch Ship or Veffel fhall lie or be in the faid River of Thames between London Bridge and Blackwall, keep any Gun or Guns on board fuch Ship or Veffel fhotted or loaded with Ball, or cause or permit to be fired or difcharged any Gun or Guns on board fuch Ship or Veffel before Sun-rifing or after Sun-fetting, fuch Mafter, Commander or other Officer fhall, for every fuch Gun fo kept thotted or loaded, forfeit the Sum of Five Shillings, and for every Gun fo fired or dif

charged the Sum of Ten Shillings; and alfo, that if any Mafter, Commander or other Officer of any Ship or Veffel, or any other Perfon on board the fame, or any Perfon on board of any Barge, Lighter, Boat or other Craft or Veffel fhall, while fuch Ship or Veffel or fuch Barge, Lighter, Boat or other Craft or Vessel shall lie or be in the River of Thames, between London Bridge and Blackwall, heat or melt, or caufe or permit to be heated, or melted, by Fire, Loggerheat Shot, or any other Thing on board any fuch or any other Ship or Veffel, or Barge, Lighter, Boat or other Craft or Veffel whatever, any Pitch, Tar, Rofin, Grease, Tallow, Oil, or other fuch combustible Matter or Thing, every Perfon or Perfons fo offending fhall, for every fuch Offence, forfeit any Sum not exceeding Five Pounds; and any Penalty. One or more of the faid Justices, or any other Juftice or Juftices for the City of London, or the Counties of Middlefex, Surry or Kent, within his or their respective Jurisdictions, is and are hereby authorized and required, upon any Information exhibited or Complaint made in that behalf within Ten Days next after any fuch Offence fhall have been committed, to fummon the Party or Parties accufed, and also the Witneffes on either Side, or after Oath made of the Commiffion of any of the Facts above mentioned by One or more credible Witness or Witnesses to iffue a Warrant or Warrants to apprehend the Party or Parties accufed, and upon the Appearance or Contempt of the Party or Parties accused in not appearing (upon the Proof of Notice given) fuch Justice or Juftices fhall proceed to the Examination of the Witness or Witneffes on Oath (which Oath he or they is and are hereby authorized and required to adminifter), and upon due Proof thereof, either by the voluntary Confeffion of the Party or Parties, or by the Oath of One or more credible Witnefs or Witnesses, to give Judgment or Sentence accordingly; and in cafe the Party or Parties accused fhall be convicted of fuch Offence, it shall and may be lawful for fuch Juftice or Juftices to iffue his or their Warrant for the levying fuch Penalty or Penalties on the Goods of the Offender or Offenders, and to caufe Sale to be made thereof in cafe they shall not be redeemed within Five Days, rendering to the Party or Parties the Overplus, if any there be, and where no Goods, or not fufficient Goods, of such Offender or Offenders can be found, to commit such Offender or Offenders to Prison, there to remain for any time not exceeding the Space of Two Months, unless the Penalty or Penalties awarded by fuch Juftice or Juftices to be paid by fuch Offender or Offenders shall be sooner paid; and if any Perfon or Perfons fhall find himself or themselves aggrieved by the Judgment of any fuch Juftice or Justices, he or they fhall and may appear to the Juftices of the Peace affembled at the next General Quarter Seffions for the County or City where fuch Offence or Offences fhall have been committed, on giving immediate Notice of fuch Appeal, and finding fufficient Security to the Satisfaction of fuch Juftice or Juftices for profecuting fuch Appeal with Effect, and for abiding the Determination of the Court therein, which faid Justices are hereby empowered to fummon and examine Witnesses upon Oath, and finally to hear and determine the fame, and in cafe the Judgment fhall be affirmed, to award the Perfon or Perfons fo appealing to pay fuch Cofts occafioned by fuch Appeal as to them the faid Juftices fhall feem meet; and One Moiety of all Money recovered on account of every fuch Forfeiture and Penalty fhall be distributed at the Discretion of the Juftice making
