An Act for inclofing Lands within the Manor of Allonby, in the Parish of Bromfield, in the County of Cumberland. (q. P.) [4th May 1814.]

Your Majefty that it may be enacted; and be it enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That at the next General Quarter Seffions of the Peace, to be holden after the paffing of this Act at Warwick, in and for the faid County of Warwick, and afterwards at any fubfequent General Quarter Seffions of the Peace to be holden for the faid County, it shall and may be lawful for the Juftices of the Peace for the faid County then and there affembled, and they are hereby authorized and empowered to make fuch Order or Orders for the building, repairing, purchafing, providing and furnishing, in the Town of Warwick, any Houfe, or any Piece of Land whereon a House may be built, with suitable Offices and Accommodations for the Refidence of His Majefty's Judges at the Affizes for the faid County, with their Officers and Attendants, and for tranfacting the Bufinefs ufually tranfacted at the Lodgings of His Majefty's Judges during the Affizes, as to them the faid Juftices fo affembled, or the major Part of them, fhall from time to time appear expedient and neceffary, and for paying, discharging and defraying all the Expences, Cofts and Charges of and attending the purchafing, erecting, building, providing and furnishing of the fame, and of effecting and carrying into Execution the feveral Purposes of this Act, by and out of the Public Stock or County Rates of the faid County, fubject to such Restrictions and Provifions as are herein.

II. And be it further enacted, That it shall be lawful for the faid Juftices of the Peace affembled at any General or Quarter Seffions for the faid County, from time to time to order and direct fuch Salaries or Allowances to be paid, out of the Monies to be raised by virtue of this Act, to the faid Clerk of the Peace, or his Deputy, for affifting in the Execution of this Act, or for executing any Rules, Orders or Regulations to be made in pursuance thereof, as shall be thought reafonable by the faid Juftices.

III. And, for the more fpeedy and effectually carying into Execution the Powers of this Act, be it further enacted, That it fhall be lawful for the faid Juftices affembled at any General Quarter Seffions of the Peace, or the major Part of such Juftices, to borrow and take up at Intereft any Sum or Sums of Money not exceeding in the Whole the Sum of Fifteen thousand Pounds, on the Credit of the County Rates to be made, raised and affeffed upon and within the faid County, and by Writing under their Hands and Seals, to mortgage or affign over any fuch Rates to the Perfon or Perfons who fhall advance or lend fuch Money, or to his, her or their Trustees, as a Security for the Repayment of any Money to be advanced for the Purpofes of this Act, with Intereft after the Rate of Five Pounds per Centum per Annum; and all Perfons to whom any fuch Mortgages or Affignments fhall be made, or who fhall be entitled to the Money thereby fecured, fhall be in Proportion to the Sums in fuch Securities mentioned, Creditors on the faid Rates equally one with another, without any Preference in refpect of the Priority of advancing fuch Money, or the Dates of any fuch Mortgages or Affignments; and every fuch Mortgage or Affignment fhall be good, valid and effectual in the Law for the Purpofes thereby intended.

And be it further enacted, That it fhall be lawful for the Per- Securities for fons entitled to any of the Securities to be given for Money advanced Money transfor the Purposes of this Act, and their refpective Executors, Adminiftrators or Affigns, at any time by Writing under their Hands and Seals to transfer fuch Securities to any Perfon or Perfons whomfoever; and Copies of all Mortgages and Affignments which fhall be made in pursuance of this Act, and Extracts or Memorials of all Transfers thereof, fhall be entered in a Book to be kept for that Purpose by the Clerk of the Peace for the faid County, which Extracts or Memorials fhall specify and contain the Dates, Names of the Parties, and the Sums of Money thereby fecured, to which Book any Perfon interested fhall at all feasonable times have accefs, and fhall have free Liberty to infpect the fame without Fee or Reward; and for the Entry of every fuch Transfer, the faid Clerk of the Peace fhall be paid by the Person to whom fuch Transfer fhall be made, the Sum of Five Shillings and no more; and after fuch Entry made of any fuch Transfer, every fuch Transfer so entered fhall entitle the Perfon to whom the fame fhall be made, and his, her and their refpective Executors, Adminiftrators and Affigns, to the Benefit of the Security thereby transferred.

Fee.

V. Provided always, and be it further enacted, That the Money Money exto be expended in the purchafing, building, erecting, providing, pended not to fitting up and furnishing fuch Houfe, Buildings, Offices, Accom- exceed 15,000l. modations, Furniture and Appurtenances as are by this Act directed, fhall not in the whole exceed the Sum of Fifteen thousand Pounds: Provided always, that it fhall be lawful for the faid Juftices fo affem- Expences of bled as aforefaid, to raise any further Sum or Sums of Money over Act. and above the faid Sum of Fifteen thoufand Pounds, which shall be found wanting to discharge and pay all the Cofts, Charges and Expences incident to and attending the obtaining and paffing of this Act, together with lawful Intereft for any Money which may be lent or advanced by any Perfon or Perfons for that Purpose.

VI. And be it further enacted, That it fhall be lawful for the faid Juftices enabled Juftices fo affembled as aforefaid, or the major Part of them, and to purchase they are hereby authorized and empowered from time to time to treat, Lands for Purcontract and agree with the Owners of, and Perfons interested in, pofes of Act. any Houfes, Buildings, Lands or Hereditaments which they fhall judge to be proper or neceffary for the Purposes of this Act, for the Purchase thereof, and by and out of the said Public Stock and County Rates of the faid County, to pay, or cause to be paid, for the Purchase of fuch Houses, Buildings, Lands or Hereditaments, fuch Sum or Sums of Money as fhall be agreed upon between fuch Owners and Perfons interefted as aforefaid and the faid Juftices; and alfo the Cofts and Charges attending fuch Agreement and Purchase as aforefaid; and upon Payment of the Money agreed to be paid for the Purchase of any fuch Houfes, Buildings, Lands or Hereditaments as aforefaid, it shall be lawful for the faid Juftices of the Peace, or any Two or more of them, their Surveyors, Workmen or Agents, at any time thereafter, to enter upon and take Poffeffion of the faid Houfes, Buildings, Lands or Hereditaments, and the fame fhall be conveyed to the Clerk of the Peace for the said County of Warwick for the Purposes of this A&t.

VII. And be it further enacted, That it fhall be lawful for all Bodies Politic, Bodies Politic, Corporate or Collegiate, Corporations Aggregate or &c. enabled to 54 GEO. III.

Sole, fell,

Sole, and all Hufbands, Trustees or Feoffees in Truft, Executors, Adminiftrators, Guardians, Committees, and all other Trustees whomfoever, not only for and on Behalf of themselves, their Heirs and Succeffors, but also for and on Behalf of their Ceftuique Trufts, whether Infants, Iffue unborn, Femes Covert, Lunatics, Idiots, or other Perfon or Perfons whomfoever, and to and for all Femes Covert who are or fhall be feised, poffeffed of or interested in their own Right, and to and for all and every Perfon or Persons whomsoever, who are or fhall be feifed, poffeffed of or interested in any of such Houfes, Buildings, Lands or Hereditaments, to treat, contract and agree with the faid Juftices, or the major Part of them, so affembled as aforefaid, for the Sale of fuch Houfes, Buildings, Lands or Hereditaments, and of all their Interest therein or in any Part thereof, and to convey the fame to fuch Perfon or Perfons for the Purposes of this A&t, and in fuch manner as they the said Juftices, or the major Part of them, fo affembled as aforefaid, fhall direct, and as Occafion shall Contracts valid. require; and all Contracts, Sales and Conveyances which shall be fo made, fhall be valid to all Intents and Purposes; any Law, Statute, Ufage or other Matter to the contrary in any wife notwithstanding; and all and every fuch Bodies Politic, Corporate or Collegiate, Corporations Aggregate or Sole, Hufbands, Truftees, Feoffees, Executors, Adminiftrators, Guardians, Committees, and all other Perfons, fhall be, and are hereby indemnified for what they shall do by virtue of this A&t.

VIII. And be it further enacted, That if any Money shall be agreed to be paid for the Purchase of any Houfes, Buildings, Lands, Tenements or Hereditaments, purchased by virtue of the Powers of this Act for the Purposes thereof, which fhall belong to any Body Politic, Corporate or Collegiate, or to any Feoffee in Truft, Execu tor, Adminiftrator, Hufband, Guardian, Committee or other Trustee, or for or on Behalf of any Infant, Lunatic, Idiot, Femes Covert or other Ceftuique Truft, or to any Perfon or Perfons whose Houses, Buildings, Lands, Tenements or Hereditaments are limited in ftrict and other Settlements, or to any Perfon or Perfons under any other Difability or Incapacity whatfoever, fuch Money fhall, in cafe the fame fhall amount to or exceed the Sum of Two hundred Pounds, with all convenient Speed be paid into the Bank of England, in the Name and with the Privity of the Accountant General of the High Court of Chancery, to be placed to his Account ex parte the Juftices of the Peace for the County of Warwick, to the Întent that fuch Money shall be applied under the Direction and with the Approbation of the faid Court, to be fignified by an Order made upon a Petition to be preferred in a fummary way by the Perfon or Perfons who would have been entitled to the Rents and Profits of the said Houfes, Buildings, Lands, Tenements or Hereditaments, in the Purchafe of the Land Tax, or towards the Discharge of any Debt or Debts, or fuch other Incumbrances, or Part thereof, as the faid Court fhall authorize to be paid, affecting the fame Houses, Buildings, Lands, Tenements or Hereditaments, or affecting any other Houfes, Buildings, Lands, Tenements or Hereditaments, ftanding fettled therewith to the fame or the like Uses, Trufts, Intents or Purposes; or where fuch Money fhall not be fo applied, then the fame fhall be laid out and invefted, under the like Direction and Approbation of the faid Court, in the Purchase of other Houfes, Build
