CHAPTER 402.

AN ACT to amend an act, entitled "An act to authorize the Fayette cou:.ty court to issue the bonds of said county, the proceeds to be used for the purchase of lands or the erection of buildings for the use of the Agricultural and Mechanical College of Kentucky," approved January 24, 1880. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That the first section of the act, entitled "An act to First section authorize the Fayette county court to issue the bonds of said county, the proceeds to be used for the purchase of lands or the erection of buildings for the use of the Agricultural and Mechanical College of Kentucky," approved January 24, 1880, be so amended that after the words, to-wit: "that the Fayette county court, at its court of claims, a majority of the justices of said county being present and concurring therein," and before the word "may," the following words shall be inserted, and be a part of said act, to wit: "or a court called by the judge of said county court, to which all the justices of the peace of said county shall be summoned, and a majority of them shall be present and concurring therein."

§ 2. That the bonds issued under the act to which this is an amendment shall bear interest from the date of their issue; and until said bonds are sold, the interest thereon shall be paid annually to the said college, to be used for procuring the temporary use of lands for the use of said college.

§ 3. That this act shall take effect from its passage. Approved March 9, 1880.

AN ACT giving the further time of two years to clerks, ex-clerks, sheriffs, ex-sheriffs, and other collecting officers, in which to collect their fees and uncollected taxes.

iffs, and ex-sheriffs, and other collecting officers of this State, are granted the further time of two years, from and after the passage of this act, to collect their fees and uncollected taxes, with the same powers of distraint as they have by existing laws; and each of them shall be under the same penalties and liabilities as are now imposed by law for the collection of illegal fees and taxes: Provided, That this act shall not apply to any fees that have been due and collectable for over five years: And provided further, That such sheriffs shall have made settlement for all State and county taxes due by them. § 2. This act shall take effect and be in force from and after its passage.

CHAPTER 105.

AN ACT to authorize the late vice chancellor of the Louisville chancery court to sign certain orders and proceedings in said court.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That James Harlan, late vice chancellor of the Louisville chancery court, is empowered and authorized to sign the records of the proceedings or orders in said court, which remained unsigned by him at the time of the expiration of his term of office; and said orders and proceedings shall be held and considered valid and effectual as if the said record and grders had been signed when said Harlan held said office of vice chancellor.

2. This act shall take effect from its passage.

CHAPTER 409.

AN ACT to amend article 4, chapter 28, of General Statutes.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That article four (4) of chapter twenty-eight (28) of General Statute the General Statutes be, and the same is hereby, amended as follows: In actions for the recovery of money or property, when the amount claimed by the plaintiff does not exceed fifty dollars, exclusive of interest, and the defendant or de

fendants are non-residents of Kentucky, and said defendants are the owners of real estate in this Commonwealth, but not of personal estate sufficient to satisfy the demand of the plaintiff, jurisdiction is hereby conferred upon the circuit and equity and criminal courts of the county where such real estate is situate to try such action, as though the amount claimed exceeded fifty dollars; and the plaintiff shall be entitled to sue out all such provisional remedies, and to prosecute bis demand in the same way and under the same rules as now apply to similar actions in said courts, where jurisdiction is now given by law.

§2. This act shall take effect from its passage.

CHAPTER 410.

AN ACT to amend section 1, chapter 34, of the General Statutes, entitled

Elisor."

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

$1. That chapter thirty-four, section one, entitled "Elisor," be amended by inserting after the sentence beginning with the word "power," and ending with the word "court," the words, to-wit: "Also to execute summons, subpœnas, and process in provisional remedies."

CHAPTER 415.

AN ACT to amend section 2 of article 13 of chapter 28 of the General

Statutes.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That section 2 of article 13, chapter 28, of the General Statutes, title "Courts," be, and the same is hereby, so amended as to read as follows: " Quarterly courts shall have jurisdiction concurrent with circuit courts of all actions for the recovery of money or personal property, when the matter in controversy, exclusive of interest and cost, exceeds

fifty dollars and does not exceed two hundred dollars in value."

2. This act shall take effect from and after the first day of May, 1880; and all laws in conflict with this act are hereby repealed.

CHAPTER 431.

AN ACT to amend chapter 94, article 1, section 30, General Statutes, so far as the same applies to the county of Butler.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That chapter 94, article 1, section 30, be, and the same General Statutes, is hereby, so amended that it shall be discretionary with the Court of claims as to what amount, if any, they will allow for wheel carriages, ploughs, draught horses, oxen, gear, and driver to work on roads.

2. The surveyors of roads are hereby authorized to contract with persons for wheel carriages, ploughs, draught horses, oxen, gear, and drivers, hauling and ploughing on roads, and may exempt such persons from work on the road such number of days as he may think reasonable, in consideration of the use of such teams, hauling, ploughing, and other services.

§ 3. That before this act shall take effect, the same shall be To be submitted submitted for approval of the people at the regular August election, 1880; and if a majority of the voters in each county, polled at said election, shall vote in favor of the provisions of this act, then it shall take effect immediately upon ascertaining the favorable result of such vote, in the usual lawful manner of canvassing election returns in said counties.

§ 4. That the county courts shall, at some court held before said August election, 1880, provide for taking the vote as mentioned in section 3 of this act.

5. The provisions of this act shall apply to the county of Butler only.

CHAPTER 436.

AN ACT to amend an act, entitled "An act to empower the counties of this
Commonwealth to take stock in turnpike companies," approved March 9,

1868.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That said act, approved March 9th, 1868, be, and is so Casey county examended, as to exclude Casey county from its provisions.

§ 2. Provided, That nothing in this act shall be construed

to affect subscriptions heretofore legally made.

3. This act shall take effect and be in force from and after

its passage.

CHAPTER 437.

AN ACT to amend section 15, article 2, of chapter 92, of the General Stat

utes.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That section 15 of article 2 of chapter 92 of the Gen. eral Statutes be amended by adding, after the word "estate," chapter 92, page in the thirteenth line of said section, the following: "or any mortgage or conveyances of real or personal property or chattel mortgage."

§2. This act shall take effect from its passage.

CHAPTER 440.

AN ACT to amend section 9, article 35, chapter 29, General Statutes. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That section 9 of article 35 of chapter 29 of the Gen eral Statutes be amended by inserting after the word "give," in said section, the following words: "procure for or fur. nish."

2. This act shall take effect from its passage.
