§3. That, until otherwise provided by law, the Commissioners of the Sinking Fund shall, so far as slack-water navigation on said river is concerned, and the preservation, in good repair, of the locks and dams on said rivers, and the appurtenances thereunto belonging, do and perform the duties which devolved by law upon the Board of Internal Improvement, during the existence of said Board, except as herein. otherwise provided.

§ 4. Said Commissioners shall appoint a suitable person to Superintendent take charge of said line of navigation as superintendent, who shall hold his office during the pleasure of said Commissioners; shall possess a thorough knowledge of civil engineering; and Oath and bond. who, before entering upon the duties of his office, shall take an oath to faithfully perform the duties thereof; and shall execute a bond to the Commonwealth of Kentucky in the penal sum of five thousand dollars, conditioned upon a faithful and honest discharge of his official duties, and prompt and full accountability for the moneys received and disbursed by him, with surety, to be approved by the Governor, and attested; which bond shall be filed in the office of the Secretary of State; and for any failure on the part of such superintendent to report and pay over promptly the money collected by him for toll or lockage, at the time and to the persons hereinafter specified, or for other misfeasance or malfeasance in office, suit may be instituted in the Franklin circuit court in the name of the Commonwealth.

§ 6. 7. 9. The superintendent shall receive an annual salary of Salan of Super$2,000, to be paid in equal monthly installments, out of the Green and Barren River Navigation Fund. He shall keep an office at Bowling Green or Rockport; and it shall be his duty, on or before the fifth of each month, to make out, certify, and forward to the Commissioners of the Sinking Fund, to be submitted like other accounts to the Governor for payment, a pay-roll for himself and employes, which roll shall To make out pay have the names of all employes required under this act to be employed on said line, the number of days each one shall have worked the preceding month, the rate of wages and kind of labor performed by each, and the whole added together. § 10. The superintendent shall also make out and forward to the Commissioners annually, on the 10th of January, a report upon the general condition of the navigation, its operations during the past year, the work done upon it, and at what localities, in repairs and improvements, and any sugges tions that may seem pertinent or necessary concerning its future requirements and management. This report shall be accompanied by an abstract according to prescribed forms, and certified by the superintendent, of the receipts and expenditures during the year preceding the 1st of January, and by tabular statements setting forth the number of boats, loaded and empty; the quantity of each article, and the number of passengers passed through the locks, and the amounts

received for toll on the various articles and under the various heads, which report and statements shall be printed for the information of the Legislature and the public; forwarded by express on every regular packet or express day to the superintendent, unless otherwise ordered by him, all moneys so collected, together with a detailed statement, according to prescribed forms, of the sources from which received out of the articles on which collected.

§ 11. This act shall take effect from its passage.

CHAPTER 780.

AN ACT to change the time of holding the Henderson county court. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

CHAPTER 814.

AN ACT to appropriate money to repair and preserve the Henry Clay
Monument, at Lexington.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. CHAPTER 849.

AN ACT to regulate and fix the pay of the elective and appointed officers of
Senate and House of Representatives not now provided for by law.
Be it enacted by the General Assembly of the Commonwealth
of Kentucky:

§1 That the officers hereinafter named shall respectively receive as compensation for their services a per diem as follows: The Principal Clerks of the Senate and House of Representatives, eight dollars per day each during the ses sion and ten days after the adjournment of the General Assembly, for preparing Acts for publication; the First Aseistant Clerks of the Senate and House of Representatives, eight dollars each per day during the session and ten days after adjournment of the General Assembly, for preparing Acts for publication; the Enrolling Clerks of the Senate and House of Representatives, five dollars each per day; the Sergeantsat-Arms of the Senate and House of Representatives, five dollars each per day; the Keepers of the Cloak-rooms of the Senate and House of Representatives, two dollars each per day; the Janitors of the Senate and House of Representatives, two dollars each per day; the Pages of the Senate and House of Representatives shall have two dollars per day.

2. This act shall take effect ten days after the expiration of the present session of this General Assembly: Provided, That there shall not be more than three Pages for the use of the Senate and four for the use of the House of Representatives.

CHAPTER 877.

AN ACT authorizing the Commissioners of the Sinking Fund to direct the Auditor of Public Accounts to transfer to the Revenue Proper the surplus in the Sinking Fund.

WHEREAS, The outstanding bonded indebtedness of the Preamble. State, in gross, amounts to $180,394; and whereas, $6,394 of this is past due and unpresented, and the bonds probably accidentally destroyed or lost, leaving bonds not yet due, and for which a permanent sinking fund is needed, amounting to $174,000; and whereas, the amount of cash on hand in the Sinking Fund amounts to $235,671 72, as shown by the Aud
