CHAPTER 329.

AN ACT to authorize the county court to supply certain records of the county court of Ballard county destroyed by fire, and for other purposes. WHEREAS, On the night of the 17th of February, 1880, the court-house in Ballard county was consumed by fire, including all the records of the county court for said county; now, therefore,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall be the duty of the county judge of Ballard county, and he is hereby directed, by an order of said court to re-establish the public roads of said county, and to appoint surveyors thereof.

§ 2. And said county court is hereby directed to require of all the public officers of said county, who are required by law, upon entering upon the duties of their respective offices, to execute bond, to appear in the said court at such time or times as the court may order, and execute new bonds, and when said bonds required herein are executed, they shall be as binding and obligatory for any purpose as if they had been executed at the time and in the manner now required by law. 3. This act shall take effect from and after its passage. Approved February 28, 1880.

CHAPTER 330.

AN ACT to provide a law library for the clerks' offices in Ballard county. WHEREAS, On the night of the 17th of February, 1880, the court-house in Ballard county was entirely consumed by fire, including the law library in each of the said offices; and now, in order to supply same,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That the Secretary of State is hereby directed to furnish the offices of the clerks of the Ballard county and circuit courts a full and complete set of the Reports of the Decisions of the Court of Appeals of Kentucky, the General Statutes, and Codes of Practice, at the expense of the State.

§ 2. This act shall take effect from its passage.

CHAPTER 331.

AN ACT to allow the heirs of J. B. Dupriest to redeem their land sold for taxes to the State.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That Amanda Dupriest and others, heirs of J. B. Dupriest, or any person for them, be, and they are hereby, permitted to redeem their tract of land lying in Marshall county, which was sold by the sheriff for taxes for the year 1875 or 1876, and bought by the State of Kentucky, upon their paying into the Treasury of the State the taxes for which it was sold, with costs and interest at six per cent.

§ 2. That the Auditor of Public Accounts, upon the presentation of the receipt of the Treasurer for said taxes, interest, and costs, do release, in writing, to said heirs the said land, and all the interest the State acquired therein by reason of said sale and purchase for taxes, and that said release may be recorded in the county court clerk's office of said county. §3. This act shall take effect from its passage.

CHAPTER 332.

AN ACT for the benefit of Thomas Jones, ex-sheriff of Campbell county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor of the State is hereby authorized to draw his warrant on the Treasury in favor of Thomas Jones, ex-sheriff of Campbell county, for eighty-seven dollars and thirty cents, payable out of any money not otherwise appro. priated.

§2. This act shall take effect from its passage.

CHAPTER 333.

AN ACT releasing sureties of M. C. Rowland, late sheriff of Marshall county from further liability on a judgment in the Franklin circuit court. WHEREAS, All the property, both real and personal, which was subject to execution of B. F. Moran, C. York, E. Cox, and LOC. L., VOL. I-19

J. M. Mooney, has been sold to satisfy a judgment recovered against them as sureties upon the revenue bond of M. C. Rowland, late sheriff of Marshall county, by the Commonwealth of Kentucky, at the June term, 1877, of the Franklin circuit court, for the sum of five thousand six hundred and fifty-three dollars and twenty-eight cents, with costs and interest and Attorney General's fee of two per cent., leaving a large balance of the judgment unsatisfied; and whereas, at said sales, made for cash in hand, the State of Kentucky bid for, and became the owner of, about acres of the lands of said sureties, including their homes, and leaving said sureties, who are all old men, with families to support, without even a homestead; therefore,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That said B. F. Moran, C. York, E. Cox, and J. M. Mooney be, and they are hereby, released from any further liability on said judgment so recovered against them in the Franklin circuit court, as sureties of said sheriff.

82. This act shall take effect from and after its passage. Approved February 28, 1880.

CHAPTER 334.

AN ACT for the benefit of R. M. Kenney, late sheriff of Bourbon county. WHEREAS, R. M. Kenney, late sheriff of Bourbon county, Kentucky, did pay into the public Treasury the State revenne in full for Bourbon county for the year 1876; and whereas, there was in said county for said year delinquents whose tax could not be collected, but which was paid into the public Treasury to the amount of one hundred and eighty-seven dollars and twenty-five cents; now, therefore, said R. M. Kenney having presented proper proof that said taxes were not collected by him, and for his just and proper relief,

Be it enacted by the General Assembly of the Commonwealth 1.1 Kentucky:

§ 1. That the Auditor of Public Accounts be, and he is hereby, directed to draw his warrant on the State Treasurer in favor of R. M. Kenney, for one hundred and eighty-seven dollars and twenty-five cents ($187 25), the amount due said

Kenney, payable out of any money in the Treasury to the credit of the colored school fund not otherwise appropriated. § 2. This act shall take effect from its passage.

CHAPTER 335.

AN ACT to incorporate Calvert City Lodge, No. 265, I. O. 0. F., of Calvert City, Kentucky.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the noble grand, vice grand, secretary, and treasurer of Calvert City Lodge, No. 265, Independent Order of Odd Fellows, and their successors in office, be, and they are hereby, created a body-politic and corporate, by the name of Calvert City Lodge, No. 265, of the Independent Order of Odd Fellows; and that they and their associates and successors shall so continue, and shall have perpetual succession; and in that name are made capable in law as natural persons to sue and be sued, plead and be impleaded, contract and be contracted with; and shall have the right to sue and be sued in all the courts of law and equity in this Commonwealth; to make and use a common seal, and the same to break, alter, and renew at pleasure. Said corporation may make regulations and by-laws for their government, and may alter, renew, and amend the same at pleasure: Provided, The same are not contrary to the laws of the United States or this State, and not inconsistent with the constitution, laws, and regulations of the Grand Lodge of the Independent Order of Odd Fellows, incorporated by an act approved February 16, 1838. The said corporation shall have power to acquire, by gift, purchase, or donation, real and personal estate, not exceeding twenty thousand dollars in value, and to sell and convey by order of said lodge, in such manner as may be directed by order entered upon the books of said lodge, or any part of the same, and may reinvest the proceeds as the lodge by order may direct.

§ 2. This act shall take effect and be in force from and after its passage.

CHAPTER 336.

AN ACT to prohibit the sale or giving away of intoxicating liquors at or within two miles of Auburn High School, at Auburn, Logan county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That hereafter it shall be unlawful for any one to sell or loan or give away any vinous, spirituous, or malt liquors, or any intoxicating drinks, at or within two miles of Auburn High School, at Auburn, Logan county.

2. That any person violating the provision of this act, shall be fined for each offense not less than ten nor more than twenty-five dollars, or imprisoned in the county jail for not less than ten nor more than twenty days, or both so fined and imprisoned, at the discretion of a jury.

3. That this act shall not be construed to apply to regular physicians, who keep and administer it as such for real sickness, nor to persons having license to sell liquor at said town of Auburn, until the expiration of such license.

4. That the police judge of said town, and justices of the peace of the Auburn district, shall have jurisdiction to try offenses committed under the provisions of this act, and to render such orders and judgments as may be necessary to carry out the verdicts that may be rendered by juries sitting in the trial of offenses under the same.

5. This act shall take effect from its passage.

CHAPTER 337.

AN ACT to ascertain and mark the boundary lines between the counties of

Larue, Green, and Taylor.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That the presiding judge of the Larue, the presiding judge of the Green, and the presiding judge of the Taylor county courts, shall, on or before the August term, 1880, of said courts, appoint from citizens of their respective counties three discreet men, householders, that is, three citizens of Larue county by the said judge of the Larue county court, three citizens of Green county by the said judge of the Green county court, and three citizens of Taylor anty by the said judge of the Taylor county court, which nine per
