CHAPTER 363.

AN ACT to amend the charter of the German Security Bank.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the act incorporating the Security Bank, approved March 9, 1867, and the act amendatory thereto, changing the name of said bank to the German Security Bank, approved December 26, 1867, be, and the same are hereby, amended so that the limitation of the corporate functions and franchises of said bank be, and the same are hereby, extended to the period of fifty-one years from the organization of said bank, instead of twenty-one years, as provided in the seventh section of the original act incorporating said bank. § 2. This act shall take effect from its passage.

CHAPTER 364.

AN ACT to amend an act, entitled "An act to amend an act, entitled 'An act to incorporate the Chattaroi Railway Company,'" approved March 23, 1863.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act to amend an act, entitled 'An act to incorporate the Chattaroi Railway Company,' approved March 23, 1878, be, and the same is hereby, so amended as to allow, authorize, and permit the said Chattaroi Railway Company to erect, construct, and maintain a railway bridge or bridges across the Big Sandy or Tug rivers, according to the provisions contained in the charter of said railway company.

§ 2. This act to take effect from its passage.

CHAPTER 365.

AN ACT for the benefit of common school district No. 14, Oldham county. WHEREAS, The trustees of school district No. 14, in Oldham county, did employ a competent teacher to teach their public school for the present year; and as it was the desire

of the patrons of said school that the trustees should employ a teacher competent to teach more than the elementary branches, they did procure a teacher of collegiate attainments, who is teaching a school acceptable to said district; but by an oversight of trustees and teacher, he did not apply for a certificate so as to enable him to draw the money due him from the public school fund; now,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the common school commissioner for Oldham county be, and he is hereby, authorized to pay said teacher for district No. 14 the amount of public money due said d ́strict, as other teachers are paid for the present school year. § 2. This act shall take effect and be in force from its passage.

CHAPTER 366.

AN ACT to amend the charter of the town of Lewisburg, in Logan county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the said act, entitled "An act to incorporate the town of Lewisburg," approved April 9th, 1878, be so amended as to include within its limits the following boundary, viz: Beginning at the junction of the Hopkinsville and Morgantown with the Russellville and Greenville road, running thence on a straight line from said junction to a tenant house belonging to Dr. L. G. Richardson, now occupied by Jas. Barrett, including the same; thence on a straight line to Alum Lick creek, at a point opposite A. J. Patton's residence; thence down said creek to a point in range with R. G. Hardison's east and west line; thence to said Hardison's line, and in the same course to the Greenville road; thence with the Greenville road to the beginning; and the same is hereby incorporated, so as to extend the limits of said town of Lewisburg accordingly.

2. The same number of trustees and other officers provided for in the said act of incorporation, with the same qualifications, and possessed of the same powers and duties, and under the same rules and responsibilities, shall be elected by

the same voters, at the same times and places, to be qualified in the same manner before the same officers, to remain in their respective offices and positions for the same length of time and under the same regulations as provided in and by the said original act of incorporation.

§ 3. This act shall take effect from its passage.

CHAPTER 367.

AN ACT to prevent the deadening of timber near any of the public highways in Henderson county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That hereafter it shall be unlawful for any person to deaden timber, or allow timber to be deadened, upon his land, within one hundred and twenty feet of any of the public highways of Henderson county; and for the violation of this act, the person so offending shall be fined not less than five nor more than twenty dollars for each offense, recoverable by warrant before a magistrate or judge of the county court of said county.

§ 2. It shall be the duty of the superintendent of roads in said county to prosecute all offenders under this act: Provided, The provisions of this act shall not be enforced until so ordered by the county court of Henderson county. 3. This act to take effect from May 1st, 1880.

CHAPTER 368.

AN ACT to incorporate the Citizens' Bank of Midway.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That a bank is hereby established in the town of Midway, Kentucky, by the name and style of Citizens' Bank of Midway; and by that name is incorporated; and shall be capable of contracting and being contracted with, of suing and being sued, of impleading and being impleaded, of answering and defending, in all courts and places whatever; it may have a common seal, and change or alter the same at pleasure.

§ 2. The stock in said bank shall be deemed personal property, and shall be assignable according to such rules as the board of directors shall, from time to time, establish.

§3. That Geo. T. Hord, John A. Steele, and E. K. Thornton may, at such time or place as suits their convenience, open books for the subscription of stock, which shall be in shares of one hundred dollars each; and when one hundred shares are subscribed and paid for, the stockholders shall meet and organize said bank by choosing a president, directors, and other officers, whose compensation and salary shall be fixed, and bond and security may be required for the faithful performance of their duties.

§ 4. The capital stock of said bank shall not be less than ten thousand dollars, which may be increased to fifty thousand dollars.

§ 5. Said bank may receive deposits of gold and silver, bank notes, and other notes which may be lawfully circulated as money, and repay the same in such manner, and at such time, as may be agreed upon with depositors by special or general contract; and may deal in loaning of money, exchange, promissory notes, and other evidences of debt, take personal or other security and real estate for the payment thereof, and dispose of same as authorized by an act, entitled "An act for the benefit of the incorporated banks of Kentucky," approved March 16th, 1871; and the promissory notes or bills made negotiable and payable at its bank, or any other bank which may be discounted by said bank, and inland bills of exchange which may be discounted by it, shall be, and they are hereby, put upon the footing of foreign bills. of exchange; and like remedies may be had thereon, jointly and severally, against the drawers and indorsers.

6. The said corporation may acquire, hold, possess, use, enjoy, and occupy all such real estate, goods and chattels, as may be convenient for the transaction of its business, or which may be conveyed to it as surety for any debt, or purchased in satisfaction of any debt, judgment, or decree, and sell and convey the same; and they may make all needful by-laws for the government of said bank, not inconsistent with the Constitution and laws of the United States or the State of Kentucky.

§ 7. It shall not be lawful for said bank to issue any note or bill to be passed or used as currency.

§ 8. This act shall take effect from its passage: Provided, Said bank is organized under it within one year from the date hereof.

§ 9. The Legislature reserves the right to alter, amend, or repeal this act at pleasure.

CHAPTER 369.

AN ACT to incorporate the Bradford and Lenoxburg Turnpike Company,
Bracken county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That L. J. Bradford, David G. Thomas, J. Smith Riley, A. J. Bradford, Henry Flowers, W. H. Wilson, John Myers, and their associates and successors, be, and they are hereby, created a body-politic and corporate, under the name and style of the Bradford and Lenoxburg Turnpike Company, for the purpose of constructing a turnpike road from the town of Bradford, on the Ohio river, to Lenoxburg, in Bracken county; and by the said name and style shall have power to contract and be contracted with, sue and be sued, answer and be answered, plead and be impleaded, in all courts and places in this Commonwealth.

2. The capital stock of said company shall be fifteen thousand dollars, in shares of fifty dollars each.

§ 3. That books shall be opened for subscription to the Commissioners. stock of said corporation by the above named incorporators, or as many as will act, who are hereby appointed commissioners for that purpose, at such times and places as they or a majority may designate. The commissioners shall insert in the subscription books an obligation to this effect, namely: We, whose names are hereunto subscribed, severally promise to pay to the president and directors of the Bradford and Lenoxburg Turnpike Company, the sum of fifty dollars for each and every share of stock in said company set opposite our respective names, in such manner and proportions, and at such times, as shall be by the said president and directors deemed best.

4. That whenever the commissioners, or a majority of them who may act, shall be satisfied that a sufficiency of stock is subscribed, or have reasonable grounds to believe
