3. That the fines under this act shall be paid into the county treasury, and shall be appropriated by the county court in removing obstructions from and cleaning out said creeks.

§ 4. That this act shall take effect from the first day of May, 1880.

CHAPTER 416.

AN ACT repealing an act, entitled "An act for the benefit of 0. Ross Baker, former sheriff of Caldwell county," approved January 29, 1880. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act for the benefit of 0. Ross Baker, former sheriff of Caldwell county," approved January 29, 1880, be, and the same is hereby, repealed. § 2. This act shall take effect from and after its passage. Approved March 10, 1880.

CHAPTER 417.

AN ACT for the benefit of Thomas Gray, sheriff of Owen county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor of Public Accounts be authorized and directed to draw his warrant upon the Treasurer in favor of Thomas Gray, sheriff of Owen county, for the sum of fifty dollars, for extra services in the trial of Thomas Buford, on the charge of murder, at the special July term, 1879, of the Owen criminal court.

§ 2. This act shall take effect from and after its passage. Approved March 10, 1880.

CHAPTER 418.

AN ACT to repeal so much of an act, approved March 5, 1850, as extends jurisdiction of police judge of Harrodsburg in civil cases over the county of Mercer.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That so much of section 11, chapter 398, of an act ap

proved March 5, 1850, extending the jurisdiction of police judge of the town of Harrodsburg in civil cases over the county of Mercer, be, and the same is hereby, repealed. §2. This act shall take effect from and after the first day of April, 1880.

CHAPTER 419.

AN ACT for the benefit of Wm. H. Albright, sheriff of Rockcastle county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That Wm. H. Albright, sheriff of Rockcastle county, is hereby granted until the first day of June, 1880, to pay into the Treasury of the State the revenue of Rockcastle county for the year 1879: Provided, however, That the sureties on his revenue bond shall, on or before the first of April, 1880, appear in open court and consent to this extension, by writing on the record.

§ 2. This act to take effect from its passage.

CHAPTER 420.

AN ACT to empower the Gallatin county court to take stock in turnpike roads in said county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the sheriff of Gallatin county shall, on the first Monday of April, 1880, open a poll at the several voting places in said county, and take the sense of the qualified voters thereof as to the propriety of the Gallatin county court subscribing seven hundred and fifty dollars to each mile of turnpike road hereafter built in said county by any company now or hereafter incorporated under the laws of this State; said eleetion to be conducted and held, return thereof made to, and the result declared by, the same officers, under the same pains and penalties as now provided by law.

§ 2. If, upon due return and comparison of the polls of said election, it shall appear that a majority of those voting are in favor of said county court making the subscription as

aforesaid, then it shall be the duty of the Gallatin county court, a majority of the justices of the peace in said county being present, to subscribe seven hundred and fifty dollars per mile to the capital stock of each and every turnpike company now or hereafter organized in said county as aforesaid. But no bonds of said county shall be issued, nor shall any part of said subscription be paid over, to such company, except as each mile of turnpike road is completed: And provided further, That the first mile of turnpike built by any company in said county shall be built on that part of the route selected by such company which will require the greatest expense and outlay to complete.

3. Said county court, a majority of the justices of the peace aforesaid concurring, shall have power to issue bonds, in such denominations and form as said court may by its orders direct, bearing interest at a rate not exceeding six per cent. per annum, and to run twenty years or less, at the court's option; and to levy a tax upon all property in said county subject to taxation for revenue purposes, to pay said bonds, principal and interest: Provided, That said levy shall not, in any one year, exceed an amount more than sufficient to pay the interest on such bonds as may be issued, as herein authorized, until after the payment of the present county debt; after which time, said county court shall levy an annual ad valorem tax, of not exceeding twenty-five cents on the hundred dollars, until said bonds are paid off and discharged.

4. The taxes levied under this act shall be collected by the sheriff or collector of said county, who shall, for that purpose, have all the powers, and be subject to the same penalties, as is now provided by law in the collection of county levies.

$5. It shall be the duty of the judge of the Gallatin county court to convene the justices of the peace of said county at the court-house in Warsaw, within forty days after the ratification of this act by the voters aforesaid, or by the voters of any precinct of said county, for the purpose of subscribing to the capital stock of such turnpike companies as may be organized and ready to begin the construction of a road; and said judge shall have power to enforce the attendance of said justices by attachment and fine, as for contempt of court.

§ 6. If a majority of the votes cast at said election, in the entire county, is against the ratification of this act, then the

same shall only be the law in such precincts as shall show a majority of the voters therein at said election to be in favor thereof; and in that event the taxes aforesaid shall only be levied and expended in such precincts as shall cast a majority of votes of said election for the ratification of this act.

§ 7. The sheriff shall cause two hundred copies hereof to be printed, posted, and circulated in said county immediately preceding said election.

8. In such precincts as ratify this act at said election, an act, entitled "An act providing a road law for Gallatin county," approved February 1st, 1878, shall, and the same is hereby, repealed.

9. This act shall take effect from its passage.

CHAPTER 421.

AN ACT to authorize the Pulaski county court to issue bonds to redeem the present court-house bonds of said county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Pulaski county court, a majority of the justices being present and concurring, may cause the bonds of the county, not to exceed in the aggregate the sum of twentyone thousand dollars, of such denominations as the court may choose, not less than one hundred dollars each, to be executed (in printed form), under the seal of the county court, signed by the presiding judge of the court, and countersigned by its clerk, payable when and where the court may elect, with annual or semi-annual interest coupons, at a rate not exceeding five per cent. per annum; and each coupon thereunto attached shall be signed by the clerk of the county court aforesaid.

§ 2. The proceeds of all sales of the bonds herein authorized to be issued, shall be used for the sole purpose of paying off and redeeming what is known as the present outstanding seven per cent. Pulaski county court-house bonds, issued and sold by virtue of an act of the General Assembly of the Commonwealth of Kentucky, approved January 19, 1878.

§ 3. The county court shall have full power and authority to negotiate the sale of the bonds herein provided for, and the LOC. L., VOL. 1-26

redemption and cancellation of the present court-house bonds, through a committee or agents appointed by it.

4. To raise money to pay off the bonds provided for in this act, the county court of said county, sitting as a court of claims, are hereby authorized to levy an ad valorem tax, not to exceed twenty cents on each one hundred dollars, on all property subject to State or county taxation, for each and every year such tax may be necessary.

5. That the sheriff or collector of taxes of the said Pulaski county, and their sureties, shall be responsible on their bonds. for the collection of taxes herein authorized, in the manner they are responsible for the ordinary county levy; shall have and exercise the same power and authority in the collection thereof as are conferred for collecting the State and county taxes, and shall, under the same penalties, pay over to whom the said court shall appoint as receiver, and at such times as the court may require, all moneys collected under this act.

6. That the court shall designate the county treasurer, or if there be no such officer, a special treasurer, to receive the funds raised as herein provided, and pay out the same as the court may direct; and such treasurer shall, before receiving any of said money, execute bond, with good and sufficient sureties, to be approved by said court, for the faithful performance of his duties.

§ 7. That each act of the county court herein authorized shall be done by an order entered on its records, a majority of all the justices being present and concurring.

8. All laws in conflict with this act be, and the same are hereby, repealed.

§ 9. This act shall take effect from its passage.

CHAPTER 422.

AN ACT to empower the Lewis county court of claims to regulate the levying and collecting the county levy, and to levy and collect an ad valorem tax for the payment of county expenses and claims.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:
