shall be given by advertisement posted up in at least three
of the most conspicuous places in the town of McKinney.

§ 12. That the police judge shall issue his processes in the
Power of police name of the Commonwealth as other warrants and processes,

and make them returnable before him as police judge of Mc-
Kinney; the same shall be directed to the marshal or any con-
stable or sheriff of Lincoln county, and shall be executed and
returned by the marshal or constable or sheriff, as the case
may be, under the same penalties as other processes, as the
county judges: Provided, however, That when any prosecution
is instituted and carried on at the instance of the board of
trustees, the warrant or process shall state that it is issued at
their instance, in which case they shall be entitled to the fine
or penalty recovered.

13. That the police judge of the town of McKinney shall have full power and authority to require bail and receive the acknowledgment and execution of recognizances of bail in all cases originating before him in which bail is or may hereafter be authorized or required by the law of the land; and such recognizances shall be taken in such form, and be returned in such manner, as is or may be prescribed by the several laws authorizing or requiring bail. He shall be a conservator of the peace, and have jurisdiction over affrays, assaults and batteries, riots, breaches of the peace, all cases of indecent or immoral behavior or conduct calculated to disturb the peace and dignity of said town; over all cases of drunkenness, profane swearing, running horses, firing guns or pistols, and all other riotous conduct whatever, within said town, all of which are hereby declared demeanors. He shall have jurisdiction of all offenses or causes arising out of the by-laws and ordinances passed by the board of trustees, concurrent with the jurisdiction of the county judge, for the enforcement of the powers granted the said town trustees by law. He shall have power to order the marshal to summons a jury, in any case cognizable before him, when a jury would be required before the circuit court or a justice of the peace; and in all cases when the amount of the fine is not or may not be fixed by law, the same be ascertained by the verdict of a jury. He shall have power to issue summons for witnesses in cases pending before him, and upon their failure to attend, may award compulsory process to compel their attendance. He shall keep a record of his proceedings, a copy of

which shall be evidence in all courts of justice, and have the same effect as records of county judges. All trials before the police judge shall be held in the town of McKinney.

§14. That the board of trustees shall appoint annually, Assessorfrom among their citizens of said town, an assessor, who shall, before he enters upon the duties of his office, take an oath duly and impartially to discharge the duties thereof. It shall be the duty of the assessor to call upon all the taxable persons in said town, and make out a true list of their taxable property, with the value thereof, which shall be made upon the oath of the party, to be administered by the assessor. The list shall be taken so as to include all the real estate in said town, and all the male citizens over twenty-one years, with all other species of personal property, money, &c. If person or persons shall refuse to give in a list of his or her property, or be absent, the assessor shall make out a list from the best information he can get. He shali, on or before the first day of January in each year, annually, complete and return the list so taken to the board of trustees. Said assessment to be placed in the hands of the marshal for collection. The trustees shall have a lien on all personal and real estate in said town until all the taxes due by the owners thereof are paid.

§ 15. That all citizens living in said town, who are qualified to vote under the Constitution and laws of Kentucky, and who have paid their poll-tax for the preceding year, and all arrearages and taxes due said town by them, shall be entitled to a vote, but free-holders only allowed to hold the office of a trustee. Said trustees shall choose a treasurer of the citizens of said town, who shall take into possession all the finance of the town, and who shall make no expenditures only at the instance of the trustees. He shall give bond upon oath properly administered in a sum of not less than two hundred and fitty dollars, conditioned faithfully to discharge the duties of bis office.

§ 16. Said trustees may sue and be sued in their corporate capacity in the name of the trustees of the town of McKinney, and shall have the right to employ counsel, who shall be feed from the revenues of the town.

§ 17. This act shall take effect from and after its passage. Approved March 20, 1880.

CHAPTER 458.

AN ACT to re-enact and amend an act, entitled "An act to authorize the people of Henry county to vote a tax for the purpose of aiding companies in the building of turnpike roads in said county," approved March 9, 1869, and the acts amendatory thereto.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act to authorize the people of Henry county to vote a tax for the purpose of aiding companies in the building of turnpike roads in said county," approved March 9, 1869, with all the amendments thereto, be, and the same is hereby, re-enacted, except as hereafter amended, so as the provisions of the same will apply to and govern districts No. 2 and 3, which districts are described and created in the first section of the act aforesaid. This act is to remain in force in said district No. 2 for three years, and for ten years in said district No. 3.

§ 2. Elections in said districts, under the provisions of this act and the acts to which it is an amendment, shall be held on the first Saturday in May, 1880, in Henry county, and the county judge of Henry county shall make an order directing the same to be held at least thirty (30) days prior to the said election; but no commissioner shall be voted for at said election in either of said districts, but it shall be the duty of the county judge of Henry to appoint one commissioner for each district, should they, or either of them, by vote adopt the laws authorizing the imposition of a tax for turnpike purposes. The commissioner or commissioners so appointed shall be allowed a per diem of two dollars for each day employed in the actual discharge of duty as commissioners.

§ 3. The county surveyor of Henry county shall discharge the duties of surveyor in and for said districts, and shall be allowed three dollars per day for services actually rendered, and he shall be governed in his duties by the act and amendments thereto to which this is an amendment.

§ 4. If by the votes of said districts, or either of them, at said election to be held therein, they adopt the provisions of the said act, and the amendments thereto to which this is an amendment, then the county court of Henry county, at its court of levy and claims to be held in 1880, shall levy a tax upon property in said districts, or either of them, for turnpike purposes, and provide for its collection.

§ 5. The sheriff of Henry county shall settle his accounts as collector of said turnpike tax for said districts at the fol lowing times, viz: District number two (2), upon the first Tuesday in April, 1881; district number three (3), second Tuesday in April, 1881, and upon said days annually thereafter.

§ 6. This act shall take effect from its passage.

CHAPTER 459.

AN ACT to amend the charter of the Winchester and Muddy Creek Turnpike Road Company.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That the charter of said turnpike road company be so amended that it will be lawful for said company to place banisters or straight fences on the sides of said road, at all places where there are deep fills, leaving the road between such banisters or straight fences at least sixteen feet in width; and on steep side-cnts, where only one ditch is required, it will be lawful to place banisters or straight fences on the embankment side of the road, provided the road-way on such side cuts remains not less than sixteen feet in width.

§ 2. That it shall be lawful to construct wooden bridges on said turnpike road, at all places where the president and directors may think necessary, provided the same shall not be less than nine feet in the clear or between the streamers.

3. That it shall not be lawful for any person or persons to travel over any of the bridges on said turnpike road on horseback, or with a vehicle of any description, at a speed faster than a walk, under a penalty of a fine of five dollars for each offense. The person or persons so offending may be prose. cuted before any justice of the peace, police or county judge of Clark county.

4. This act shall take effect from and after its passage. Approved March 20, 1880.

CHAPTER 460.

AN ACT to provide for the collection of the State revenue due from Pulaski county for the years 1880 and 1881.

WHEREAS, There is now no sheriff in the county of Pulaski; and whereas, no one will undertake the collection of the State revenue due from said county for the year 1880 for the fees allowed by law; and whereas, Samuel Tate agrees to undertake the collection of said revenue at ten per cent on the whole amount collected and paid into the Treasury by him for said year; therefore,

Be it enacted by the General Assembly of the Commonwealth at Kentucky:

§ 1. That the Auditor of Public Accounts be, and he is hereby, authorized to contract with Samuel Tate for the collection of the State revenue due from said county for the year 1880, at ten per cent.: Provided, That said Tate will properly qualify to perform all the duties sheriffs are required to perform.

§ 2. He is further authorized to contract for the collection of the State revenue which may be due from said county for the year 1881, at any rate not greater than ten per cent., provided no one can be found who will agree to make the collection at the rate allowed by law: Provided, That the collector of the revenue shall also perform all the duties of 'sheriff.

§ 3. This act to take effect from its passage.

CHAPTER 461.

AN ACT to incorporate the Plummer's Landing and Muse's Mills Turnpike Road Company.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That Elijah Petty. M. M. Petty, James Elyott, George Hutton, Andrew Fountain, and J. B. Muse, be, and they are hereby, incorporated as a body-politic and corporate, under the name and style of the Plummer's Landing and Muse's Mills Turnpike Road Company, and are hereby invested with all the powers incident and usual to such corporations, for the purpose of building and making a turnpike road from the neighborhood of Plummer's Landing to Muse's Mills.
