GENERAL ASSEMBLY

OF THE

STATE OF ARKANSAS,

Passed at the Special Session, held at the Capital, in the City of Little Rock, A. D., 1874.

No. I.

AN ACT to Suspend the Sale of Delinquent Eonds, and for other purposes.

Be it enacted by the General Assembly of the State of Arkansas: SECTION 1. That the sale of all delinquent lands, now upon the delinquent lists on file in the several Clerk's offices in this State, for the non-payment of taxes due thereon for the years 1872 and 1873, be, and the same are hereby suspended, until such time as is provided by law for the sale of delinquent lands for the taxes due for the year 1874.

SEC. 2. That at any time before the 20th day of April, 1875, the delinquent taxes may be paid; and all lands forfeited to the State for taxes due thereon, and not sold by the State, may be redeemed by the payment of the taxes assessed against said lands, with the cost of sale, without any penalty.

SEC. 3. That the Auditor shall not offer for sale any delinquent lands, until the time provided by law for advertising and selling delinquent lands in the year 1875.

SEC. 4. That it shall be the duty of the several Clerks of the several Counties of this State, in making up the tax books for the year 1874, to extend against the lands returned delinquent for the taxes of 1872 and 1873, and upon which the taxes and costs have not been paid, the amount of the delinquent taxes and cost of returning and advertising such delinquent lands, if advertised-if not advertised, the cost of returning such delinquent lands without penalty, and the Collectors shall proceed to collect the delinquent tax and costs in the same manner as provided by law for the collection of taxes due for the year 1874; that nothing in the Act shall be construed to prevent the Collectors of the several Counties from receiving the taxes and costs on said delinquent lands at any time the tax book for 1874 shall come to his hands.

SEC. 5. That sections 99, 100, 101, 102, 103, 104, 105, 106, 107 and 108 of the Act of 1873, entitled "An Act regulating the assessment and collection of revenue," approved the 28th day of April, 1873, so far as they may relate to the sale of forfeited lands for non-payment of taxes for the years 1872 and 1873, be, and the same are hereby suspended, until such time as is provided by law for the sale of delinquent lands for taxes for the year 1874.

SEC. 6. That it shall be the duty of the several Clerks of the several Counties, to receipt the owner or owners, agent or agents, when they shall have paid him the full amount of taxes and cost (penalty excepted) against their said lands, in full for said taxes and cost, and said Clerks shall be allowed a fee of twenty-five cents for each receipt so given by him; and further, that the several Collectors of the several Counties, in their annual settlements, to have a credit of all such sums as may be collected and receipted for by the Clerks.

SEC. 7. That all Acts and parts of Acts, conflicting with the provisions of this Act, shall be suspended, and their enforce

ment withheld, until such time as is provided by law for the sale of delinquent lands for the year 1874, and that this Act shall be in force from and after its passage. Approved May 16, 1874.

AN ACT Providing for a Convention of the People of the State of Arkansas to frame a new Constitution.

SECTION

PREAMBLE.

1. A Constitutional Convention called.

2. Delegates; how chosen, and

qualifications.

3. Number of Delegates to which Counties are entitled.

4. When election to be held. 5. How election to be conducted. 6. State Board of Supervisors to be elected by the General Assembly.

7. State Board to appoint Boards of County Election Supervi

SECTION

13. County Boards to return to the State Board names of all persons voted for.

14. When President of Convention may order new election in any county.

15. Adjournment until quorum is present.

16. Oath to be taken by officers and Delegates.

17. Penalties in case of fraud on part of election officers, and of illegal voting.

18. Convention to determine qualifications of its members.

19. Appropriation to pay expenses of Convention.

20. Mode of voting for Convention, and how votes certified and returned; mileage and per diem of Delegates.

21. Governor to issue proclamation for election.

22. Conflicting acts repealed, and this act in force from pas

sage.
