Be it enacted by the General Assembly of the State of Arkansas: SECTION 1. That it shall be unlawful for County Collectors and Treasurers, to purchase, or otherwise [be] the owners of or interested directly or indirectly in, any school warrant issued by any School Trustee, of the county in which they feside.

SEC. 2. That the district school tax in each county may be payable and receivable in the warrants drawn by the Trustees of the school district, in which a school tax may be levied by the County Court.

SEC. 3. That all contracts made by Trustees with teachers shall be executed in triplicate, one of which shall be filed with the County School Superintendent, who shall endorse thereon the date of the filing, and preserve it as a part of his official papers, and the same shall at all times be subject to the inspection of any tax payer.

SEC. 4. That it shall be the duty of the County Treasurer of each County, to keep in his office a suitable and well bound book, in which he shall register by number and in the order of presentation, all district school warrants that may be presented to him; this registration to be made before the warrant is paid, and it shall show the date of the presentation of the warrant, by whom drawn, on what district, and in whose favor, and for what purpose drawn; the amount and date of the warrant, date of payment, and to whom paid; and said book shall at all times be subject to the inspection of any tax

payer.

SEC. 5. That it shall be the duty of the County Treasurers, immediately upon the receipt by them of any school funds, to give notice of the amount and kind of funds received, and from what source received, by written or printed notices put up in two public places in each and every school district and at the courthouse door, and the funds so received shall be paid out pro rata on the warrants registered in accordance with the provisions of the preceding section of the Act, provided that application for such payment is made within thirty days from the giving of the notice herein required.

SEC. 6. That before any further disbursement of the Common School Fund is made by County Treasurers, they shall give notice for at least thirty days to all parties holding district school warrants to come forward and present the same for registration, in accordance with the provisions of this Act; such notice to be given in the manner prescribed in section five of this Act.

SEC. 7. That any officer failing to comply with the requirements of this Act, for each and every offense, shall be subject to indictment, and if found guilty shall be punished by a fine of not less than five hundred dollars, and by confinement in the penitentiary of the State, for a period not less than three nor more than twelve months.

SEC. 8. That any Trustee who shall fraudulently issue any school warrant, shall be guilty of a misdemeanor, and upon conviction shall be subject to the penalties enumerated in section 7 of this Act.

SEC. 9. That this Act shall take effect and be in force from and after its passage, and all Acts and parts of Acts in conflict herewith be, and the same are hereby repealed. Approved May 27, 1874.

No. XV.

AN ACT to Change the Time of Holding the Circuit Courts of this State.

SECTION

1. To be no May term for 1874; pending business to be continued to fall terms; exception made as to 15th Circuit.

2. Conflicting laws repealed.
3. This act in force from passage.

Be it enacted by the General Assembly of the State of Arkansas: SECTION 1. That there shall be no May term, or intermediate term of the Circuit Courts of this State, held for the year 1874, and that all suits, processes and proceedings already

instituted and pending for the terms aforesaid, stand over and be continued until the fall terms of said Courts for said year; Provided, That this Act does not interfere with the holding of the Courts in the Fifteenth (15th) Judicial Circuit for the terms aforesaid.

SEC. 2. That all laws, and parts of laws, in conflict with this Act be, and the same are hereby repealed.

SEC. 3. That this Act take effect and be in force from and after its passage.

Be it enacted by the General Assembly of the State of Arkansas : SECTION 1. That the collector of the revenue of the County of Cross be, and he is hereby, directed and ordered to remit to all persons owning real property in said County, the tax by him collected on the percentage added by the State Board of Equalization to the valuation of such property, as the same was fixed by the Assessor of said County.

SEC. 2. That all Acts and parts of Acts in conflict with this Act be, and the same are hereby, repealed, and that this Act take effect and be in force from and after its passage.

No. XVII.

AN ACT Supplementary to and Amendatory of an Act entitled An Act Providing for a Convention of the People of the State of Arkansas, to frame a New Constitution, May, 1874.

Be it enacted by the General Assembly of the State of Arkansas : SECTION 1. That all Judges of this State are prohibited from issuing any writ of process whatever, or taking any action, or assuming any jurisdiction in or about, or in connection with the election provided for in the Act to which this is supplementary and amendatory, except in so far as may be necessary for the preservation of peace and order, and to secure the holding such election: Provided, however, That the provisions of this section shall not be construed as to amend, or in any wise impair the criminal jurisdiction of Criminal and Circuit Courts, as specified in the Act to which this is supplementary and amendatory.

SEC. 2. In case of a vacancy or vacancies occurring in the Board of State Supervisors provided for in the Act to which this is supplementary and amendatory, the same shall be filled at once by the remaining Supervisor or Supervisors, appointing a person or persons of known intelligence and uprightness to fill such vacancy or vacancies.

SEC. 3. The members of said Board of Supervisors shall receive the same mileage and per diem as is now allowed by law to the members of the General Assembly, to be paid out of any moneys in the treasury of the State not otherwise appropriated.

SEC. 4. That the members of the Board of Supervisors of the several counties shall receive two ($2) dollars each per day

while actually engaged in the duties of their offices, to be paid out of any moneys in the treasuries of their respective counties not otherwise appropriated.

SEC. 5. That all Acts and parts of Acts in conflict with this Act be, and the same are hereby, repealed, and that this Act take effect and be in force from and after its passage. Approved May 28, 1874.

No. XVIII.

AN ACT Defining the Line between the Counties of Pope and Conway.

SECTION

1. Boundary between the two Counties defined.

2. Territory taken from Conway by said line to be attached to Pope County.

SECTION

3. Portion of Act establishing Faulkner County, in conflict with this act, repealed.

sage.

Be it enacted by the General Assembly of the State of Arkansas: SECTION 1. That commencing at the point on the north bank of the Arkansas River, where the line between ranges seventeen and eighteen west crosses the same, thence running directly north on and with said line dividing ranges seventeen and eighteen, to the northern boundary line of the County of Conway to the line dividing townships nine and ten, as at present organized, shall hereafter, and the same is hereby declared to be the dividing line between the said Counties of Pope and Conway

SEC. 2. Be it further enacted, That all the territory thus taken from the County of Conway by the establishment of the line aforesaid, and which territory is lying west of said line, shall hereafter be deemed and become a part of said County of Pope, and the Board of Supervisors of said Pope County, shall for all purposes, taxation and political organization included, exercise like control of the same as is conferred by law in other portions of the said County of Pope to said Board of Supervisors.
