AN ACT to Repeal an Act entitled An Act to Define the Duties of the County Clerk of Pulaski County, Arkansas, and to Authorize the County Clerk of Pulaski County to turn over all Books, Records, etc., Pertaining to the Recorder's Office, to said Circuit Clerk of Pulaski County.

SECTION

1. Former act repealed.

2. County Clerk to turn over books, etc., to Circuit Clerk.

Be it enacted by the General Assembly of the State of Arkansas: SECTION 1. That an act entitled "An Act to define the duties of the County Clerk of Pulaski County, Arkansas," approved April 25, 1873, be, and the same is hereby, repealed.

SEC. 2. That the County Clerk of said County shall, within ten days after the passage of this Act, turn over to the Circuit Clerk of said County all the books, records and other matters appertaining and belonging to the office of Recorder of said County.

SEC. 3. That all Acts and parts of Acts in conflict herewith be, and the same are hereby, repealed, and that this Act be in force from and after its passage.

AN ACT in Reference to the Arkansas Industrial University, the Effects, Officers, and Management thereof.

Be it enacted by the General Assembly of the State of Arkansas : SECTION 1. That all trusteeships, created by or under the provisions of the Act of the General Assembly of this State, entitled "An Act for the location, organization and maintainance of the Arkansas Industrial University, with a Normal Department therein," approved March 27th, 1871, be, and the same are hereby vacated, and all the authority and powers of said University Trustees and Committee-men, appointed or elected by or under them, are revoked.

SEC. 2. Be it further enacted, That section three of said Act be so amended as to read as follows: Until further provided by law the Board of Trustees of said University shall consist of Dudley E. Jones, L. Gregg, A. W. Dinsmore, James M. Johnson, M. F. Lake, J. C. Walker, and Wood E. Thompson, and the Governor of the State for the time being, and the President of said University; and they shall have all authority and necessary powers to carry out the provisions of said Act, and all subsequent Acts supplemental or amendatory thereof. The Governor shall ex-officio be President of said Board, and in his absence the members of the Board shall elect one of their number President; in case of a tie, the President of the Board, the President of the University, and Secretary of the Board by majority, shall cast the deciding vote; in all other cases they shall each have one vote as other members of the Board. A majority of said Trustees shall constitute a quorum to do business, but a less number may adjourn from time to time, and send for absent members; Provided, If said Trustees shall fail to accept the positions herein tendered them, or if a vacancy should otherwise occur, when the Legislature is not in session, the same shall be filled by the Governor by appointment.

SEC. 3. Be it further enacted, That at the annual meetings of said Board they shall elect one of their number Secretary, and another Treasurer, and such Committees as to them may appear necessary to carry out the provisions of the Acts aforesaid; and until such elections are had, Dudley E. Jones shall act as Secretary of said Board, and the President of said Uni

versity shall act as Treasurer, and he shall be responsible upon his official bond heretofore given, for his acts as such Treasurer and for all funds that may come into his hands belonging to said University; and A. W. Dinsmore, L. Gregg and James M. Johnson, shall act as a Building Committee, and shall have the same powers and perform the same duties as the former Building Committee of said Board.

SEC. 4. Be it further enacted, That it is made the duty of each of the said Trustees herein designated to attend a Board meeting at the University buildings, near Fayetteville, on the last Thursday in June, eighteen hundred and seventy-four (1874), and they shall meet at said place annually thereafter; and they shall have power to hold adjourned meetings when the business of the University actually require it, or the President of the Board may call a meeting of the Board, when he is satisfied the interests of the University requires, or when five members of the Board petition him so to do.

SEC. 5. Be it further enacted, That each one of the Trustees, whose office is vacated by this Act, is required forthwith to turn over to the Treasurer of the State, or the President of said University, all moneys, title papers, books, stationery and other property, or effects of every kind whatever, in his possession and belonging to said University; and it shall be the duty of said President and Treasurer of State to give a receipt for said property, etc., and they shall severally thereafter be responsible for all they may respectively so receipt for, and the same shall be held subject to the order of the Board or the President thereof.

SEC. 6. Be it further enacted, That this Act take effect and be in force from and after its passage.

AN ACT to repeal an Act entitled an Act in Relation to the Forfeited Lands in certain Counties in the State of Arkansas, approved April 29, 1873.

SECTION

1. Former act repealed.

2. Lands enumerated in said act and retired from sale, now

made subject to sale, entry,

etc.

SECTION

3. Conflicting laws repealed, and this act in force from passage.

Be it enacted by the General Assembly of the State of Arkansas in Extraordinary Session assembled:

SECTION 1. That Act number 136 being an Act entitled "An Act in relation to the forfeited lands in certain counties in the State of Arkansas," approved April 29, A. D. 1873, be and the same is hereby repealed.

SEC. 2. Be it further enacted, That all lands enumerated in said Act which have been retired from sale or entry, in accordance with the provisions of said Act, are hereby made subject to redemption, entry, or sale, at the State Land Office, according to provisions of law now in force.

SEC. 3. Be it further enacted, That all laws, and parts of laws, in conflict with this Act, are hereby repealed, and that this Act take effect and be in force from and after its passage. Approved May 30, 1874.

AN ACT to repeal an Act to regulate the Publication of Legal Notices, Approved July 14, 1868, and to Provide for the Manner of such Publication.

Be it enacted by the General Assembly of the State of Arkansas : SEC. 1. That the Act entitled "An Act to regulate the publication of legal notices," approved July 14, 1868, be, and the same is hereby repealed.

SEC. 2. Be it further enacted, That hereafter any and all legal advertisements which are by law required to be published in a newspaper, may be published in any newspaper published in the State of Arkansas. Provided, That notices pertaining to any suit in any court of justice or legal proceedings thereunder, and all notices of an official character which are or may hereafter be required by law to be published in any newspaper, shall be published in some newspaper in the county where such suits are or were pending, and where such proceedings are had; and when such official acts are to be, or have been performed, if there is any newspaper published in said county, and in case there is none, then in the nearest newspaper published thereto, having a circulation therein.

SEC. 3. The delinquent list of each county shall be published in some newspaper published in the county, and where there are more than one, in the one having the largest circulation in the county, and when there is no newspaper published in the county, in the one having the largest circulation therein; and the circulation shall be determined by the Circuit Court of each county.

SEC. 4. That all Acts, and parts of Acts, in conflict with this be, and the same are hereby repealed, and that this Act take effect, and be in force, from and after its passage,
